Dear Mr. Kotis:
This letter is in reference to your permit minor modification request received August 25, 2021.
During the pre-review process, it was noted that the following items were missing from the
submitted application package:
1. Pursuant to 15A NCAC 02T .0106(b)(1), the request for the permit modification shall be signed
by a principal executive officer of at least the level of vice-president or his authorized
representative. If an authorized representative is to be used, pursuant to 15A NCAC 02T
.0106(c), delegation of authority to sign permit applications to other authorized employees or
any employee in a specific position shall be provided in writing to the Division and signed by
a principal executive officer of at least the level of vice-president. Accordingly, please
resubmit the minor modification request that has the authorization of the Permittee.
2. The constructed wetlands cells were modified January 28, 2008. Condition III.12. of that
permit and 15A NCAC 02T .0505(d) require that the constructed wetland cells have a two foot
freeboard. However, based upon the current 15A NCAC 02T rules, the Permittee may apply
for Alternative Design Criteria pursuant to 15A NCAC 02T .0105(n).
Accordingly, in order to utilize alternative design criteria, the Permittee shall demonstrate to
the Division that a one foot freeboard in the constructed wetland cells will provide:
a. Equal or better treatment of the waste;
b. Equal or better protection of the waters of the state; and
c. No increased potential for nuisance conditions from noise, odor, or vermin.
3. Pursuant to 15A NCAC 02T .0504(c)(1), please submit engineering plans that have been
signed, sealed, and dated by a North Carolina licensed Professional Engineer showing plan and
profile views of the constructed wetland cells that include their structural elevations (i.e. cell
bottom, top of berm, base of berm, influent/effluent inverts, etc.).

Accordingly, your permit minor modification request is being returned as incomplete per the
requirements in 15A NCAC 02T .0107(b).
-Discharge Branch process depends
upon the receipt of complete and accurate applications and supporting documentation. Please amend the
application package to include the previously noted omitted items and resubmit with the appropriate permit
processing fee.
Please be advised that construction and/or operation of the subject facilities without a valid
permit is a violation of G.S. 143-215.1, and may subject you to appropriate enforcement actions in
accordance with G.S. 143-215.6A-6C. Civil penalties of up to $25,000 per day per violation may be
assessed for failure to secure a valid permit.
