After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to place rock riprap waterward of an existing concrete bulkhead and extend a rock jetty into North River. , s FIELD INVESTIGATION REPORT: RONALD M. LONG /CARTERET PAGE #2 9. NARRATIVE DESCRIPTION: The project is located adjacent to North River, South Leffers Creek and North Leffers Creek and State Road 1333 (Crow Hill Road), near the community of Otway, in Carteret County. The property is approximately 95 acres in size with the vast majority acreage consisting of Coastal Wetlands. An elevated dirt road through the marsh provides the only vehicular access to the approx. 16 acres of highground which is located directly adjacent to North River. The previous landowner constructed a residence on the property and stabilized a portion of the shoreline some years ago. There is a small sandy beach area in front of the residence. The applicant was issued a CAMA General Permit in 1994 which authorized the stabilization of approx. 500 linear feet of shoreline. The applicant completed that work but also placed a concrete rubble jetty in North River without proper authorizations. A Notice of Violation {NOV) was issued, however the approx. 25' long x 8' wide (bottom width) section of jetty in North River was allowed to remain. The applicant was latter issued CAMA Major Permit #147 -95 which authorized the placement of approx. 1100 feet of rock riprap rubble along the shoreline and the construction of a pier 115' long in North River. The applicant has also requested permission to extend and widen the rock jetty to a base width of 20' and to a length of 75' beyond the MHW line but this request was denied primarily due to impacts of shellfish resources. The rock riprap has been installed but the pier has not been built to this date. Waters at the project site have been classified as SA and are open to the harvesting of shellfish. Oysters are visible along the shoreline area and it could be anticipated that clams would be found in offshore areas. The applicant is now requesting to place rock riprap along several areas of shoreline which have previously been stabilized and to extend the jetty once more into North River but in a scaled down version. Plans submitted with the application show that the shoreline stabilization will be in two areas: 1) along a 50' section of sandy shoreline above the mean high water line and 2) along a 200' section of shoreline which has previously been stabilized with a rock/concrete wall. This wall has begun to deteriorate and shows signs of structural failure. The rock would be placed an average of 5' beyond the mean high water line at that location. The proposed jetty will result in the existing one being widen to 11' and extended into North River for a total distance of 50'. The applicant has indicated that the additional jetty extension is needed to prevent further adverse impacts from wind and tidal effecting the foundation stability of the applicant's residence. 10. ANTICIPATED IMPACTS: The project as proposed will result in the filling of 10,000 sq.ft. of intertidal area in association with the shoreline stabilization with approx. 18.5 cu. yds. of material being placed below the MHW line. The remaining 1600 sq.ft. of shoreline riprap will be above the MHW line and on a sandy beach area. The proposed riprap jetty will result in an additional 400 sq.ft. of shallow water bottom area being filled with approx. 12 cu. yds. of material. The jetty extension would appear to directly impact existing live oysters. It is not know if any clam resources would be impacted. Long for Department of the Army authorization and a State Water Quality Certification to place fill material in non - vegetated wetlands for the purpose of widening an existing jetty to 11 feet wide by 50 feet long, place rock rip rap along a 50 foot shoreline above the mean high water (MHW) line, and repair a deteriorating wall along a 200 - foot -long shoreline, placing rock approximately 5 feet waterward of MHW. Shoreline stabilization and other work has been permitted and completed on this property in the past. The site is located on the North River, at the end of Dill Point Road (SR 1333) near Otway, in Carteret County, North Carolina. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by February 17, 1997, the District Engineer will deem that waiver has occurred. FIELD IlWESTIGATION REPORT: RONALD M. LONG /CARTERET PAGE #2 9. NARRATIVE DESCRIPTION: The project is located adjacent to North River, South Leffers Creek and North Leffers Creek and State Road 1333 (Crow Hill Road), near the community of Otway, in Carteret County. The property is approximately 95 acres in size with the vast majority acreage consisting of Coastal Wetlands. An elevated dirt road through the marsh provides the only vehicular access to the approx. 16 acres of highground which is located directly adjacent to North River. The previous landowner constructed a residence on the property and stabilized a portion of the shoreline some years ago. There is a small sandy beach area in front of the residence. The applicant was issued a CAMA General Permit in 1994 which authorized the stabilization of approx. 500 linear feet of shoreline. The applicant completed that work but also placed a concrete rubble jetty in North River without proper authorizations. A Notice of Violation (NOV) was issued, however the approx. 25' long x 8' wide (bottom width) section of jetty in North River was allowed to remain. The applicant was latter issued CAMA Major Permit #147 -95 which authorized the placement of approx. ,1100 feet of rock riprap rubble along the shoreline and the construction of a pier 115' long in North River. The applicant has also requested permission to extend and widen the rock jetty to a base width of 20' and to a length of 75' beyond the MHW line but this request was denied primarily due to impacts of shellfish resources. The rock riprap has been installed but the pier has not been built to this date. Waters at the project site have been classified as SA and are open to the harvesting of shellfish. Oysters are visible along the shoreline area and it could be anticipated that clams would be found in offshore areas. The applicant is now requesting to place rock riprap along several areas of shoreline which have previously been stabilized and to extend the jetty once more into North River but in a scaled down version. Plans submitted with the application show that the shoreline stabilization will be in two areas: 1) along a 50' section of sandy shoreline above the mean high water line and 2) along a 200' section of shoreline which has previously been stabilized with a rock/concrete wall. This wall has begun to deteriorate and shows signs of structural failure. The rock would be placed an average of 5' beyond the mean high water line at that location. The proposed jetty will result in the existing one being widen to 11' and extended into North River for a total distance of 50'. The applicant has indicated that the additional jetty extension is needed to prevent further adverse impacts from wind and tidal effecting the foundation stability of the applicant's residence. 10. ANTICIPATED ]IMPACTS: The project as proposed will result in the filling of 10,000 sq.ft. of intertidal area in association with the shoreline stabilization with approx. 18.5 cu..yds. of material being placed below the MHW line. The remaining 1600 sq.ft. of shoreline riprap will be above the MHW line and on a sandy beach area. The proposed riprap jetty will result in an additional 400 sq.ft. of shallow water bottom area being filled with approx. 12 cu. yds. of material.
