The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: The Pre -Construction Notification (PCN) lists the applicant as CCP-SH Crossroads Manager, LLC. Title 15A of the North Carolina Administrative Code (NCAC) 02H .0502(a)(3) requires an applicant that is a corporation be registered with the NC Secretary of State's Office. I was unable to find the applicant in a search conducted on the NC Secretary of State's website. Please provide documentation that the applicant is a registered corporation with the NC Secretary of State. [15A NCAC 02H .0502(e)]. The corporation has changed since the beginning of the project. Updated info: Crossroads Community, LLC 330 Franklin Road, Suite 135A-591 Brentwood, TN 37027 2. Please provide a culvert cross section detail showing the provisions for aquatic life passage/culvert burial that demonstrates the culvert will meet condition 11.11. of 401 General Water Quality Certification 4135. [15A NCAC 02H .0506 (b)(2) and (3)]. See attached. 3. It appears there is adequate room to re -align the entrance road to the north and avoid wetland impact W7. Please re -align the road to avoid this impact or clearly explain why the road cannot be re -aligned. [15A NCAC 02H .0506(b)(1)]. The proposed limits of disturbance cannot be moved further north due to easement limititation. Crossroads Community negotiated an easement with Crossroads Church for the proposed access road. The Church was not willing to allow for more area than what is shown on the plans. 4. The nature and/or purpose of proposed impact W6 is not clear from the PCN or associated site plans. Please explain why and how W6 will be impacted. [15A NCAC 02H .0506(b)(1)]. See attached Sheet C308. An access road connecting S Bear Creek Road to the existing church parking lot is proposed. Impacts are associated with a proposed culvert which will extend approximately 18LF into W6. Culvert will be adequately buried to allow for aquatic life passage. 5. Are any utility (e.g. water, sewer, electric) impacts required for the project? [15A NCAC 02H .0502(6)]. No anticipated utility impacts to jurisdictional waters outside of proposed roadway. Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by August 27, 2021. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application and the appropriate fee. Feel free to contact me if you have any questions. EXISTING GRADE FINAL GRADE BANK FULL \ / ELEVATION -- CULVERT/PIPE BELOW ELEVATION STREAMBED OF STREAM BED 7 MATERIAL (SEE NOTES FOR REQUIRED DEPTH) Notes: Culverts greater than 48 inches in diameter will be buried at least one foot below the bed of the stream. Culverts 48 inches in diameter or less shall be buried 20% of the culvert diameter to allow for low flow passage of water and aquatic life. The bottom of the culvert must be placed at a depth below the natural stream bottom to provide for passage during drought or low flow conditions.
