HomeMy WebLinkAbout20211077 Ver 1_WRC Comments_202108189 North Carolina Wildlife Resources Commission 9 Cameron Ingram, Executive Director August 18, 2021 Ms. Amanda Fuemmeler U.S. Army Corps of Engineers, Regulatory Branch 151 Patton Avenue, Room 208 Asheville, North Carolina 28801-5006 SUBJECT: 20 South Bear Creek UT to Hominy Creek, Buncombe County Dear Ms. Fuemmeler: Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed an application to culvert 60 ft of an unnamed tributary (UT) to Hominy Creek, fill 0.018 acre of wetland, and temporarily impact 30 ft of stream and 0.004 acre of wetland in Buncombe County. Our comments on this application are offered for your consideration under provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Wild trout reproduction should not be impacted by the project, and a trout moratorium is not needed. However, Blotched Chub (Erimystax insignis, NC Significantly Rare) is found downstream of the project, and effective erosion and sediment control on site is important to conserve habitat for this species. The project application proposes to culvert the stream with two 72-inch culverts. Double culverts set at the same elevation often result in one culvert carrying most or all of the flows over time; this can cause channel instability and problems with aquatic organism passage. We recommend replacing the double culverts with a spanning structure such as a bridge or bottomless arch instead. If a culvert must be used, we recommend using a single larger squash (or elliptical) pipe capable of carrying base and stormflows, possibly with a floodplain culvert placed at a higher elevation to pass flood flows. In addition, culvert material is not specified. We recommend against slick -walled high -density polyethylene (HDPE) and reinforced concrete, as these materials are smooth and are less likely to retain substrate and allow passage of aquatic organisms like salamanders and crayfish. The NCWRC does not support commercial or residential development within the 100-year floodplain. The filling of floodplains increases the potential for flooding and degrades in -stream habitats for fish and other aquatic organisms. We offer the following recommendations to minimize impacts to fish and wildlife: 1. In -channel work should be accomplished as quickly as possible and vigilance used in sediment and erosion control during site preparation, construction, and clean up. Disturbed areas should be seeded, mulched and/or matted as soon as possible, preferably at the end of each workday. 2. Any erosion control matting used should be free of plastic or nylon mesh, as this type of mesh frequently entangles wildlife and is slow to degrade, resulting in a hazard that may last for years. 3. We recommend that the stream running through the property be planted with a riparian buffer at least 30 ft in width comprised of native trees, shrubs, and herbaceous vegetation. In addition, we recommend widening the buffer on Hominy Creek to at as wide as possible and using this area as green space. A wide forested buffer can ensure greater bank stability, filter overland pollutants, and provide habitat for birds and other wildlife. 4. We strongly recommend using a spanning structure such as a bridge or arch pipe; if a culvert must be used, we recommend a single corrugated squash/elliptical pipe, possibly with an additional floodplain culvert set at a higher elevation. In addition, smooth -walled culvert material should not be used. 5. If temporary wetland impacts involve heavy equipment access, then equipment should work from mud mats to lessen wetland soil compaction. 6. Effective stormwater management is essential in minimizing impacts to downstream waters. Stormwater control measures should mimic the hydrograph consistent with an impervious coverage of less than 10%. We recommend the use of Low Impact Design techniques, such as grassed swales and pervious pavement; curb and gutter, catch basins, and underground piping of stormwater should be avoided. As stormwater runoff from pavement can cause short-term temperature spikes in downstream waters, mechanisms to lower stormwater temperature should be incorporated into the stormwater management design.
