This emails serves as a request for additional information to your submitted PCN on July 23, revised August 6, 2013.
1. Your proposal references Impact Area 1(culvert) as 0.0094 acre of permanent impact. According to the plans
submitted, this has not changed since the original 2009 request. However, impacts for this were authorized in 2009 at
0.012 acre. Please explain.
2. There is no justification for your need to retain the 0.0138 acre of permanent fill for "parking ". Please provide a full
explanation (to include why this wasn't originally proposed) with modified plans showing the additional parking spaces
needed. If this cannot be justified, please provide a restoration plan to remove the unauthorized fill material.
3. The relocated ditch connecting the pond to the main drainage artery must meet the terms and conditions of the
Nationwide Permit (management of water flows). Please provide information (as- builts) to support that the 2601f of new
drainage route is of similar width and depth as the original (filled) channel that it is replacing.
Please provide additional information to complete your permit request by August 23, 2013 or we will consider the
application incomplete and withdrawn.

In speaking with Ed, he installed an outfall ditch for the pond back in December or January. The attached map depicts, in
green, the approximate location of the rerouted ditch, which runs into the larger ditch that bisects the property. With
that said, can we use the rerouted ditch as mitigation for unauthorized fill?

The plans I have do not show a pipe and that was part of my initial confusion upon reviewing the permit. A culvert
seems necessary to maintain the drainage from the pond; simply filling the tributary would have the effect of an
impoundment and would cause overflow of the pond. Since both the pond and the tributary are considered
jurisdictional waters of the U.S., it is necessary that the fill does not disrupt the circulation and flow of water.
As our Nationwide Permits state, "the following General Conditions must be followed in order for any authorization by a
NWP to be valid ":
8. Adverse Effects From Impoundments. If the activity creates an impoundment of water, adverse effects to the aquatic
system due to accelerating the passage of water, and /or restricting its flow must be minimized to the maximum extent
practicable.
9. Management of Water Flows. To the maximum extent practicable, the pre- construction course, condition, capacity,
and location of open waters must be maintained for each activity, including stream channelization and storm water
management activities, except as provided below. The activity must be constructed to withstand expected high flows.
The activity must not restrict or impede the passage of normal or high flows, unless the primary purpose of the activity is
to impound water or manage high flows. The activity may alter the pre- construction course, condition, capacity, and
location of open waters if it benefits the aquatic environment (e.g., stream restoration or relocation activities).
As an alternative, if Mr. Burnett does not wish to install a culvert, he may revise his plans to relocate the tributary.

I believe I addressed everything in your letter dated 24 July 2013 within the PCN, except for the 198 linear feet of culvert
that you state needs to be installed in accordance with the verified plans. I have looked the plans over and do not see
where a pipe was proposed for this area. If you have plans or other docs that show the culvert, please email them to me.
