To Kaylie Yankura, I am responding to your questions by filling in the answers after each question. Roger Peden Mr. Peden, On August 3, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on hold until the following items are addressed: 1. The drawings provided with the application indicate 300 linear feet of streambank stabilization, but this information is not included on the PCN impact table. Please confirm/indicate the total length of streambank proposed for stabilization activities. [15A NCAC 02H .0506(b)(1)] [15A NCAC 02H .0502(c)] The total length of the bank stabilization is 300 linear feet. 2. Per General Condition 11.9 of GC 4134, all work must be done "in the dry," so that the flowing stream does not come in contact with the disturbed work area. Therefore, dewatering methods will be necessary to temporarily dewater the stream channel and/or work area during bank stabilization activities. Please describe the proposed method for dewatering or diverting stream flow around the work area during bank stabilization. Examples include: pump around system, jersey barrier, cofferdams, rock berms, or other diversion structures. This work should be conducted during periods of low flow. [15A NCAC 02H .0506 (b)(2)] The dewatering method will a rock berm. The construction will begin at the up stream portion and will involve laying large boulders from the rock quarry to establish a river bank. The infill of dirt and rock berm will naturally divert the water without disruption of flow or foreign elements. 3. The construction drawing provided with the application proposes to "establish boulder rocks from riverbed to above high water line." Please indicate if you are proposing to use stone from the riverbed. The removal/dredging of stone from the riverbed for stabilization is not recommended. Boulders/stone associated with the project should be from a different source. [15A NCAC 02H .0506 (b)(2)] All materials will be trucked in and not materials, rocks, or any other materials will be removed from the river. The only thing removed from the actual river will be some fallen trees, brush and debris from flooding. Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received, the Division will be unable to approve the application and it will be returned. Please contact me if you have any questions.
