between the DEPARTMENT OF TRANSPORTATION, an agency of the STATE OF NORTH
CAROLINA, 1 South Wilmington Street, Raleigh, NC 27601 (hereinafter "GRANTOR"), and
Greater Asheville Regional Airport Authority, 61 Terminal Drive, Suite 1, Fletcher, NC 28732
(hereinafter "GRANTEE");

WITNESSETH:
THAT WHEREAS, the Department of Transportation, in the construction of Project No.
I-5501(46292.3.1) in HENDERSON County, North Carolina acquired certain lands from Murphy
Wilson Investment Co., a N.C. General Partnership, Kenneth D. Murphy and Ken Wilson,
Partners recorded July 8, 2014, in Deed Book 1571 at Page 432 in the HENDERSON County
Registry; and
WHEREAS, the GRANTEE was the highest bidder at public sale, with a bid in the amount
of Thirty -Three Thousand Eight Hundred Seventy -Five Dollars ($33,875.00); and
WHEREAS, the Board of Transportation has approved this transaction by resolution
passed on March 04, 2021;
WHEREAS, the Council of State has approved of this transaction by resolution passed on
June 1, 2021;
NOW, THEREFORE, for and in consideration of the premises and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the GRANTOR,
subject to any reservations and condition hereinafter set forth, has bargained and sold, and by these
presents does bargain, sell, grant and convey unto the GRANTEE, its successors and assigns, in
fee simple absolute, that tract or parcel of land lying and being in HENDERSON County, North
Carolina, more particularly described as follows:
BEGINNING at a point 23.66 feet left of and normal to Survey Station 11+00.00 Survey
Line Y-1 as shown on a plat entitled "A Boundary Survey of N.C.D.O.T. Property" Prepared by
Location & Surveys Unit Division 14, Sylva with said survey being on file in the Office of the
Department of Transportation in Raleigh, NC; thence N 13' 55' 21" W 38.37 feet to a R/W
Monument located 60.51 feet left of and normal to Survey station 10+89.33 Survey Line Y-1;
thence along and with the common property boundary of Buncombe County and Henderson
County South 88' 06' 45" East 123.27 feet to a REBAR located 63.00 Left of and normal to
Survey station 10+64.60 Survey Line Yl; thence South 08' 51' 38" East 36.77 feet to a R/W
Monument located 29.91 feet left of and normal to survey station 12+20. 00; thence North 880
29' 2 1 " West 119.68 to the point and place of BEGINNING and containing 0.117 acre more or

This conveyance is made subject to any underground or above -ground utilities in
existence at the time of this conveyance to GRANTEE, and is subject to any recorded and/or
unrecorded easements, encumbrances or right-of-way, known and visible within the boundaries
of the property conveyed hereby. This conveyance is also subject to the above -referenced
Highway Project and any Control of Access imposed pursuant to the Project.
TO HAVE AND TO HOLD the above -described lands and premises together with all the
privileges and appurtenances thereunto belong to the said GRANTEE, its successors and assigns,
in fee simple absolute forever, subject always to the reservations and conditions hereinabove set
forth.
The GRANTOR makes no warranty, express or implied, as to title to the property
hereinabove described.
IN WITNESS WHEREOF, His Excellency, Roy Cooper, Governor of the State of North
Carolina, upon the application of the Department of Transportation, and by and with the approval
of the Council of State, does hereby execute this deed in the name of the State of North Carolina,
and the same is attested by the Secretary of State, and the Great Seal of the State of North
Carolina is affixed hereto; all in accordance with the provisions of North Carolina General
Statutes §§146-74 through 146-78.
