Dear Mr. Greene:
On August 10, 2021, the Division of Energy, Mineral and Land Resources received information regarding
the proposed subject project. In accordance with the requirements of NCAC 2H.1000 (the stormwater
rules), only those applicable development activities that are subject to one or more of the stormwater post -
construction programs outlined in 15A NCAC 02H .1001(2) must submit for and receive a Stormwater
Management Permit prior to construction.
In this case, your consultant has indicated that the project has not triggered any of the submittal
requirements. The project is not currently located within the jurisdiction of any of the stormwater post -
construction programs outlined in 15A NCAC 02H .1001(2), therefore, the Division is providing
confirmation that the project is not subject to the State Stormwater requirements at this time.
Please keep in mind that this determination applies only to the current activity. If future development
occurs within the jurisdiction of any of the stormwater post -construction programs outlined in 15A
NCAC 02H .1001(2), the project will be deemed subject and must submit a Stormwater Management
Permit application prior to any construction.
