Arnett Water Pollution Control System Operators Certification Commission - Certificates: WW-3 #13446 and Land Application #13507 Dear Mr. Arnett: This letter provides notice of the decision to revoke your Water Pollution Control System Operators' Certification Commission certificates (WW-3 #13446 and Land Application # 13507) as provided in 15A NCAC 8G .0802. The decision to revoke your certificates is based on at least one of the six "Grounds for Disciplinary Actions" called for in 14A NCAC 08G .0801 (2), failure to use reasonable care or judgment in the performance of duties. I have based this, decision on the information presented both orally and in writing to the advisory committee at a meeting held April 11, 2007. The information presented during the meeting revealed that you were responsible for the unpermitted discharge of biosolids (sludge) from the Laurinburg-Maxton Airport Commission wastewater treatment facility into the waters of the state of North Carolina. The aforementioned. action also represents .a failure to adhere to the Responsibilities Of All Certified Operators set forth in 15A NCAC 08G .0203 (2) (4), which states that certified operators must comply with all statues and rules regarding the operation of water pollution control systems. This revocation is effective twenty (20) days from the date you receive this notice, as evidenced by the Return Receipt Card. If you wish to contest the revocation of these certificates, you must file a written petition for contested case hearing with the Commission as provided in the Administrative Procedure .Act, NCGS Chapter 150B within fifteen (15) days of receipt of this notice.
