Hi Len,

Now that I’ve looked at this final plan, I need more information to justify the impacts please.
On this plan, it doesn’t appear that the wetland needs to be impacted by the project. It also
appears that the lower end of the stream is only impacted by the stormwater pond. DWQ
typically does not allow for impacts to a stream or a wetland from a stormwater measure. The
reasoning is that the BMP manual has many options for stormwater treatment, and so it is
hard to justify avoidance and minimization for stream impacts unless you’ve shown that any
combination of stormwater measures would impact the stream or that other measures would
be infeasible. Often you can reshape the measure, or use 2 different measures or some other
combination etc to have a smaller footprint on the property and avoid the stream.

I know this is a small stream and wetland but our rules are the same for all projects, we can’t
treat small areas any different than large areas, they all have to show avoidance and
minimization.

This is probably just a case where I need more documentation or details to show this
information more clearly. Let me know if you agree and can email me more information.
