The CCSS and the Commission hereby stipulate the following: (a) That the CCSS holds North Carolina NPDES Permits: NPDES Permit No. School NC 0045438 NC 0029297 NC 0051608 NC 0044059 Sherrills Ford Elementary Fred T. Foard High Bandys High Bunker Hill High for making outlets to waters of this State as required pursuant to NCGS 143-215.1a. (b) That the CCSS will be unable to comply with the final effluent limitations, that will be imposed upon the renewal of the current Permits without construction and proper operation of additional wastewater treatment facilities; (c) That noncompliance with the conditions of the Permits identified in 1(b) above constitutes causing/contributing to pollution of waters of this State; (d) That the CCSS is within the jurisdiction of the Commission as set forth in Chapter 143, Article 21 of the North Carolina General Statutes; (e) That the CCSS hereby waives its right to an administrative hearing authorized by NCGS 143-215.2 on the terms of this Special Order by Consent, and also hereby waives its rights to seek judicial review of this Special Order by Consent as provided in accordance with NCGS 143-215. 5 . 2. The CCSS, desiring to comply with conditions of the permits identified in paragraph 1(a) above, does hereby agree to do and perform all of the following: (a) Meet and comply with all.tertns and conditions of the permits. See Attachments A-D for monitoring requirements and effluent limitations. The permittee may also be required to monitor for other parameters as deemed necessary by the Director in future permits or Administrative letters. (b) Upon execution of this Order, undertake the following activities in accordance with the indicated time schedule: 1. Sherrills Ford Elementary - NC 0045438 a. Submit plans and specifications on or before January 1, 1991 for the extension of the current outfall line to a positive flow stream. MET b. Upon receipt of Authorization to Construct, begin construction by no later than April 1, 1991. MET c. Complete the extension of the outfall line by September 1, 1991. MET d. Attain full compliance with final effluent limits by October 1, 1991. MET 2. Fred T. Foard High - NC 0029297 a. Submit plans and specifications on or before January 1, 1991 for the extension of the current outfall line to a positive flow stream. MET b. Upon receipt of Authorization to Construct, begin construction by no later Char_ April 1; 1491 . MET c. Complete the extension of the outfall line by September 1, 1991. MET d. Attain full compliance with final effluent limits by October 1, 1991. MET 3. Bandys High - NC 0051608 a. Submit plans and specifications on or before October 1, 1991 for the extension of the current outfall line to a positive flow stream. MET b. Upon receipt of an Authorization to Construct, begin construction by no later than December 15, 1992. (MET) c. Complete the extension of the outfall line by January 1, 1993. d. Attain full compliance with final limits by February 1, 1993. 4. Bunker Hill High'- NC 0044059 a. Submit plans and specifications on or before October 1, 1991 for the extension of the current outfall line to a positive flow stream. MET b. Upon receipt of an Authorization to Construct, begin construction by no later than August 1, 1992. MET c. Complete the extension of the outfall line by November 1, 1992. MET d. Attain full compliance with final limits by February 1, 1993. (c) During the time in which this Special Order by Consent is effective, comply with the interim effluent limitations contained in Attachment A-D. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. (e) No later than January 31 of each year, submit to the Division Director a written status report of all the Special Order by Consent related activities that occurred during the past year and those that are planned for the coming year. This report should also include major maintenanca activities undertaken at each facility if applicable. Copies of this report shall be sent to the Regional Water Quality Supervisor and to the Division of Plant Operations. (f) The CCSS shall conduct a study of all cleaning compounds used by the schools in order to determine if the concentrations of NH3 as N in the effluent can. be reduced by using cleaning componds that do not contain ammonia. The resultsof this study Shall be reported to the Mooresville Regional Office on or before January 31 of each year the SOC is effective. 3. The CCSS shall pay the Commission the following stipulated penalties for failure to comply with the monthly average effluent limitations contained in Attachments A-D. Parameter Penalty Amount BOD $1000 per violation TSS $1000 per violation NH3 as N $1000 per violation 4. The CCSS shall pay the Commission a penalty of $2000.00 each for failure to meet any of the deadlines set forth in paragraph 2(b) 1-4. 5. Stipulated penalties will not be due if the CCSS satisfies the Commission that noncompliance was caused by events or circumstances beyond the CCSS's control.' 6. School Bunker Hill High School Catawba. County, NC Dear Mr. Everett: I regret my response to the above subject will be close to the fourteen (14) days time table. but I received your letter in my office on December 30. Even though it was addressed to me by certified mail, I was not the one that signed for it. 1 was very much aware that we would not meet our deadline of the Consent Order for the two subject schools. A letter was sent on September 25, 1991, (copy inclosed) stating this and the reason for our delay. I will try to give an update and go into more detail for the delay. As stated in my letter of September 25, we had some problems acquiring rights -of -way. The two subject schools outfall lines were funded in this year's budget. Although the SOC dates were previously set, we still had no funds for acquiring or buying land ar money for a consulting engineer or surveyor. Webegan in early July checking tax maps and land layouts (elevations) to try and. determine the least expensive and easiest routs for our outfall lines. At Bunker Hill High School (NC0044059) we had two options. The best option would be to use gravity outfall lines. The only problem here was the land we needed to cross was owned by a gentleman the Catawba County Schools had condemned some of his land a number of years ago. The second option and most expensive would be to pump the effluent across a ridge. We decided to go with the first option. With much negotiation using a go between contact initially then working directly with the land owner and eventually the land owners lawyer we have been promised access across this property. This right-of-way had to be handled with great.care and could not be pushed. At Bandys High School (NC0051608) we had as many as four options. Three of the options would require gravity outfall. lines and the last option would require pumping of the outfall line. After trying to make initial contacts with the 15 land owners, we turned to a real estate company to help with land negotiations. After weeks of negotiations by the real estate company on all three of the gravity outfall line location possibilities, the real estate company informed us of the opposition they had. . The 2 shortest routs each had at least one land owner totally opposed to us going across their land. We had success with the third option which was the longest. During the process, one of the pieces of land we needed to crossd changed owners. We were fortunate that the new land owner also agreed for us to cross his land. Our third option even required contact with DOT since it would require partially using a right-of- way on a state road. After we finally had the o.k. from land owners on the two subject schools, only then could we_begin the surveying and engineering work. Our surveyor also had to contend with some bad weather that delayed his work. The engineer could not do his designing until the surveying was completed. Bunker Hill High School was submitted on November 14th and Bandys High School was submitted December 1Gth. It took many hours of contacts and negotiations to arrive on agreements for the rights -of -way. It was very hard to explain to most land owners that you needed to run a "sewer" outfall line across their property. Even though we did not meet our deadline as previously agreed upon, I hope the above information shows some of the problems that caused the delays. Any consideration on waving the current penalties would be greatly appreciated. We certainly do not anticipate any more delays once our plans are approved. (f) The CCSS shall conduct a study of all cleaning compounds used by the schools in order to determine if the concentrations of NH3 as N in the effluent can be reduced by using cleaning componds that do not contain ammonia. The results of this study shall be reported to the Mooresville Regional Office on or before January 31 of each year the SOC is effective. ' 3.. The CCSS shall pay the Commission the following stipulated penalties for failure to comply with the monthly average effluent limitations contained in Attachments A-D. Agenda Item: Explanation: Consideration of Water Quality SOC for the Catawba County School System, Catawba County, North Carolina This SOC, EMC WQ 90-12, if issued to the Catawba County School System will allow two of the schools to exceed final effluent limitations for NH3 as N. The other two schools are included for the schedule only. Currently the school system operates septic tank and recirculating surface sand filters with disinfection. Treated effluent is discharged into various zero 7Q10 streams throughout Catawba County. The School System is planning to extend the outfall line at each facility to a "positive flow" stream. The first two schools will be completed by October 1, 1991 with the other two schools completed by October 1, 1992. The SOC is scheduled to expire on December 15, 1992. Recommendation: The Division recommends that the SOC for the Catawba County Schools be approved as proposed. This report should also include major maintenance activities undertaken at each facility if applicable. Copies of this report shall be sent -to the Regional Water Quality Supervisor and to the Division of Plant Operations. (b) That the CCSS will be unable to comply with the final effluent limitations: that will be imposed upon the renewal of the current Permits without construction and proper operation of additional wastewater treatment facilities; (c) That noncompliance with the conditions of the Permits identified in 1(b) above constitutes causing/contributing to pollution of waters of this State; (d) That the CCSS is within the jurisdiction of the Commission as set forth in Chapter 143, Article 21 of the North Carolina General Statutes; (e) That the CCSS hereby waives its right to an administrative hearing authorized by NCGS 143-215.2 on the terms of this Special Order by Consent, and also hereby waives its rights to seek judicial review of this Special Order by Consent as provided in accordance with NCGS 143-215.5. 2. In the case of noncompliance, the notice shall include a statement of the reason(s) for noncompliance, remedial action(s) taken, and a statement identifying the extent to which subsequent dates or times for accomplishment of listed activities may be affected. (e) No later than January 31 of each year, submit to the Division Director a written status report of all the Special Order by Consent related activities that occurred during the past year and those that are planned for the coming year. This report should also include major maintenance activities undertaken at each facility if applicable. Copies of this report shall be sent to the Regional Water Quality Supervisor and to the Division of Plant Operations. (f) The CCSS shall conduct a study of all cleaning compounds used by the schools in order to determine if the concentrations of NH3 as N in the effluent can be reduced by using cleaning compounds that do not contain ammonia. The results of this study shall be reported to the Mooresville Regional Office on or before January 31 of each year the SOC is effective. 3. The CCSS shall pay the Commission the following stipulated penalties for failure to comply with the monthly average effluent limitations contained in Attachments A-D. State of North Carolina Department of Environment, Health, and Natural Resources 919 N. 14ain St. Mooresville, NC 28115 Dear Mr. Gleason: As per your letter of February 9th, the Catawba County Schools are requesting a Special Order by Consent for discharges at Sherrills Ford Elementary, Bandys High, Fred T. Foard High and Bunker Hill High. This Special Order will be needed until we can extend the current discharges in dry ditches to a positive 7Q10 or 30Q2 stream. As you know, we have already sent information in trying to determine a new discharge point. From the information I received in December, we have pinpointed an adequate discharge point for Bunker Hill High and Sherrills Ford Elementary. Our proposed point for Fred T. Foard can be extended as per Division of Environmental. Management's recommendation. Bandys was also recommended to be extended but I would like to have an on site evaluation for this discharge. The recommended discharge from Division of Environmental Management would have to extend through several more property owners and may become very costly. The following schedule will be followed if several matters can be resolved: 1. Funding from the Catawba County Commissioners. 2. We do not have to go to court over right of ways for our new discharge lines. Sherrills Ford Elementary, Fred T. Foard High: July 1, 1990 - If funding is provided, begin acquiring right of way, apply for permit, design work, and bid project. Complete both projects during 1990- 91 school year. Bunker Hill High, Bandys High: July 1, 1991 - Follow same procedure as above and complete these two projects during 1991-92 school year. If any other information is needed, please advise.
