Box 1069 Kitty Hawk, NC 27949 Dear Mr. Roughton: You have our approval to place fill material in 1098 square feet of wetlands or waters for the purpose of constructing a bulkhead and jetty at lots 13/14 Cypress Point subdivision, as you described in your application dated 10 December 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: Applicant proposes to construct 212 feet of wooden bulkhead an average distance of 5.18 feet waterward of NWL. Applicant also proposes to construct a 40 foot long jetty in the Albemarle Sound. BLC Ventures Bio Report Page Two Site Description The applicant owns two adjacent lots with a total area of 1.5 acres, located in the Cypress Point Subdivision, Harbinger, Currituck County. The parcels are located between the Albemarle Sound and Waterside Drive, SR 1431. Adjacent property consists of a lot to the south developed with a single family dwelling, a bulkhead and sever jetties and an undeveloped dedicated open area with a natural sandy beach type shoreline to the north. Tract elevation varies from 0 feet at NWL to 4 feet with the high land portion being a ridge located approximately 20 feet landward of NWL. This ridgelforms a bank that slopes to NWL or, in areas where erosion has been severe, has an erosion escarpment of 3 feet with an estuarine sandy beach area near NWL. Soils are sandy with yard grasses and loblolly pine (Pinus taeda) present. Several pine trees either have fallen or are dying due to erosion. Delineated wetland areas exist on the tract and are vegetated with common reed (Phragmites communis). Man -made features include a septic field system suitable for a single family dwelling, a wooden bulkhead and a 10 foot section of rip rap. Two sections of bulkhead totaling 70 linear feet are still functioning; however, over the remaining shoreline, the bulkhead is either non - functioning or missing. Waters of the Albemarle Sound are classified as SB by the NC Division of Environmental Management. Water depth is 2 feet at 40 feet from NWL. Development Proposal In order to protect their shoreline, the applicants propose to construct 212 feet of wooden bulkhead with backfill. The average distance from shore of the proposed bulkhead is 5.18 feet with a maximum distance from shore being 15 feet. The proposed alignment is 2 feet waterward of the existing bulkhead alignment. The applicants further propose to construct a 40 foot long wooden jetty on their shared property line. The jetty will have a height of approximately 2 feet above NWL and will be constructed perpendicular to the proposed bulkhead. Anticipated Impacts The proposed bulkhead alignment will result in 1,098 square feet of Estuarine Waters and Public Trust Waters being filled. Approximately 81 cubic yards of backfill will be required. The jetty will restrict parallel flow of water along !the proposed bulkhead. The proposed jetty is consistent with near by existing jetties, the ;nearest being 40 feet from the southern property line. No wetland areas will be impacted. Water turbidity will increase temporarily during construction. No submerged aquatic vegetation was found within the project area.
