APPROVAL of 401 Water Quality Certification

Dear Mr. Coughlan:
You have our approval, in accordance with the attached conditions for the purpose of
overhead distribution line at Hog Island, as you described in your application dated 23 June
1997. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3101. This Certification allows you to use Regional Permit
Number 049 when it is issued by the Corps of Engineers. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited
to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply
Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA
permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to send
us a new application. If total wetland fills for this project (now or in the future) exceed one
acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For
this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To
ask for a hearing, send a written petition which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for
a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the
Clean Water Act. If you have any questions, please telephone John Dorney at 919 - 733 -1786.

Subject: Requested Approval of Electrical Distribution Line Construction
in Craven County

Carolina Power & Light Company (CP &L) is planning to construct an overhead distribution line
to service development on Hog Island, located in the Neuse River in Craven County, northwest of
New Bern. The line, a 13.2 KV distribution line, will be constructed within the right -of -way
(ROW) of an existing larger 115 KV transmission line, from a point on the mainland southwest
of the Neuse River, extending roughly northeast and crossing Bachelor Creek and Hog Island
Creek perpendicularly to Hog Island (Enclosure 1). The minimum vertical clearance of the line
over these streams will be 41.5 feet (Enclosure 2). The line will not cross the Neuse River itself.
CP &L does not propose any impact to wetlands within this existing transmission line ROW other
than setting poles for the distribution line. No additional vegetation will need to be cleared.
From a point near the centerline of Hog Island, the distribution line will move perpendicular
(roughly northwest), extending for a distance of some 700 feet to the line's terminus. This final
section of the line will require clearing of a 30 -foot wide ROW and the setting of several poles.
The landowner intends to clear the ROW. Poles will be set by CP &L using a mechanized auger.
Mats will be utilized for any work in wetlands.
CP &L i "sking that th Corps of Engineers approve this project under Regional General Permit
No. 8100049 pursu t to Section 10 of the Rivers and Harbors Act for the stream crossings.
CP L does not ieve that the required work requires a Section 404 permit. However, we
wou ate the Corps' concurrence that the work is non jurisdictional under Section 404.
Should the Corps determine that the work is jurisdictional under Section 404, CP &L asks that the
Corps approve that portion of the work under this same regional permit. CP &L also believes that
this work is consistent with the North Carolina Division of Water Quality's General Certification
(WQC #3101) for this permit, and that no formal notification of that agency is required.
However, a courtesy copy is being forwarded to Mr. John Dorney of that agency.
