Dear. Mr. Forehand:
In accordance with your application for discharge permit received on April 27, 1990, we are
forwarding herewith the subject State - NPDES permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and,the U.S. Environmental Protection Agency dated December 6, 1983.
The following comments/modifications are made in response to your letter of September 14, 1993,
regarding your draft permit:
1) Part I, Section B, Schedule of Compliance -
• 001 - The effective date will be 30 days, or more, after issuance.
• 002 - Due to the permit's effective date, testing will start in 1994.
2) Part II, Section D, Monitoring and Records-
• Representative Sampling - The acute toxicity sample may be collected from the discharge
pipe to the Haw River.
• Reporting - Toxicity information reported on the MR-1 form for pipe 001 should include the
parameter code TAA3D if Daphnia pulex is used as the test organism and TAA3B if
Ceriodaphnia dubia is used as the test organism and the test result (LC50). The contract
laboratory's report is acceptable for quarterly OCPSF testing results. A supplement can be
attached to that showing the mass calculation (including the flow used in the calculation).
The assumption regarding calculation of a monthly average is correct, however, quarterly
sampling data may be representative of a monthly average for determining compliance.

• Test Procedures - Special conditions "H", "I" and "J" have been added to address concerns
with the OCPSF testing procedures.
3) Part III, Section E, Acute Toxicity Permit Limit -
• The toxicity limitation should read 90% and allow the option of using either Daphnia pulex
or Ceriodaphnia with the appropriate parameter code reported on the MR-1.
The following comments/modifications are made in response to your letter of January 4, 1994,
regarding your revised draft permit:
1) Cover Sheet -
• The facility name has been corrected to "AlliedSignal FIBERS".
2) Effluent Limitations and Monitoring Requirements for Outfall 001 -
• Radioactivity monitoring - gross beta particle activity has been specified.
3) Part III, Special Conditions H, I, and J -
• Special Condition H - Twelve sampling results is the Division policy when considering
reduction in OCPSF monitoring frequency. Therefore, quarterly sampling for three years is
required. This is consistent with EPA procedures and has been applied to all other OCPSF
facilities in North Carolina.
• Special Condition I - Correct. Any number preceded by a less than should be entered as a
zero when calculating averages.
• Special Condition J - DEM cannot issue a permit allowing utilization of a test method that
cannot show that permit limits are not being exceeded when an approved EPA test method
exists having this capability. AlliedSignal's letter requesting use of method 524.2 has been
sent to the EPA for review. Until such time as method 524.2 is approved as an alternate, or if
it is not approved, the approved EPA method with the minimum detection and reporting levels
that are below the permit discharge requirements must be utilized.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicative hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611 -7447.
Unless such demand is made, this decision shall be final and binding.
Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be
followed in case of change in ownership or control of this discharge.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Environmental Management or permits required by the Division of Land Resources,
Coastal Area Management Act or any other Federal or Local governmental permit that may be
required.

1. Continue to operate the existing 0.244 MGD wastewater treatment facility
consisting of an aeration basin, clarifier, sludge drying bed, chlorine gas
chlorination, and chlorine contact chamber with discharge through outfall 001,
and continue to discharge stormwater, condensate, and firepond overflow
through outfall 002 located at AlliedSignal FIBERS, off of NCSR 1972, east of
Haywood, Chatham County (See Part III of this Permit), and
2. Discharge from said treatment works at the location specified on the attached
map into the Haw River (outfall 001) and into an unnamed tributary to Shaddox
Creek (outfall 002), both classified as Class C waters in the Cape Fear River
Basin.

THERE SHALL BE NO CHROMIUM, ZINC, OR COPPER ADDED TO THE COOLING WA FER.

Benzo(a)pyrene; 3,4-Benzofluoranthene; Benzo(k)fluoranthene, Chrysene, Dibenz (a,h) anthracene and
Indeno (1,2,3 - ed) pyrene.

E. ACU FE TOXICITY PERMIT LIMIT (QRTRLY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined as
definitive in E.P.A. Document 600/4-85/013 entitled "The Acute Toxicity of Effluents to
Freshwater and Marine Organisms." The monitoring shall be performed as a Daphnia pulex or
Ceriodaphnia 48 hour static test, using effluent collected as a 24 hour composite. The LC50 of this
effluent using the previously stated methodology may at no time in any toxicity test be less than
90%. Effluent samples for self -monitoring purposes must be obtained during representative
effluent discharge below all waste treatment. The first test will be performed after thirty days from
the effective date of this permit during the months of January, April, July and October.
The parameter code for this test if using Daphnia pulex is TAA3D. The parameter code for this test
if using Ceriodaphnia is TAA3B. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in
which it was performed, using the appropriate parameter code. Additionally, DEM Form AT-1
(original) is to be sent to the following address:

Test data shall be complete and accurate and include all .supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North
Carolina Division of Environmental Management indicate potential impacts to the receiving stream,
this permit may be re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum
control organism survival and appropriate environmental controls, shall constitute an invalid test
and will require immediate retesting(within 30 days of initial monitoring event). Failure to submit
suitable test results will constitute noncompliance with monitoring requirements.
F. ACUTE TOXICITY MONITORING (EPISODIC)
The permittee shall conduct FIVE acute toxicity tests using protocols defined as definitive in
E.P.A. Document 600/4-85/013 entitled "The Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales
promelas) 24 hour static test, using effluent collected as a single grab sample. Effluent samples
for self -monitoring purposes must be obtained below all waste treatment. Sampling and
subsequent testing will occur during the first five discrete discharge events after the effective date
of this permit. After monitoring of the first five toxicity tests, the permittee will conduct one test
annually, with the annual period beginning in January of the next calendar year. The annual test
requirement must be performed and reported by June 30. If no discharge occurs by June 30,
notification will be made to the Division by this date. Toxicity testing will be performed on the
next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this
permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it
was performed, using the appropriate parameter code. Additionally, DEM Form AT-1 (original) is

G. Biocide Condition
The permittee shall not use any biocides except those approved in conjunction with the permit
application. The permittee shall notify the Director in writing not later than ninety (90) days prior
to instituting use of any additional biocide used in cooling systems which may be toxic to aquatic
life other than those previously reported to the Division of Environmental Management. Such
notification shall include completion of Biocide Worksheet Form 101 and a map locating the
discharge point and receiving stream.
H. After monitoring for a minimum of a three year period, upon written request, OCPSF
monitoring data will be reviewed by the Division of Environmental Management to determine if a
reduction in monitoring frequency is warranted. Data submitted for review should be in a tabular
format for the sampling period under consideration.
I. When an approved analytical protocol with the appropriate minimum detection level is followed
and a result of "non -detectable" or "below quantitation limit" is obtained, the permittee will be
considered to be in compliance with the numerical permit limit for that pollutant.
J. ALTERNATIVE TEST METHODS FOR OCPSF PARAMETERS
The use of an alternative test method other than those listed in 40 CFR Part 136 for OCPSF
parameters will be allowed by the Division of Environmental Management if utilization of the
subject method is approved by the Environmental Protection Agency (EPA) prior to
implementation. Until such approval is provided by the EPA, the permittee shall follow the test
methods specified in 40 CFR Part 136. Specifically, test methods must be utilized that produce
minimum detection and reporting levels demonstrating that pollutants in the effluent are not present
in amounts exceeding permit limitations.
