Dear Mr. Davis:
On June 10th, this office received the May 30, 2008 letter from. JoAnn Gentry
concerning the status of LMAC's Plan -of -Action for resolving the Whole Effluent Toxicity
(WET) failures. ' This Office understands that LMAC. will request a "quant scan" during the
next aquatic toxicity sampling event, and that if the "quant scan" does not indicate the cause
of the Whole Effluent Toxicity failures, then LMAC will probably enter into a formal
agreement with David Merritt for him to assist LMAC in solving for the aquatic toxicity.
Please keep in mind that it is important for the process of the toxicant(s) identification
that the "failure" be present during the same time period as the Toxicity Identification
Evaluation. We are aware that since December 2007, the toxicant(s) is manifesting itself as a
consistent series of "failures". If the toxicant(s) diminishes to a level that results in a "Pass"
before the toxicant(s) is identified (and thereby not purposely targeted for reduction), .the
toxicant(s) may remain as an unknown, and would possibly reoccur. It is recommended that
a fractionization type aquatic toxicity test be used to determine the group or type of toxicant.
Identification of the primary (and possibly secondary) cause of the WET "failures" is a
complex problem; and, this Office again highly recommends that LMAC hire an aquatic
toxicity consultant.
