HomeMy WebLinkAbout20130654 Ver 1_USACE Permit_20130813 (2)SAW- 2013 -01151 SPECIAL CONDITIONS Action I.D. 4 SAW- 2013- 01151: NCDOT- Division 2, Bridge 223 on SR 1232 (Allen Gay Road) over Langs Mill Run near Fountain, Pitt County, North Carolina. Replace The existing 36' long by 29.3' wide concrete bridge on timber joists will be replaced with a proposed 31' -5" x T -3" aluminum box culvert with headwalls on existing location utilizing an offsite detour. 125 linear feet of permanent stream impacts, 25 linear feet of temporary stream impacts and 0.01 acres of permanent riparian wetland impacts are authorized by this verification. a) The pernittee shall follow best management practices outlined in NCDOT policy entitled "Bridge Demolition and Removal in Waters of the United States" (September 20, 1999) at all times. b) The pernittee shall follow best management practices outlined in NCDOT: Best Management Practices for the Protection of Surface Waters and Sedimentation and Erosion Control measures. C) The pernittee shall follow best management practices outlined in NCDOT: Design Standards in Sensitive Watersheds. d) Where construction activity (eg. pile driving /drilling) requires disturbance of the substrate below the mud bottom, the pernittee or its contractors will utilize a turbidity curtain to isolate suspended sediments associated with the construction activity from being distributed in the water column. e) Remove all temporary structures (temporary work bridges, cofferdam, erosion control devices) and return the project site to its original preconstruction contours and elevations upon completion of the project. f) No bridge demolition debris or excavated or fill material will be placed at any time, in any wetlands or surrounding waters, outside of the alignment of the fill area if indicated on the work plans. g) The pernittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). h) Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill, or inechanized land - clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands, or any activities that cause the degradation of waters or wetlands, except as authorized by this permit, or any modification to this permit. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the pernitted area. There shall be no excavation from, waste disposal into, or degradation of, jurisdictional waters or wetlands associated with this permit without appropriate modification of this pennit, including appropriate compensatory mitigation. i) The pernittee shall require its contractors and /or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and /or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions and any Corps approved modifications shall be available at the project site during construction and maintenance of this project. j) Any violation of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District, U.S. Army Corps of Engineers, within 24 hours of the violation. k) Compensatory mitigation for impacts to 125 linear feet of stream associated with the proposed project shall be provided by the North Carolina Department of Transportation ( NCDOT), sufficient to perform the restoration of 125 linear feet of warn water stream a in the Neuse River Basin, Cataloging Unit 03020203. NCDOT has agreed to be the responsible party for providing the required mitigation by having provided written confirnation, dated June 25, 2013, stating that they agree to accept responsibility for the mitigation work required and will debit the Wiggins Mill Mitigation Site in Wilson County for the required mitigation. 1) Failure to institute and carry out the details of special conditions a - n, above, may result in a directive to cease all ongoing and permitted work within waters and /or wetlands associated with TIP No. 41665.5A; Bridge 223 , or such other remedy as the District Engineer or his authorized representatives may seek.
