Sec. 40-267. Fats, oils and greases.
(a) Purpose. The purpose of this section is to aid in the prevention of sanitary sewer blockages and
obstructions from contributions and accumulation of fats, oils, and greases into the sewer system from industrial
or commercial facilities, particularly food preparation and serving facilities.
(b) Definitions. The following words, terms and phrases, when used in this section, shall have the meanings
ascribed to them in this subsection, except where the context clearly indicates a different meaning:
Cooking facilities means those facilities primarily engaged in activities of preparing, serving, or otherwise making
available for consumption by the public such as restaurant, commercial kitchen, caterer, hotel, school, hospital,
prison, correctional facility, and care institution. These facilities use one or more of the following preparation
activities: cooking by frying (all methods), baking (all methods), grilling, sauteing, rotisserie cooking, broiling (all
methods), boiling, blanching, roasting, toasting, or poaching. Also included in this definition are infrared heating,
searing, barbecuing, and any other food preparation activity that produces a hot, nondrinkable food product in or
on a receptacle that requires washing. It is sometimes referred to herein as "food service facility."
Demand monitoring means that if set FOG limits are exceeded, the owner shall pay monitoring fees until limits are
achieved.
Fats, oils, and greases (FOG) means organic polar compounds derived from animal and/or plant sources that
contain multiple carbon chain triglyceride molecules. These substances are detectable and measurable using
analytical test procedures established in the United States Code of Federal Regulations 40 CFR 136, as may be
amended from time to time. All are sometimes referred to herein as "grease" or "greases."
Grease discharge permit (GDP) means a permit issued by the city authorizing the discharge of wastewater to the
wastewater collection system from a food service facility.
Grease management program coordinator (GPM coordinator) means the water/sewer/street superintendent or
other authorized employee of the city appointed by the city manager to implement a fats, oils, and greases (FOG)
control program.
Grease trap or interceptor means a device for separating and retaining waterbome greases and grease
complexes prior to the wastewater exiting the trap and entering the sanitary sewer collection and treatment
system. These devices also serve to collect settable solids, generated by and from food preparation activities,
prior to the water exiting the trap and entering the sanitary sewer collection and treatment system. Grease traps
are typically compact under -the -sink units that are near food preparation areas. Grease interceptors are often
below -ground units in outside areas and are built as two or three chamber baffled tanks. Grease traps and
interceptors are sometimes referred to herein as "grease interceptors."
Minimum design capability means the design features of a grease interceptor and its ability or volume required to
effectively intercept and retain greases from grease -laden wastewaters discharged to the public sanitary sewer.
Noncooking facilities means those facilities primarily engaged in the preparation of precooked foodstuffs that do
not include any form of cooking. These include cold dairy and frozen foodstuffs preparation and serving facilities.
It is sometimes referred to herein as "food service facility."
User means any person, including those located outside the jurisdictional limits of the city who contributes,
causes or permits the contribution or discharge of wastewater into the city sewer system, including persons who
contribute such wastewater from mobile sources, such as those who discharge hauled wastewater.
(c) Prohibitions. No food service facilities, existing or future shall connect to the city sewer system any fixture
that may be used to contain grease, without installing a grease interceptor or grease trap.
(d) Wastewater discharge limitations.
(1) No user shall allow wastewater discharge concentration from any grease interceptor, grease trap or
alternative pretreatment technology to exceed 200 milligrams per liter FOG, as defined by EPA test
method 1664 or 275 milligrams per liter FOG, as identified by EPA test method 413.
(2) The sampling and testing to demonstrate the concentration of grease in the discharge must be

conducted by the GMP Coordinator and measured in accordance with the analytical test procedures
established in 40 CFR 136 as amended from time to time. The city shall have the right to sample and
analyze the wastewater from any food service facility at any time to determine compliance with the
requirements of this section. If violations of the oil and grease limit are detected, enforcement action may
be initiated and demand monitoring costs billed to the food service facility.
(e) Implementation.
(1) All food service facilities are required to obtain a grease discharge permit from the city. The permit
shall be renewed annually, prior to the expiration date of the current year's permit. The fee for the grease
discharge permit will be set by the city council.
(2) All new food service facilities shall submit to the GMP coordinator, for approval, their grease
interceptor sizing plan prior to obtaining their building permit. All grease interceptors shall be readily and
easily accessible for cleaning and inspection. Existing facilities with planned modification to existing
plumbing systems will be required to include plans to comply with the grease interceptor requirements.
These facilities must obtain approval from, the GMP coordinator for grease interceptor sizing prior to
submitting plans for a building permit.
(3) All existing food service facilities connected to the city sewer shall be permitted to operate and
maintain existing grease interceptors provided their grease interceptors are in operating condition and
properly sized and do not exceed the limits set forth in subsection (d) of this section.
(4) The city may require an existing food service facility to install, operate and maintain a new grease
interceptor that complies with the requirements of this section or to modify or repair any noncompliant
plumbing or existing interceptor or trap within 180 days of written notification by the city.
(5) Except as provided in this section, for a period of one year following adoption of the ordinance from
which this section is derived, although installation of grease interceptors will be required to be installed,
no enforcement actions will be taken under this section for failure to achieve limits on grease discharges
from grease interceptors. If, during this one-year period an obstruction of a sewer main occurs that
causes a sewer overflow to the extent that an impact on the environment is realized and that the overflow
or failure of the sanitary sewer collection system to convey sewage can be attributed in part or in whole to
an accumulation of grease in the sewer main, the city will take appropriate enforcement actions, as
stipulated in section 40-266 against the generator or contributor of such grease.
(f) Grease interceptor maintenance, recordkeeping, and grease removal.
(1) Grease interceptors shall be installed by users as required by the GMP coordinator.
(2) Grease interceptors shall be constructed in strict accordance with the manufacturer's instructions or
by the design approved by the GMP coordinator at the user's expense.
(3) . Grease interceptor sizing and installation shall conform to the current edition of the North Carolina
Plumbing Code.
(4) The user shall maintain a written record of inspection and maintenance for three years. All such
records will be made available for on -site inspection by a representative of the city during all operating
hours.
(5) Grease interceptors shall be maintained in efficient operating conditions by periodic removal of the
accumulated grease as follows:
a. Grease interceptors: 'not less often than every 30 days.
b. Grease traps: not less often than every seven days.
c. No such collected grease shall be introduced into any drainage piping, or public or private
sewer.
(6) No nongrease laden sources are allowed to be connected to sewer lines intended for grease
interceptor service.

(g)
(7) Access manholes, with a minimum diameter of 24 inches, shall be provided over each grease
interceptor chamber and sanitary tee. The access manholes shall extend at least to finished grade and be
designed and maintained to prevent water inflow or infiltration. The manholes .shall also have readily
removable covers to facilitate inspection, grease removal, and wastewater sampling activities.
(8) Users who are required to pass water through a grease interceptor shall accept the following
conditions:
a. If any skimmed or pumped wastes or other materials removed from grease interceptors are
treated in any fashion on site and reintroduced back into the grease interceptor as an activity of
and after the on site treatment, the user shall be responsible for the attainment of established
grease numerical limit consistent with and contained in subsection (d) of this section on all
discharges of wastewater from the grease interceptor into the city sanitary sewer collection and
treatment system.
b. Operation of the grease interceptor in a manner so as to maintain the device such that
attainment of the grease limit is consistently achieved. The term "consistent" shall mean any
wastewater sample taken from the grease interceptor shall be subject to terms of numerical limit
attainment described in subsection (d) of this section.
c. That the use of biological additives as a grease degradation agent is conditionally
permissible, upon prior written approval by the GMP coordinator. Any facility using this method of
grease abatement shall maintain the trap or interceptor in such a manner that attainment of the
grease wastewater discharge limit, as measured from the trap's outlet, is consistently achieved.
d. That the use of automatic grease removal systems is conditionally permissible, upon prior
written approval by the GMP coordinator and the Scotland County Inspection Department. Any
facility using this equipment shall operate the system in such a manner that attainment of the
grease wastewater discharge limit, as measured from the unit's outlet, is consistently achieved.
e. That the GMP coordinator reserves the right to make determinations of grease interceptor
adequacy and need, based on review of all relevant information regarding grease interceptor
performance, facility site and building plan review and to require repairs to, or modification or
replacement of such traps.
f. Provide for a hydraulic retention time in accordance with the current edition of the North
Carolina Plumbing Code.
g. Grease interceptors shall be kept free of inorganic solid materials such as grit, rocks, gravel,
sand, eating utensils, cigarettes, shells, towels, rags, etc., which could settle into this pocket and
thereby reduce the effective volume of the device.
Variance from grease interceptor requirements.
(1) Grease interceptors required under this section shall be installed unless the GMP coordinator
authorizes the installation of an indoor grease trap or other altemative pretreatment technology and
determines that the installation of a grease interceptor would not be feasible. The food service facility
bears the burden of demonstrating that the installation of a grease interceptor is not feasible. The GMP
coordinator may authorize the installation of an indoor grease trap where the installation of a grease
interceptor is not feasible due to space constraints or other considerations. If a facility believes the
installation of a grease interceptor is not feasible, because of documented space constraints, the request
for an alternate grease removal device shall contain the following information:
a. Location of sewer main and easement in relation to available exterior space outside a
building.
b. Existing plumbing at or in a site that uses common plumbing for all services at that site.
(2) Alternative pretreatment technology includes, but is not limited to, devices that are used to trap,
separate and hold grease from wastewater and prevent it from being discharged into the sanitary sewer
collection system. All alternative pretreatment technology must be appropriately sized and approved by
the GMP coordinator.

(h) Fees and billing. The fees provided for in this section are separate and distinct from all other fees
chargeable by the city. All fees shall become immediately due and owing to the city upon receipt of invoices for
rendition of services or expenditure by the city and shall become delinquent if not fully paid within 30 days after
receipt. Any delinquent amount shall be subject to a late charge. All fees shall be set and adopted by the city
council.

Re: New Ordinance
This letter is to inform you of the new Fats, Oils, and Greases (FOG) Control
Ordinance that was adopted and passed on the 20th of May 2003. The purpose of this ordinance
is to aid in the prevention of sanitary sewer blockages and obstructions from contributions and
accumulation of fats, oils, and greases into the sewer system from industrial or commercial
facilities, particularly food preparation and serving facilities. The ordinance was necessary in
order for the City of Laurinburg to meet the requirements set forth in our System -Wide
Wastewater Collection System Permit issued by the North Carolina Environmental Management
Commission on the 19th day of April 2002. This permit requires the city to maintain an
educational and enforcement program that would require the proper operation and maintenance of
all grease traps and septic tanks connected to the wastewater collection system, by July 2003.
The educational program should target both residential and commercial users.
In accordance with the ordinance certain requirements will have to be met. Such
requirements are as follows: All food service facilities will be required to obtain a Grease
Discharge Permit from the city, which shall be renewed annually. The City may require an
existing food service facility to install, operate and maintain a new grease interceptor that
complies with the requirements of this ordinance or to modify or repair any noncompliant
plumbing or existing interceptor or trap within one hundred eighty (180) days of written
notification by the city. And that no food service facilities, existing or future shall connect to the
City of Laurinburg's sewer system any fixture that may be used to contain grease, without
installing a grease interceptor or grease trap. As a result of the ordinance, those affected will be
any person who contributes, causes or permits the contribution or discharge of wastewater into
the sewer system.
The City of Laurinburg has elected to defer enforcement actions associated with this
ordinance for one (1) year, although grease traps and grease interceptors will be required to be
installed on new facilities. The ordinance 0-2003-13 Fats, Oils, and Greases Control has been

PERTAINING TO A FATS; OILS, AND GREASES CONTROL ORDINANCE

Section 1: Article IV, Sewer Use, of the Laurinburg City Code is hereby amended by
adding the following section to the Article:
Sec.27-177 Purpose

(a) No user shall allow wastewater discharge concentration from any grease
interceptor, grease trap or altemative pretreatment technology to exceed 200
milligrams per liter FOG, as defined by EPA test method 1664 or 275 milligrams
per liter FOG, as identified by EPA test method 413.
(b) The sampling and testing to demonstrate the concentration of grease in the
discharge must be conducted by the GMP Coordinator and measured in
accordance with the analytical test procedures established in 40 CFR 136 as
amended from time to time. The City shall have the right to sample and analyze
the wastewater from any food service facility at any time to determine compliance

Sec. 27-181 Implementation

the city. The permit shall be renewed annually, prior to the expiraticn date of the
current years permit. The fee for the grease discharge permit will be set by City
Council.
All new food service facilities shall submit to the GMP Coordinator, for approval,
their grease interceptor sizing plan priorto obtaining their building permit. All
grease interceptors shall be readily and easily accessible for cleaning and
inspection. Existing facilities with planned modification to existing plumbing
systems will be required to include .plans to comply with the grease interceptor
requirements. These facilities m ust o btain approval from t he G MP C oordinator
for grease interceptor sizing prior to submitting plans for a building permit.

Except a s p rovided h erein, for a p eriod o f o ne year following a doption o f t his
Ordinance, although installation of grease interceptors will be required to be
installed, no enforcement actions will be taken under this Ordinance for failure to
achieve limits on grease discharges from grease interceptors. If, during this one
year period an obstruction of a sewer main(s) occurs that causes a sewer overflow
to the extent that an impact on the environment is realized and that said overflow
or failure of the sanitary sewer collection system to convey sewage can be
attributed in part or in whole to an accumulation of grease in the sewer main(s),
the City of Laurinbnrg will take appropriate enforcement actions, as stipulated in
Sec 27-176 of the Sewer Use Ordinance, against the generator or contributor of
such grease.

Sec. 27-182 Grease Interceptor Maintenance, Record Keeping, and Grease

for 3 years. All such record will be made available for on -site inspection by a
representative of the City of Laurinburg during all operating hours.
(e) Grease Interceptors shall be maintained in efficient operating conditions
by periodic removal of the accumulated grease as follows:
Grease Interceptors: not less often than every thirty (30) days.
Grease Trap: not less often than every seven (7) days.
No such collected grease shall be introduced into any drainage piping, or
public or private sewer.
(f) No non -grease laden sources are allowed to be connected to sewer lines
intended for Grease Interceptor service.
(g) Access manholes, with a minimum diameter of 24 inches, shall be
provided over each grease interceptor chamber and sanitary tee. The access manholes

water inflow or infiltration. The manholes shall also have readily removable covers to
facilitate inspection, grease removal, and wastewater sampling activities.
(h). Users who are required to pass water through a Grease Interceptor shall.
accept the following conditions:
1. That if any skimmed or pumped wastes or other materials removed from
Grease Interceptors 'are treated in any fashion onsite and reintroduced back into
the Grease Interceptor as an activity of and after said onsite treatment, the User
shall be responsible for the attainment of established Grease numerical limit
consistent with and contained in Sec. 27-180 on all discharges of wastewater from
said Grease Interceptor into the City of Laurinburg sanitary sewer collection and
treatment system.

2. Operate the Grease Interceptor in a manner so as to maintain said device
spa. l .that attainment of the. grease limit is consistently achieved. "Consistent" shall
mean any wart rater sample taken. from said Grease Interceptor shall be subject
to terms of numerical thrift attainment. described in see: 27-180.'
3. That the use of • biological additives : as a Grease degradation agent is
conditionally pemussible, upon prior written approval by the GMP Coordinator.
Any facility using this method of Grease abatement shall maintain the trap or
interceptor in such a manner that attainment of the Grease wastewater discharge
limit, as measured from the. trap's outlet; is consistently achieved.

burden of demonstrating that the installation of a grease interceptor is not feasible.
The GMP Coordinator may authorize the installation of an indoor grease trap
where the installation of a grease interceptor is not feasible due to space
constraints or other Considerations. If a facility believes the installation of a grease
interceptor is not feasible, because of documented space constraints, the request
for an alternate grease removal device shall contain the following information:
1. Location of sewer main and easement in relation to available exterior
space outside building.

Sec. 27-184 Fees
Fees and Billing. The fees provided for in this Ordinance are separate and distinct
from all other fees chargeable by the City. All fees shall become immediately due
and owing to the City upon receipt of invoice(s) for rendition of services or
expenditure by the City and shall become delinquent if not fully paid within 30
days after receipt. Any delinquent amount shall be subject to a late charge. All
fees shall be set and adopted by City Council.
Section 11. This ordinance shall be in full force on and after the 2" a day of June 2003.

In July, you should have received a letter .notifying you that the Fats, Oils, and Grease Ordinance was
adopted on the 20th of May 2003. That letter explained the purpose of the ordinance and what you as the
customer should expect as a result of it's passing. On November 18, 2003, city council adopted the new
schedule of fees for the City of Laurinburg that will be effective January 01, 2004.
The Grease Discharge Permit (GDP) Fee thatwas adopted will affect any facility that already has or is
deemed necessary, through inspection, to install and operate, modify or replace .a grease interceptor. The
purchase of a GDP will allow you to continue the discharge of wastewater into the wastewater collection
system. The cost of the permit will provide for inspections of the grease interceptor as needed throughout
the life of the permit and the collection of reports on cleaning, pumping, and maintenance of the
interceptor, and to sample and analyze the wastewater.
The life of a GDP will be one year (1) or until the business ceases to operate as a food service facility. A
new owner will be required to apply for a new GDP. The peiniit shall be purchased for the dates of January
1 to December 31 of the current year. If a facility opens or is required to purchase a permit within the
months of January to March the permit will cost $110.00, from April to June the cost will be $82.50, from
July to September the cost will be $55.00, and from October to December the cost will be $27.50 plus
$110.00 which will purchase the new permit for the upcoming year- total cost will be $137.50.
By filling out the enclosed form Grease Discharge Permit Information, it will provide the City of
Laurinburg with useful information on the owner and contacts, facility design, plumbing fixtures, and the
grease interceptor. It should be filled out completely and returned within thirty (30) days. This will allow
the City of Laurinburg to properly establish cleaning and maintenance requirements for the grease
interceptor(s) at your facility. Once the form is received at the Cross Connection Control Office, an
inspection of the facility and grease interceptor will be made. If you should have any questions or concerns

Attached is information relating to a proposed grease ordinance for the City of
Laurinburg. This ordinance is necessary as a result of the requirements set fourth in the
city's waste water collection permit issued by the State of North Carolina. Although the
city is not required to charge for this service, it is our recommendation that in keeping
with the idea of having various utilities be self-supporting and the idea that where costs
can be attributable to particular customers those customers are charged, that charging for
this service would be appropriate.

As a food service facility, you are required to obtain a Grease Discharge Permit (GDP)
from the City of Laurinburg. You must purchase the permit within thirty days (30) from the date
of this letter from the Consumer Billing Depaitalent located at 303 West Church Street. Your
permit will be given to you at this time. Failure to do so could subject you to enforcement action
as described in Code of Ordinances. General Provisions Sec. 1-10. The cost of this permit will
coincide with the date of this letter and the chart below. If the purchase date is within October and

Have you ever experienced a sanitary sewer back-up or overflow? Luckily, most sewer
back-ups and overflows can be prevented with a progressive preventive maintenance
program. All of us can help to prevent them by wisely using the City Of Laurinburg's
sanitary sewer system.
Sewer back-ups and overflows are frequently caused by improper materials such as fats,
oils and grease being placed into the sewer system. Since fats, oils and grease are lighter
than water they tend to accumulate at the top and sides of sewer pipes and can build up
until a blockage occurs. If a blockage happens, the sewer backs up or overflows resulting
in interior home damage, environmental damage and health hazards.
The City of Laurinburg's Fats, Oils, and Greases Ordinance requires that food service
facilities should install and maintain grease traps and/ or interceptors to prevent grease
from entering the sewer system. However, there are many more residential kitchens than
