Lee Boulevard, Suite 200 Orlando, Florida 32822 (hereinafter referred to as the "Grantor"), to
Toll Southeast LP Company, Inc., a Delaware corporation, whose address is 1 l40 Virginia Drive,
Fort Washington, Pennsylvania 19034 (hereinafter referred to as the "Grantee").
(Whenever used herein, the terms "Grantor" and "Grantee" shall be deemed to include
the parties and their heirs, legal representatives and assigns of individuals, and the successors and
assigns of corporations. The singular shall be deemed to include the plural, and vice versa, where
the context so permits.)
TO HAVE AND TO HOLD that certain parcel of land located in Wake Forest, Wake
County, North Carolina as more particularly described as the tract titled "Lot 4" on the plat
titled "Recombination Plat" prepared by The John R. McAdams Company, Inc. and filed in the
Wake County Registry at Book of Maps 2020, Pages 383 through 389 (the "Property"), and all
the estate, right, title, interest, lien and equity whatsoever of Grantor either in law or in equity
or both, to the proper use. benefit, and behoof of Grantee and Grantee's successors and assigns
in fee simple forever. All or a portion of the Property does not contain the primary residence of'
Grantor.
AND THE GRANTOR hereby covenants with Grantee that Grantor will warrant and
defend the Property against the lawful claims and demands of all persons claiming by, through
or under Grantor, but against none other, and that the Property is free of all encumbrances, except
those matters set forth on Exhibit "A" attached hereto and by this reference made a part hereof.
