PROJECT SUMMARY: The applicant proposes to reconfigure an existing subdivision resulting in the addition of 9 lots, install gravity sewer, extend waterlines and construct 17 single family dwellings. Scotch Bonnet Soundside Page Two 9. PROJECT DESCRIPTION: Charles F. Riggs and Associates, Inc., on behalf of Wellman's Construction Inc. / Scotch Bonnet Soundside, have requested that the attached application be processed under the Express Review Permitting Program. The applicant's project is located along N.C. State Highway 210, just north of Ninth Street, approximately 0.1 miles north of the Town line of Surf City and North Topsail Beach, adjacent to Stump Sound, in North Topsail Beach, Onslow County. To find the property, take Highway 17 North from Wilmington and turn right on N.C. State Highway 50 (approximately 30 miles from Wilmington). Head east on Hwy 50 and turn left onto Hwy 210 at the intersection of Hwy 210 and Hwy 50. The property is located on the western side of Hwy 210, approximately 2.5 miles from the intersection of Hwy 210 and Hwy 50. Ninth Street borders the property to the south and Seaside Developers, LLC, borders the tract to the north. Scotch Bonnet Soundside is an existing 10 lot subdivision which was originally permitted under the Express Permit Program on August 11, 2004 (CAMA Major Permit #120 -04). The subdivision is approximately 7.65 acres and is bordered along the north west side by both coastal wetlands and "404" type wetlands. The high ground portion of the tract is relatively flat with an average elevation of 4.0' above Normal Low Water (NLW). Several small stands of Southern Wax Myrtles (Merica cerifera), Yaupons (Ilex vomitoria), and Red Cedars (Juniperus virginiana) exist on the water ward side of the site, bordering Stump Sound. The tract has approximately 1,270 linear feet of shoreline along Stump Sound. The high ground vegetation is bordered by transitional species including Sea Oxeye (Borrichia frutescens) and Grounsel -bush (Baccharus halimifolia). High coastal marsh vegetation, including, Black Needle Rush (Juncus roemarianus), Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp), and Salt Meadow Grass (Spartina patens) complete the transition to the water's edge where Smooth Cordgrass Marsh (Spartina alterniora) is the predominant species. The shoreline in this area is not bulk - headed. The applicant received a Notification of Jurisdictional Determination (SAW- 2012 - 02013) from the U.S. Army Corps of Engineers on December 14, 2012. The property is accessed from NC 210 / Island Drive via Scotch Bonnet Circle which runs along the southwestern property boundary, turns eastward through the center of the subdivision and currently ends in a cul -de -sac. Currently the only structures which have been constructed are the community swimming pool with concrete decking, pool house and fence. Lots 3 & 4 within_ the subdivision are privately owned and are not included in the current proposal with the exception of utilities. The waters of Stump Sound, adjacent to the project site, are classified as SA by the North Carolina Division of Water Quality. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. According to maps provided by the Department of Environmental Health, Shellfish Sanitation Section, the area located within the ninth street canal is CLOSED to the harvesting of shellfish; however, the remaining waters bordering the subject property are OPEN. The subject property is located within the High Hazard Flood Area, as indicated by Zone VE (elevation 11) on the Flood Insurance Rate Map. The High Hazard Flood Area (VE Zone) associated with the subject property is contiguous to the Atlantic Ocean. A portion of the property is also located within the 75' Estuarine Shoreline AEC. PROPOSED PROJECT: The applicant proposes to reconfigure an existing subdivision resulting in the addition of 9 lots, install gravity sewer, extend waterlines and construct 17 single family dwellings. Originally, Scotch Bonnet Soundside was created as a 10 lot subdivision with a series of ten (10) individual septic systems to be located in a designated septic field along the eastern property line. The applicant states that Pluris, LLC now has the capacity to handle wastewater for the subdivision. Therefore, the applicant proposes to install gravity sewer lines to accommodate the subdivision and abandon the original septic field. The gravity sewer lines would extend along NC Hwy 210 approximately 240 feet northeast to an existing lift station. As proposed, the original septic field area would be reconfigured for an additional 6 lots (Lots 12 -17). The applicant is also proposing to convert a portion of the originally designated "Common Scotch Bonnet Soundside Page Three Recreational Area" located adjacent to the existing swimming pool on the west side, to 2 additional lots ( Lots 18 & 19). This reconfiguration would result in a total of 19 lots for the subdivision of which only 17 are owned by the applicant. Individual lots sizes would range from 5,843 to 35,982 square feet - a density of 2.48 units /acre. As proposed, the existing cul -de -sac would be removed; the road extended approximately 125' eastward with a hammerhead turn around in the center of what is currently Lot 10, and Lot 10 would be subdivided into 2 lots (Lots 10 & 11). New gravity sewer lines and waterlines would be installed adjacent to the road to service all the lots within the subdivision. The applicant is also proposing to construct 17 identical single family dwellings on pilings on all lots with the exception of Lots 3 & 4 (which are not owned by the applicant). Each of the proposed dwellings would have a footprint of approximately 26' in width by 36' in length (as measured from drip line to drip line) with a 6' wide by 24'long open deck on the front of each dwelling. As proposed, each dwelling would have a concrete driveway measuring approximately 20' in width, extending from the road to the front of the dwelling (averaging approximately 30' in length). According to the site drawings, the total built upon area for lots 1, 3, 4 and 5 would be 2,600 square feet. The remaining lots would have a total built upon area allowance of 2,050 square feet of impervious coverage. The applicant has received a Low Density Stonmwater Permit No. S W8130505 on May 22, 2013 from the North Carolina Division of Water Quality. In addition, the applicant has an approved Sedimentation and Erosion Control Plan (No.Onslo- 2013 -092), which was validated on May 2, 2013 by the NC Division of Energy, Mineral and Land Resources. Municipal water would be provided to the subdivision by Onslow County Water. As proposed, no portion of the dwellings, eaves, driveways, streets or utility installation would impact any portion of coastal wetlands or "404" type wetlands. 10. ANTICIPATED UAPACTS: As proposed, the road extension and installation of utilities would result in 11,848 sq. ft. (0.272 acres) of land disturbance. The proposed dwellings would result in 37,462 sq. ft. (0.86 acres) of high ground disturbance and the proposed driveways would result in 26,920 sq. ft. (0.618 acres) of high ground disturbance. A total of 1.75 acres of high ground would be disturbed as a result of the proposed project. Total impervious coverage within the 75' Estuarine Shoreline AEC would be 3,061 square feet, or 3.3 %. This subdivision was created by Scotch Bonnet Enterprises, Inc. c/o Mr. Robert W. Gilbert, 124 Martin Lane, Sneads Ferry, North Carolina 28460. This property is located in the Cape Fear River Basin with Banks Channel listed as the receiving stream and the stream class was SA;HQW. This subdivision has existing asphalt streets, water service from ONWASA and an existing private pool for the subdivision. All infrastructure was installed with the exception of the proposed septic fields for the proposed homes. This property is presently vacant. All infrastructure was installed properly and I am unaware of any violations or issues related to this project. This Permit is SW8 040501 MOD. RECEIVED DCM WILMINGTON, NC JUL 2 4 2013 PROPOSED and/or CURRENT CONDITIONS The entire property is presently owned by Wellman's Construction Inc. & Thomas W. Nelson with the exception of Lots 3 & 4. These lots are owned by separate individuals as illustrated on the attached site plan. Wellman intends to abandon the proposed septic field and install gravity sewer through the project and along the right -of -way of N.C. Highway 210 to the existing Lift Station located approximately 240 feet northeast of the project. This abandonment of septic field and installation of sewer line will allow Wellman to add nine lots to the subdivision. This addition of lots will also require both street and waterline extension. Wellman intends to construct not only the street, water and sewer, but to also construct single family dwellings on pilings on his 17 lots. All of this activity will lie within uplands. No activity will take place within wetlands or within the 30' CAMA Buffer. The total amount of proposed disturbed area is 1.75 acres.
