III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;
however, DWQ may accept paperwork of any size. DWQ prefers full-size construction
drawings rather than a sequential sheet version of the full-size plans. If full-size plans are
reduced to a small scale such that the final version is illegible, the applicant will be informed that
the project has been placed on hold until decipherable maps are provided.

surrounding are is low-density development in the form of single-family residences on lots

10. Describe the overall project in detail, including the type of equipment to be used: The
project will entail subdividing the property to allow for single-family residential, low-density
development. Roadway and utility infrastructure will be installed, which will include
mechanized land clearing and rg adin~, installation of erosion control device as needed, and
asphalt~aving There will also be lot pre,~aration which will include septic tank absorption
field permitting and filling of wetlands to provide access to a few of the lots. All wetland
impact activities will be performed using mechanical equipment.
11. Explain the purpose of the proposed work: The purpose of the work is to create a
subdivision equipped with the necessary utilities to allow for construction of single-family
residences The proposed wetland impacts are necessary to provide continual roadway
access thro u~~h the site from Overlook Drive, to provide the necessary access to lots where
such access is impeded by the location of the wetlands, and to allow for the installation of
needed utility infrastructure. Other wetland impacts address the secondary and cumulative
impacts resulting from a portion of a wetland becoming isolated due to an impact.
IV. Prior Project History
If jurisdictional determinations and/or permits have been requested and/or obtained for this
project (including all prior phases of the same subdivision) in the past, please explain. Include
the USACE Action ID Number, DWQ Project Number, application date, and date permits and

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts

were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving.. similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http•//h2o enr.state.nc.us/ncwetlands/strm~ide.html.
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
The Ecosystem Enhancement Program has agreed to provide in-lieu mitigation coverage for

Non-impacted wetlands on the property will be subject to restrictive covenants; an example

Section VI. Proposed Impacts to Waters of the United States/Waters of the State
1. Provide a written description of the proposed impacts:
Impact Area 1 - A proposed driveway that will provide access to the majority interior of that lot (Lot
9) for house construction and/or septic system installation.
Impact Area 2 - A proposed roadway crossing with culvert to prevent upstream isolation, area for
subsurface utility infrastructure and drainage easement sloping.
Impact Area 3 - A proposed driveway crossing with culvert to prevent upstream isolation, which
will provide interior access for the entire lot (Lot 10).
Impact Area 4 - A proposed roadway crossing with culvert to prevent upstream isolation.
Impact Area 5 - A proposed driveway crossing with culvert to prevent upstream isolation, which
will provide interior access for the entire lot (Lot 19).
Impact Area 6 - A proposed cul-de-sac, and driveway access with culvert to gain access to develop
these lots (Lots 25 and 26).
Section VII. Impact Justification (Avoidance and minimization)
The first site plan included two additional wetland impacts due to roadway crossings. This would have
resulted in more direct impacts and more cumulative impacts due to areas upstream of the crossing
becoming hydrologically isolated.
The second site plan included one additional wetland impact associated with a berm for a drainage
easement in Lot 23. This impact has been removed.
The proposed driveway crossing at Impact 1 is necessary to provide access to the eastern portion of Lot
9. The impact is unavoidable because the wetland feature extends the entire width of the lot. Without
this impact, the lot would not have sufficient upland area to meet Pender County's subdivision
requirements and the lot would not have enough land on which to construct a house and septic system.
The impact was minimized by locating it at the most upstream location on the wetland finger as
possible, alleviating the concern of cumulative impacts.
The proposed roadway crossing culvert at Impact 2 is necessary to provide access to the northern portion
of the property. The impact is unavoidable due to the location, shape and orientation of that wetland
feature. The culvert will prevent isolation of upstream wetlands. Please note that curb and gutters will
not be used for this project and thus only one culvert will be used to prevent isolation of upstream

wetlands which will drain along the roadside ditch/swale and into the culvert. The impact is proposed
perpendicularly to, and at the confluence of, the three wetland fingers to minimize impacts. The
impacted area along the west side of the road will also be used for subsurface utility installation, and a
berm for the drainage easement, which are necessary for proper subdividing and development. For each
drainage easement, berms only extend l00 linear feet from the roadway. The remaining portion of the
easements that are within jurisdictional wetlands shall be undisturbed.
The proposed driveway culvert at Impact 3 is necessary to provide access to the interior of lot 10. The
culvert will prevent hydrologic isolation of the waters that extend through this lot. The impact is
unavoidable because the wetland feature extends the entire width of the lot. Without this impact, the lot
would not have sufficient upland area to meet Pender County's subdivision requirements and the lot
would not have enough land on which to construct a house and septic system. Please note that the
driveway could not be placed between the wetland fingers due to the presence of the culvert from impact
2.

of the property. The impact is unavoidable due to the location, shape and orientation of that wetland
feature. The culvert will prevent isolation of upstream wetlands. The impacted area along the west side

impact is unavoidable because the wetland feature extends the entire width of the lot. Without this

26. The impact is unavoidable because the wetland feature extends the entire width of the lots. The
culvert will prevent isolation of upstream wetlands.
Additionally, some issues were raised with respect to the buildability of Lot 35 and access to the pool
area across a wetland. Please refer to the schematics of Lot 35 and the proposed footbridge from the
parking lot to the pool area.
It should be noted that no impacts are proposed to perennial headwaters of Mill Creek, which comprise
approximately 40-50% of the area within the property boundary.
Section XI. Stormwater (required by DWQ): Describe impervious acreage (both existing and
proposed) versus total acreage on the site. Discuss Stormwater controls proposed in order to
protect surface waters and wetlands downstream from the property.

There is currently no impervious surface on the property. There is a proposed 1.44 acres of impervious
road surface proposed, and an additional 10.6 acres of impervious surface for individual lot
improvements. Stormwater controls on the site include grass-line swales. Development density was
kept below 25% impervious, thus no further stormwater controls are required.

I. Covenants and Restrictions Document Language:
The following language will be added to the recorded Covenants and
Restrictions Document:
"The areas shown on the recorded plat (identify the plat by title, date and recording date)
as conservation areas shall be maintained in perpetuity in their natural or mitigated
condition. No person or entity shall perform any of the following activities on such
conservation area:
a. fill, grade, excavate or perform and other land disturbing activities
b. cut, mow, burn, remove, or harm any vegetation
c. construct or place any roads, trails, walkways, building, mobile homes, signs,
utility poles or towers, or any other permanent or temporary structures
d. drain or otherwise disrupt or alter the hydrology or drainage ways of the
conservation area
e. dump or store soil, trash, or other waste
f. graze or water animals, or use for any agricultural or horticultural purpose
This covenant is intended to ensure continued compliance with the mitigation condition
of the Clean Water Act authorization issued by the United States of America, U.S. Army
Cops of Engineers, Wilmington District, Action ID # ,and therefore maybe
enforced by the United States of America. This covenant is to run with the land, and
shall be binding on the Owner, and all parties claiming under it."
II Permit Condition Language:
The following language will be accepted as conditions of the Permit:
A. "In the event that the recorded Covenants and Restrictions Document has a
provision that all, or some portion of the property owners can amend or modify said
document, then that provision shall include the following language in order to place the
property owners on notice and ensure that language mandated by the U.S. Army Corp of
Engineers, Wilmington District, as set forth in paragraph of this Attachment A, cannot be
modified, amended, or deleted without the express written consent of the U.S. Army
Corp of Engineer, Wilmington District.
`Notwithstanding anything contained within these Covenants
and Restrictions to the contrary, neither the property owners
in any percentage, nor any property owners association, may
modify, amend or delete, in any manner, Paragraph (to
be identified by its specific paragraph number) of these Covenants and
Restrictions regarding the prohibition of certain activities
in conservation areas, without the express written consent of
the U.S. Army Corp of Engineer, Wilmington District."'
B. "Perrriittee shall execute and cause to be recorded in the Pender County
Register of Deeds a Covenants and Restriction Document acceptable to the U,S. Army
Corp of Engineers for the purpose of maintaining the conservation areas, as show on the
recorded plat (identify plat by title, date, and recoding data) in their natural state
in perpetuity, prior to the sale conveyance of any lots or other property within the
subdivision. For so long as the permittee retains title to the property, the permittee shall
enforce the terms of the Covenants and Restrictions Document as same pertains to
maintaining the conservation areas and, prior to the conveyance of the property, shall
take no action on the property inconsistent with the terms thereof. The permittee shall
provide a copy of the recorded Covenants and Restrictions Document to the U.S. Army
Corp of Engineers, Wilmington District, within 15 days of recording."

The propose of this letter is to notify you that the North Carolina 8cosystem Enhancement Program (NC EEP) is willing to
accept payment for impacts associated with the above referenced project. Please note that this decision does not assure that

up to a 2:1 ratip, (buffers, Zone 1 at a 3:1 ratio and Zone 2 at a 1.5:1 ratio). The type and amount of the compensatory
mitigation wip be as specified in the Section 404 Permit and/or 401 'VVatcr Quality Certification, and/or CAMA Permit. The
mitigation will be performed in accordance with the lviemorandum of Understanding between the N. C. Department of
Environment and Natural .Resources and the U. S. Army Corps of Engineers dated November 4, 1998.
