DANIEL SMITH Director NORTH CAROLINA Environmental Quality September 8, 2021 Shawn Wilkerson Wildlands Holdings V, LLC (via electronic mail: swilkerson@wildlandseng.com ) Re: Catfish Pond II Mitigation Banking Instrument (MBI) Catfish Pond II Bank Parcel Credit Release — Task 3 Dear Mr. Wilkerson: DWR Project #: 2018-0196v2 Durham County On May 18, 2021, the Division of Water Resources (DWR) received an As -Built Report from Wildlands Holdings V, LLC (Wildlands) for the Catfish Pond II Mitigation Site. On August 18, 2021, Katie Merritt with DWR requested additional information to complete her review of the report. On August 19, 2021, Wildlands provided Ms. Merritt with the information requested. According to the As -Built survey submitted with the As -Built Report, there are slight adjustments in the total amounts of Riparian Buffer credits as well as Nutrient Offset credits as compared to the approved Bank Parcel Development Package. The subject site has generated 342,834 ft2 of buffer restoration credits, 52,041.411 ft2 of cattle exclusion buffer enhancement credits and 829,563 ft2 (43,287.706 lbs-nitrogen, 2,788.063 lbs-phosphorus) of nutrient offset credits. The credits being released have been modified to reflect any changes to the creditable acreage as proposed in the BPDP. On August 31, 2021, DWR received a performance bond (#107414675) issued to Wildlands from Travelers Casualty and Surety Company of America, in the amount of $100,000, to cover monitoring and maintenance at the subject site. The term of this bond applies beginning August 24, 2021 and ends with the approval of the Year 1 Monitoring Report by the DWR. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports. In accordance with the MBI, signed on September 14, 2020, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 3) Monitoring Financial Assurance Posted and Approval of As -Built Report 10% LDE NORTH CAROLINA aopamnenl or !wtronmonnO Ona$MY North Carolina Department of Environmental Quality 1 Division of Water Resources 512 North Salisbury Street 11617 Mail Service Center I Raleigh, North Carolina 27699-1617 919.707.9000 Catfish Pond II Mitigation Site Wildlands September 8, 2021 By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and therefore the following credits are being released: • 10% of the Neuse buffer Restoration credits (0.10 x 342,834 ft2 = 34,283.400 ft2) minus 5,978.800 ft2 yields 28,304.600 ft2 available to sell. • 10% of the Neuse buffer Enhancement via Cattle Exclusion credits (0.10 x 52,041.411 ft2 = 5,204.141 ft2) minus 10.934 ft2 yields 5,193.207 ft2 now available to sell. • 10% of the Nitrogen nutrient offset credits (0.10 x 43,287.706 lb-N = 4,328.771 lb-N) minus 875.604 lbs yields 3,453.167 lbs now available to sell. • 10% of the Phosphorus nutrient offset credits (0.10 x 2,788.063 lb-P = 278.806 lb-P) minus 56.395 lbs yields 222.411 lbs now available to sell. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020201 of the Upper and Lower Falls Watersheds within the Neuse River Basin pursuant to 15A NCAC 02B .0703 which became effective on April 1, 2020. Additionally, the riparian buffer credits must be used for authorized impacts in the Neuse River Basin according to guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
