Hatley (Phase I) Bank Parcel Credit Release — Tasks 1, 2, 3, 7
Dear Mr. Rinker:
On December 28, 2012, the Division of Water Quality, hereby referred to as Division of Water
Resources (DWR) approved a Bank Parcel Development Package (BPDP) for the Hatley Bank
Parcel submitted by Environmental Banc & Exchange, LLC (EBX) on August 9, 2012. On May
10, 2013, the DWR received a signed and recorded conservation easement for Phase 1 of the
subject site assigned to the North Carolina Wildlife Habitat Foundation as the Grantee.
Additionally, EBX has elected to construct the subject project without posting a performance
bond. On June 14, 2013, DWR received an As -Built Report for Phase I of the subject site
submitted by EcoEngineering on behalf of EBX. On August 9, 2013, Katie Merritt, with DWR,
with assistance from Aaron Speaks with EBX, inspected the site to compare site conditions with
the As -Built report and confirm that the subject site had been completely planted and monitoring
devices had been established.
According to the UMBI signed on February 10, 2012, the following Project Milestones have
been met, and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have satisfied the above requirements
for the above - referenced tract and 55% of your Neuse riparian buffer credits (0.55 x 310,838 ft'
= 170,960.90 ft2) are now available for sale. Additionally, 55% of your nitrogen nutrient offset
credits (0.55 x 16,774.88 lb -N = 9,226.181b -N) and 55% of your phosphorous nutrient offset
credits (0.55 x 1,080.43 lb -P = 594.24 lb -P) are now available for sale.
Please note that nutrient offset credits generated at this site must be used for impacts in
HUC 03020201 of the Upper and Lower Falls Lake Watersheds as defined in 15A NCAC
02B .0276 and provided in 15A NCAC 02B .0282. Additionally, the riparian buffer credits
must be used for impacts in the Neuse River Basin according to guidelines in 15A NCAC
02B .0242.
Please use the attached Credit Ledger Template to track and report credit availability for the
Hatley (Phase I) Mitigation Bank. Upon receiving this correspondence, please submit three credit
ledgers to DWR reflecting the available credits released for each mitigation type.
