Box 93 Davis, NC 28524 Dear Mr. and Ms. Arenholz: You have our approval, in accordance with the attached conditions, to place fill material in 3,811 square feet of waters for the purpose of constructing a bulkhead and enclose a portion of a canal at 197 S. Harbor Drive, as you described in your application dated 23 July 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. However, it should be noted that there have already been 3 CAMA general permits issued to this applicant in the past. Given this fact it seems reasonable to request minimization for this project. To this end, it would be reasonable to reduce benthic infaunal impacts by reducing the amount of fill allowed from an area of 701x37' to 701x251. This would reduce the filling of soft - bottom habitat from 2590 s.f. to 1750 s.f., it would also increase water exchange from the boat ramp /basin area with Davis Harbor Canal (minimizing the potential for low D.O.'s and water quality standard violations), and would still provide the applicant with a more stable and protected boat ramp area. Harbor Drive in the Davis Township of Carteret County. This is a .46 acre peninsula shaped tract adjacent to Core sound, lying between the Davis Harbor Canal to the north and another artificially created canal to the south. The Davis Harbor Canal is the location of the James Styron Fish Houses. This canal was excavated prior to the implementation of the CAMA in 1978. The property averages 6.5' in elevation and is currently occupied by a residence served by a private well and septic tank. The Carteret County Land Use Plan classifies the area as Community, with all areas within CAMA Areas of Environmental Concern classified as Conservation. This area of Core Sound is not a designated Primary Nursery Area; the Davis Harbor Canal, and the area of Core Sound surrounding the mouth of the canal is closed to the taking of shellfish for consumption; the remainder of Core Sound and the created canal on the south side of the property are open to the taking of shellfish; The Division of Water Quality classifies the waters of Core Sound SA NSW ORW. The bottom area within Core Sound is sandy, with a much siltier composition in the canals. There are beds of submerged aquatic vegetation in the sound, but not within the canals. The Davis Harbor Canal is regularly maintained, and does not appear to support a shellfish resource. Core Sound has a tidal amplitude of approximately 1.5'. The applicant is proposing to construct approximately 328' of new bulkhead, and maintain approximately 80'. He proposes the construction of a pier with a T -head for private use, and to potentially anchor the intake for a mariculture operation in the future. The applicant wishes to fill an area of the basin within the Davis Harbor Canal to prevent the undermining of his boatramp. The application addresses the shoreline stabilization of that area adjacent to the canal on the south side of his property by constructing 153' of timber bulkhead, approximately 5' from the mean high water contour. There is no vegetation in this area. The bulkhead would extend a maximum of 10' from mean high water at its furthest waterward point. There is an existing 80' section of bulkhead that was never backfilled. The applicant wishes to maintain this section of wall, which is also extends approximately 5' from the mean high water contour. Silt fencing and fill material would be placed behind the wall. Adjacent to Core Sound, the applicant wishes to construct a new timber bulkhead an average of 2' and a maximum of 4' from the existing wall that was damaged in Hurricane Fran. Within the Davis Harbor Canal on the north side of the property, the applicant proposes to extend his bulkhead across 70' of his boat basin, and connect it to shore, 37', beside his boatramp. This area would be filled to the existing grade of the adjacent high ground. Soundings in the basin currently indicate approximately -1.5' to -2' mean low water. The applicant proposes to construct a pier, 4' x 88' into core sound. At the waterward end, there is a 12' x 12' deck proposed. this structure terminates in -1.8' at mean low water. The r body of water is approximately 4 miles across at the pier location. The applicant is indicating a minimum of 26' to the nearest riparian corridor. Approximately 28 cubic yards of fill material will be required for backfilling of the bulkheads. Another 739 cubic yards of material is anticipated for the fill of the basin area, 115 cubic yards of which will be below the mean high water level. The material to be used for these purposes is 8 year old fill material that is stockpiled on the applicant's property. If additional material is needed, the applicant proposes to obtain sand from a high ground source. There have been 3 CAMA General Permits issued to this applicant on this site - 10733 -C, 9013 -C, 8813 -C. These permits have been for the construction of the bulkhead and a pier within the canal. i I : ►Y I' : Y_ _I i►�1' The project as proposed will incorporate approximately 496 square feet of Public Trust Area with the construction of the pier. Approximately 3010 square feet of high ground will be disturbed for the installation of the tie back cables and deadmen for the bulkheads. Approximately 3811 square feet of shallow bottom area will be filled with the construction of the bulkheads and the filling of the basin area. Of this, approximately 136 square feet is sandy bottom area in Core Sound, while the remainder is the siltier bottom area within the canals. The extension of the bulkhead into the Davis Harbor Canal to fill the basin should not impact navigation, as it is a continuation of the existing bulkhead along its current line. The applicant is hoping that by filling this feature, the wave action will be reduced against his boat ramp, and therefore, less maintenance will be required on this feature in the future. CAMA Application - Section 3.d. JUL 2 3 1997 JUL 10 1997 _ Project Description: COASTAL MANAGEMENT Purpose /use: There are four tasks covered by this application. The first consists of constructing an original bulkhead along the lesser canal that represents the southern border of the project site. The bulkhead is for bank stabilization and erosion protection. The second task consists of replacing the bulkhead that faces Core Sound, the easterly border of the project site. The original bulkhead was breached and damaged beyond normal repair methods by hurricane Fran in 1996. This bulkhead is for bank stabilization and erosion control. The third -task is to construct a bulkhead around a portion of a man -made boat basin on the Davis Harbor Canal (north side of project site). The purpose of this bulkhead is to reclaim as dry land, a portion of the basin (371x701). After filling with soil and sand, the bulkhead will function for bank stabilization as well. This reclamation should aid in making the remaining portion of the basin and boat ramp more functional during windy, high sea conditions, as well as aid in stabilizing the canal. The fourth task consists of constructing an 88' pier and a 121x12' platform on the seaward end. The use of the pier is for recreational purposes and to anchor and protect the intake and seaward portion of a seawater system for subsequent aquaculture /mariculture applications. Methods of Construction: All bulkheads will be constructed with 6 1Ix6" pilings, 4 1Ix6" cross timbers, and 2 1Ix8" tongue - and- groove planking. The pilings will be on 4' centers, with 5/8" diameter galvanized rod tie -backs to anchors or "deadmen" buried in the bank. Silt- barrier cloth will be utilized on the inner side of the constructed bulkheads. All lumber exposed to immersion in saltwater will be marine application, pressure treated material. The pilings will be "jetted" down, using a small horsepower gasoline water pump. The planking will be "jetted" in place as well. The planking and pilings will be of a length that allows at least 1/3 of the length of the material to be below the surface of the sediments. Completed bulkhead, lined with silt - barrier cloth, will surround all areas prior to the introduction of any fill material. Hence, very little sedimentation to public waters will occur as a result of the back -fill or construction process. The pier will consist of at least 6" diameter pilings on 8' centers, paired with doubled 2 11x10" cross- members. Stringers and decking will consist of 2 11x10" lumber. Pilings will be marine application, pressure treated material, while the remainder of the materials will be ground- contact pressure treated stock.
