Durham, NC 27705 Subject Property: Teaches Point Phase V Tar-Pamlico Basin, Slade Gut, 030307, 29-19-9-4, SC, NSW REQUEST FOR MORE INFORMATION Dear Mr. Marsh: On May 23, 2007, the Division of Water Quality (DWQ) received your application dated May 1, 2007, to impact 744 square feet (ft2) of waters and 200 square feet (ft2} of protected riparian buffers to construct a pier and observation area on the subject property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetland, streams and/or buffers on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and 2B .0259($) and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Tar-Pamlico Riparian Buffer The project as proposed will impact Zone 1 of the Tar-Pamlico Protected Riparian Buffer (1 SA NCAC 02B .0259} with 200 (ft2) of open slatted deck. This impact is considered as impervious surface under the Tar-Pamlico Buffer regulations and is a "prohibited use". To continue with the project as proposed you must first obtain a Major Variance from the Environmental Management Commission allowing these impacts. If you. choose to remove this impact from your application. the DWQ can continue to review your project. If we do not hear from you within four weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
