Amy, I talked with Louis King, the business that will be doing our Bank Stabilization Project work. Here are his answers to address these two questions: 1. Condition 9 of the attached GC 4134 requires that project activities shall be conducted so that the flowing stream does not come in contact with the disturbed area. In other words, no excavation in flowing water should occur. Please discuss how project activities will abide by this condition. Answer: If it becomes necessary that we will be at water's edge, we'll use a pump around system. 2. The stream adjacent to the project area is Class C; Trout waters. The water quality standard for Trout waters is 10 NTUs. There is no silt fence specified in the project application to protect surface waters. Please discuss how project activities will ensure that sediment does not enter the creek and that turbidity levels will not exceed 10 NTUs. Answer: We will do whatever measure necessary, silt fence, or waddles, to stop any sediment run off. If you have further questions, please let me know. As we discussed on the phone, I have a few questions as to how water quality standards will be protected / met during project activities. Please reach out to your contractor to discuss and send me an email when you have more information. On July 4, 2021, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project, with the appropriate fee received on July 14, 2021. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days. If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. I have also attached a resource guide for streambank stabilization that may help you stabilize the other side of the creek.
