We are in receipt of your Notice of Violation dated September 10, 2021. The violation is for the
monthly average limit for BOD5 for the month of April 2021. As the monitoring data indicates,
this parameter was in compliance both before and after the high sample event for the month. The
BOD5 samples are grab samples taken from the effluent flow from the final lagoon in the system.
On the day of the high BOD5 result, the regular plant operator was off and another town staff
member collected the sample. We cannot adequately verify that the sample was representation of
the actual discharge, but it is our believe that it was not. Grab samples taken from ":the lagoon
discharge should be taken several inches below the surface. The top of the surface layer will have
higher level's of algae and other floating debris which can increase the apparent BOD5. The Town -
will-take=streps-to=-train-al1staff-members who take compliance samples in the -proper -sampling
technique.
