Edwin Mitchell, Jr. 119 Middle Street New Bern, NC 28560 Dear Mr. Mitchell: You have our approval, in accordance with the attached conditions and those listed below, to place fill in 031 acres of wetlands or waters for the purpose of constructing Adams View Subdivision at Rose Joyner Tract, as you described in your application dated 29 April and 12 May 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3103 and 3106. These certifications allow you to use Nationwide Permit Numbers 14 and 18 when they are issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This Certification updates one issued to you on 20 May 1997. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed restrictions, conservation easements or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands to restrict future fill within 30 days of the date of this letter. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. Approval from DWQ is required to disturb these wetlands. Our rules require us to consider cumulative impacts to wetlands (15A NCAC 2H .0506(c)). In particular you will need to supply maps to allow us to determine whether lot fill will be needed to develop this subdivision. Deed restrictions or conservation easements will be required on all lots to restrict future wetland fill. Please show this information on maps of suitable scale (for instance 1" = 100 feet) so we can begin to determine your projects' compliance with 15A NCAC 2H.0500. This approved building site may exceed any presumed setback if the standards for approval as set out in paragraph 5B hereinafter are more completely met by increasing such setbacks. The presumed setbacks are as follows: (1) 100 feet from any street right -of -way; (2) 15 feet from each side Lot line; (3) 100 feet from the front (waterside) Lot line, if the Lot is adjacent to a body of water; and (4) 75 feet from the back Lot line (any Lot line other than property lines determined by the Association to be adjacent to the water, adjacent to a public street or a side Lot line) . Furthermore, the Committee shall have the right to vary any setbacks set out herein or on any recorded plat for good cause shown, upon petition submitted in writing by the owner of a Lot. The Committee shall never be obligated to grant a variance. The Committee shall not issue a variance if, in the opinion of the Committee, such variance would have a substantial adverse impact upon the value of an adjoining Lot. The owner(s) of immediately adjoining Lots shall be given notice of the request for a variance in writing, by the owner of the Lot seeking the variance, at least five (5) days prior to the issuance of a. variance by the Committee. E. Certain areas of Adams View contain wetlands as defined by Section 404 of the Clean Water Act. The location of the Section 404 wetlands, as of the date of the recordation of each subdivision plat within Adams View, shall be denoted on each of said subdivision plats. Because of changes in groundwater or in the definition of Section 404 wetlands, or the interpretation of such definitions or conditions, the locations of wetlands may vary from time to time. Wetlands perform valuable ecological and aesthetic functions. These functions include providing filters for storm V R er drainage and runoff, providing habitat for wildlife and moting proper drainage. Therefore, no fill or substantial eration of any of the Section 404 wetlands delineated on any orded subdivision plat within Adams View shall be allowed hout issuance of a permit for such activity by the State of North Carolina and the Corps of Engineers, an agency of the United States of America, and without permission of the Committee, which permission shall only be granted upon a showing of a strong and compelling reason for such wetland fill or alteration, and which permission must be obtained prior to application for any permit authorizing alteration of such a wetland. It is the intent of Declarant to preserve as many of the wetlands as feasible within Adams View to allow such wetlands to perform beneficial functions for the benefit of the residents of Adams View and surrounding properties. NO ALTERATION OF A WETLAND WILL THEREFORE BE ALLOWED WITHIN ADAMS VIEW UNDER AUTHORIZATION GRANTED BY ANY NATIONWIDE PERMIT WITHOUT FULL DISCLOSURE OF THE ACTIVITY TO BE UNDERTAKEN IN ADVANCE OF SUCH ACTIVITY, WHICH NOTICE. SHALL BE GIVEN TO THE CORPS OF ENGINEERS, THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT OF THE STATE OF NORTH CAROLINA AND THE COMMITTEE, AND WITHOUT APPROVAL OF THE COMMITTEE. F. The heights of structures on any Lot shall be subject to approval of the Committee in accordance with the standards set out in Section 5 hereunder. G.
