(SEPI) submits this Preconstruction Notification (PCN) form for impacts to Waters of the U.S. associated with the proposed Gem Street Extension Project. The purpose of this letter is to request approval for a Section 404 Nationwide Permit 14 and corresponding Section 401 General Water Quality Certification (No. 4135). The following is intended to summarize information provided in the corresponding PCN and assist you in your review. In addition to this cover letter, the following has been included to assist your review: • Attachment A – Agent Authorization • Attachment B – Signed Preliminary Jurisdictional Determination • Attachment C – USGS Topographic Map • Attachment D – NRCS Soil Survey Map • Attachment E – Project Drainage Plans • Attachment F – Project Impact Maps • Attachment G – Regulatory Support Documentation Purpose and Need The Town of Cornelius proposes to widen Willow and Gem streets and extend Gem Street to intersect with Oak Street. A sidewalk is proposed to be constructed on the north side of Willow and Gem streets. A paved parking area is also proposed to be constructed adjacent to the Gem Street extension. Storm drain improvements will be made within the Center Street right of way. The majority of the work will occur within the existing road right-of-way and powerline easement. Project Description The approximate 2.5-acre project study area runs along Willow Street and Gem Street for their entire lengths and from the end of Gem Street southeasterly to Oak Street. It also runs within the Center Street right-of- way from Willow Street south, approximately 700 feet. Land uses within the project study area is limited to single family residential and one business. Vegetation within and adjacent to the study area is comprised of maintained lawns and a maintained powerline right- of-way. 2 Resource Status The entirety of the proposed project is located within the Catawba River Basin (Hydrologic Unit Code 03050101) and all surface water at the project study area flows south to the McDowell Creek. The project is not, therefore, subject to State Riparian Buffer rules. Furthermore, based on a review of Mecklenburg County GIS, the streams in the project area are not subject to local riparian buffer regulations. Regulatory Approvals Environmental due-diligence for the project study area has been completed and a Preliminary Jurisdictional Determination was received on March 2, 2021 (SAW 2021-00440). One (1) jurisdictional stream occurs within the project limits. No wetlands are present within the project limits. Federally Protected Species As of June 17,2021, the United States Fish and Wildlife Service (USFWS) lists five federally protected species for Mecklenburg County (Table 1). Table 1. Surveys were completed on August 18, 2020 for those species with habitat within the project area and no individuals were identified. A September 13, 2021 screening by NC Natural 3 Heritage Program identified no known occurrences within one mile of the study area. Biological conclusions rendered above are based on these results. Lake Norman is just over one mile westerly of the study area and provides suitable foraging habitat for bald eagle. The study area is highly urbanized and developed, therefore not provided suitable nesting habitat. The project will not affect bald eagle. Impacts to Jurisdictional Resources and Mitigation Summary Proposed permanent impacts to jurisdictional areas total 124 linear feet of permanent stream impacts resulting from the channel stabilization and culvert installation at the new crossing as shown on the attached stream impact maps. This is below the 150 linear feet limit that triggers mitigation. The amount of stream impacts is below the amount requiring mitigation. Cultural Resources Based on coordination with the N.C. Department of Natural and Cultural Resources, no historical and/or cultural resources would be affected by the project (ER 20-1410). For purposes of computation of impacts, compensatory mitigation requirements, and other resource protection measures, a permit decision made on the basis of a preliminary JD will treat all waters and wetlands that would be affected in any way by the permitted activity on the site as if they are jurisdictional waters of the U.S. This preliminary determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part 331). The Corps of Engineers believes that there may be jurisdictional aquatic resources in the review area, and the requestor of this PJD is hereby advised of his or her option to request and obtain an approved JD (AJD) for that review area based on an informed decision after having discussed the various types of JDs and their characteristics and circumstances when they may be appropriate. 2. (SEPI) submits this Preconstruction Notification (PCN) form for impacts to Waters of the U.S. associated with the proposed Gem Street Extension Project. The purpose of this letter is to request approval for a Section 404 Nationwide Permit 14 and corresponding Section 401 General Water Quality Certification (No. 4135). The following is intended to summarize information provided in the corresponding PCN and assist you in your review. Purpose and Need The Town of Cornelius proposes to widen Willow and Gem streets and extend Gem Street to intersect with Oak Street. A sidewalk is proposed to be constructed on the north side of Willow and Gem streets. A paved parking area is also proposed to be constructed adjacent to the Gem Street extension. Storm drain improvements will be made within the Center Street right of way. The majority of the work will occur within the existing road right-of-way and powerline easement. Project Description The approximate 2.5-acre project study area runs along Willow Street and Gem Street for their entire lengths and from the end of Gem Street southeasterly to Oak Street. It also runs within the Center Street right-of- way from Willow Street south, approximately 700 feet. Land uses within the project study area is limited to single family residential and one business. Vegetation within and adjacent to the study area is comprised of maintained lawns and a maintained powerline right- of-way. Resource Status The entirety of the proposed project is located within the Catawba River Basin (Hydrologic Unit Code 03050101) and all surface water at the project study area flows south to the McDowell Creek. The project is not, therefore, subject to State Riparian Buffer rules. Furthermore, based on a review of Mecklenburg County GIS, the streams in the project area are not subject to local riparian buffer regulations. Regulatory Approvals Environmental due-diligence for the project study area has been completed and a Preliminary Jurisdictional Determination was received on March 2, 2021 (SAW 2021-00440). One (1) jurisdictional stream occurs within the project limits. No wetlands are present within the project limits. 2 Federally Protected Species As of June 17,2021, the United States Fish and Wildlife Service (USFWS) lists five federally protected species for Mecklenburg County (Table 1). Surveys were completed on August 18, 2020 for those species with habitat within the project area and no individuals were identified. A September 13, 2021 screening by NC Natural Heritage Program identified no known occurrences within one mile of the study area. Biological conclusions rendered above are based on these results. Lake Norman is just over one mile westerly of the study area and provides suitable foraging habitat for bald eagle. The study area is highly urbanized and developed, therefore not provided suitable nesting habitat. The project will not affect bald eagle. Impacts to Jurisdictional Resources and Mitigation Summary Proposed permanent impacts to jurisdictional areas total 124 linear feet of permanent stream impacts resulting from the channel stabilization and culvert installation at the new crossing as shown on the attached stream impact maps. This is below the 150 linear feet limit that triggers mitigation. The amount of stream impacts is below the amount requiring mitigation. 3 Cultural Resources Based on coordination with the N.C. Department of Natural and Cultural Resources, no historical and/or cultural resources would be affected by the project (ER 20-1410). If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specied. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacic Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. These habitats include seagrasses or submerged aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters. Some deepwater reef communities (coral or tubercid worm reefs) have also been excluded from the inventory. These habitats, because of their depth, go undetected by aerial imagery.
