Dear Mr. Clark:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any
development approval issued by the Division of Water Quality under Article 21 of
Chapter 143 of the General Statutes, which is current and valid at any point between
January 1, 2008, and December 31, 2010. The law extends the effective period of any
stormwater permit that was set to expire during this time frame to three (3) years from
its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-
177, which granted an extra year for a total of four (4) years extension.
On March 8, 2012, Bill Clark Homes of Wilmington, LLC submitted an application to
transfer ownership of the permit. A file review and site inspection was performed on
March 16, 2012 by DWQ. As noted in the enclosed inspection report, the site is
currently in compliance with the terms and conditions of the current state stormwater
permit. The Division is hereby notifying you that permit SW8 040129 has been
transferred on March 21, 2012, and shall be effective until February 2, 2020, which
includes the 4-year extension. For your records, please find enclosed a copy of a new
updated page 2 of the previously issued permit, a copy of the inspection report, and a
copy of the Name/Ownership Change form submitted on March 8, 2012. Please attach
this cover letter and the new page 2 to your High Density Permit, originally issued on
June 13, 2005 and as modified thereafter.
This permit is subject to the conditions and limitations as specified therein. Please pay
special attention to the conditions listed in this permit regarding the Operation and
Maintenance of the.BMP(s), recordation of deed restrictions, procedures for changes of
ownership, transferring the permit, and renewing the permit. Failure to establish an
adequate system for operation and maintenance of the stormwater management
system, to record deed restrictions, to transfer the permit, or to renew the permit, will
result in future compliance problems.

have the right to request an adjudicatory hearing by filing a written petition with the
Office of Administrative Hearings (OAH). The written petition must conform to Chapter
150B of the North Carolina General Statutes, and must be filed with the OAH within
thirty (30) days of receipt of this permit. You should contact the OAH with all questions
regarding the filing fee (if a filing fee is required) and/or the details of the filing process

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of
North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of thirteen (13) infiltration basins in compliance
with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules`) and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water
Quality and considered a part of this permit.
This permit modifies Permit No. SW8 040129, issued June 13, 2005 as follows: (a)
modifies Drainage Areas 1A, 413, 5, 6, 7A, 713 and 8, including their built upon area
(BUA); (b) modifies the design of Infiltration Basins 5, 6, 7A, 713, and 8; (c) adds a
bypass for Infiltration Basin 8; (d) allocates 54 lots at 4,000 sq ft BUA each and 25 lots
at 3,300 sq ft BUA each for Phases II and III; and (e) changes the "Owner/Signing
Official' from Ms. Sonya A. Culler, Manager, to Mr. Edward H. Clark, Manager.
This permit shall be effective from the date of issuance until February 2, 2020 and shall
be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff from the specified built -upon area within the specified drainage area as
described in Section 1.6 on page 3 of this pg�rmit. The subdivision is permitted for
122 single family lots each allowed 3,290 ft of built -upon area (Phase 1), 54
single family lots each allowed 4,000 ft of built -upon area, 25 lots each allowed
3,300 ft2 of built -upon area, and ten (10) multi -family buildings (Phase 1) with a
total BUA of 150,241 ft2.
3. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.

STATE STORMWATER PERMIT TRANSFER REQUEST FORM
(Pursuant to N.C.G.S. 143-214.7(c2)/Session Law 2011-256)
This request form is for a transfer of the stormwater permit from a current permittee who is the
declarant of a condominium or declarant of a planned community (as defined in Chapter 47C or
Chapter 47F of the General Statutes, respectively) to a unit owners association, owners association,
or other management entity identified in the condominium or planned community's declaration
pursuant to N.C.G.S. 143-214.7(c2)/ Session Law 2011-256.
I. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer request.

This correspondence is to address the items on the NOI dated 2/15/2012. We have cleaned and placed sod in the swale
at basin 3B and have Informed the HOA that the Basin needs to be mowed by March 15'. If the HOA fails to mow the
Basin by this time Bill Clark Homes will mow this area and clean by the end of March. Please let me know if you need

Dear Board of Directors:
On October 13, 2011, the Wilmington Regional Office of the Division of Water Quality
inspected the storm water facilities in the Seaspray Community. It was noted that there
are two (2) basins within the Seaspray Condominium common area that are not in
compliance with the storm water permit. As per the Declaration of Condominium for
Seaspray Villas at Carolina Place, Article VII, Section 7.1(a), "The management,
replacement, maintenance, repair, alteration and improvement of the common elements
shall be the responsibility of the association, and, subject to the provisions of Section 7.2
hereof, the cost thereof shall be a common expense to the extent not paid by unit owners
pursuant to Section 71(b) hereof." Therefore, it is the responsibility of Seaspray
Condominium Association to maintain any and all storm water facilities located within
the Condominium common areas. The problems associated with Basin 2B and Basin 3B
are maintenance issues and therefore it is the Association's responsibility to bring Basin
2B and Basin 3B noted in the attached inspection report into compliance with the State
storm water permit.
Please contact me to discuss the schedule for which you will follow to bring these basins
into compliance. If a plan is not received by Bill Clark Homes prior to November 1,
2011, Bill Clark Homes will make arrangements for the basins to be brought into
compliance and Seaspray Condominium Association will need to reimburse Bill Clark
Homes.

Dear'Mr. Clark:
The Division acknowledges receipt of the transfer of ownership forms for the subject
Stormwater Management Permit on December 9, 2009. However, due to the following,
the request to transfer ownership of Permit Number is not acceptable.
A modification to this permit was issued to Mr. Edward H. Clark & Bill Clark Homes of
Wilmington, LLC on February 2, 2006.
It is the Division's policy to allow the transfer of approved stormwater facilities to a
Homeowner's Association (HOA) or Community Association after 50% of private lots
have been sold. The Community Association shall be legally established to provide for
required maintenance.
It is the Division's policy not to transfer permits from the permittee (as the developer), to
the same permittee as an officer in the HOA unless and until the permittee/developer is
no longer affiliated with the HOA, holds no office and has no majority vote in the HOA
based on the number of votes allowed per lot that remain in the permittee's possession.
It is customary to assign more votes per lot to the lots that are owned by the developer
or permittee, so it may take more than 50% of the lots to be sold to get to the point
where the permittee no longer has a majority vote.
As an alternative, the Division will transfer the permit to the HOA, or Community

Based on field survey previously provided by GeoInnovation along with recent observation
on April 10, 2008, we are prepared to move ahead with final certification to the Division of
Water Quality of stormwater facilities at the above referenced development. However, there
are several items that we feel should be noted for consideration in conveyance of the system
to the HOA. The following list describes these items of concern:
1. Yard Inlet #4 — Needs stable vegetation around it to prevent washouts and sediment
accumulation in the box (may want to consider sodding). Chicken wire is clogged.
2. Yard Inlet #6 — Sediment and overgrown vegetation have accumulated around weir.
3. Channel #1 — Vegetation is overgrown and needs to be mowed.
4. Channel #7 — Washed out sediment has accumulated at the point of discharge to the
infiltration basin (near the cul-de-sac). The sediment should be removed and the
washouts repaired. The channel and any disturbed area should be stabilized with
seeding (or sod).
5. Yard Inlet #2 — Clean out accumulated sediment around weir and.stabilize (sod).
6. Channel #5 — Needs to be stabilized with seeding or sod.
7. Flared End Section at Infiltration Basin #8 — Clean out dirt and grass.

GENERAL
Seaspray Cove Phases II & III is located in Carolina Place subdivision along Highway 133
in Brunswick County. The proposed project consists of 79 residential lots, with 24 having a
maximum allowable impervious surface of 3,300 sf and 55 having a maximum allowable
impervious surface of 4,000 sf. The existing site is partially wooded with 1-2% slopes
draining toward the existing phase I development and towards Dutchman Creek Canal.
Phases II & III were previously approved under permit SW8 040129, dated June 13, 2005.
We are requesting that the attached modification be approved in place of the previously
approved plans for Phases I I & III.
PROPOSED IMPROVEMENTS
Proposed improvements will involve the construction of 79 residential lots including roads
and utilities that drain to multiple proposed infiltration basins. The basins will improve
water quality for post development runoff as well as ensure that our post -development flow
is less than our pre -development flow for the 10-year event. Stormwater runoff will be
conveyed through grass swales and a stormwater collection system that is routed to the
infiltration basins. There are no wetland impacts within the limits of construction for
Phases II & Ill.
DRAINAGE CONSIDERATIONS
Runoff will be conveyed to the infiltration basins by means of swales, curb inlets and a
conduit system that runs along the proposed roads. The pipes were sized for a 10-year
storm event and the hydraulic gradient was maintained inside the pipe system during that
event. Infiltration basins #5, #6, VA and #713 were designed to store the first four and one-
half inches of rainfall over an average draw -down time of approximately 3 hours.
Infiltration basin #8 was designed to store and release the first three inchs of rainfall over an
average draw -down time of approximately 9 hours. The infiltration system was also
designed to store runoff from the 10-year, 24-hour event and hold discharge rates below
those for the predevelopment site. The ,grades shown on the plans are final grade
elevations. The plan currently proposed shows that the imperviousness of the Phase II and
III drainage area being conveyed to the basins will be approximately 39.3% During
construction silt fence, riprap apron, sediment trap (proposed basins), and construction
entrances will be placed in critical areas as directed by the Drainage Plan. All design
criteria is based on Brunswick County stormwater standards.
Drainage areas were delineated for determining the correct culvert size for each drainage
segment, and are shown on the drainage area map.
