If you plan to just breach the dam, for example take a notch out of the dam with an excavator, and place the dam material on high ground, you would NOT need a 404 permit. This is assuming that you are not discharging material into the stream. In this situation, I would also suggest pumping down the water as much as possible first so you don't have a heavy flow from the breach that causes sediment from the dam to go downstream. If you're proposing to use a BMP or check -dam, depending on the amount of impact, you would likely need a permit. Although we do not plan to begin construction until October at the earliest, we'd like to consider draining the pond ahead of construction to give it some time to dry before we work on it. It will be converted to wetland. Am I correct in assuming we would need the 401 and 404 before we drain it? Or is that something we could do before permits are issued but after the mitigation plan is conditionally approved? Thanks.
