You have our approval, in accordance with the attached conditions, to place fill material in 0.028 acres
of wetlands or waters for the purpose of constructing a bridge and access road at Lots 7 and 8 in Davis Bay
subdivision at Lennoxville Point Road, as you described in your application dated 1 April 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3112.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you maybe required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the
conditions listed in the attached certification. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

9. NARRATIVE DESCRIPTION: The applicant has subdivided an approx. 100 acre
tract of land located at the end of the Lennoxville Point Road, near the Town of
Beaufort into 9 lots, each being 10 acres or larger in size. This property abuts Davis
Bay which adjoins North River. A dirt road provides access to lots 1 -7 and is located
outside of any Area of Environmental Concern. Most of the lots have been sold but no
residences have been constructed on the property. A marsh gut separates Lots 8 & 9
from the remainder of the property. This marsh gut is 600' long x up to 250' wide
and is vegetated primarily with Spartina alterniflora marsh. Areas of "404" wetlands
are located adjacent to the gut and throughout the property. A wetland delineation has
been completed on the property and approved by the US Army Corps of Engineers.
Waters at the project site have been classified as SA and are closed to the harvesting of
shellfish for human consumption. Turner's Creek is located just beyond the project
site and is designated as a Primary Nursery area.
The applicant is proposing to span across this area of Coastal Wetlands with a wood
timber bridge in order to gain vehicular access to lots 8 & 9. The bridge would
measure approx. 168' long x 12' wide and would be a minimum of 3'9" above the
marsh floor elevation. The roadway and bridge construction would begin on lot #7 and
terminate on lot #8. Fill material for the road would be placed at the end of the cul-
de -sac on lot #7 and continue to a point above Coastal Wetlands where an end wall
abutment would be constructed and the bridge would begin. The filling of the road
and construction of the end wall abutment would impact an area of "404" approx. 40'
long x 30' wide. The bridge would terminate on lot #8 onto high ground. A similar
end wall abutment would be constructed on lot #8, however no wetlands would be
impacted.
10. ANTICIPATED IMPACTS: The project as proposed will result in the shading of
approx. 2,016 sq.ft. of Spartina alterniflora with the construction of a wooden, pile
supported bridge. The bridge will not impact any navigable waters. There will be
some limited impacts to coastal wetlands during the pile driving phase of the project
but those impacts should be limited to the immediate area around the pilings. There
may also be some impacts to the wetlands underneath the structure but they should be
minimized by the height ( ±4' above the marsh floor), the width (12') and the
orientation of the bridge (north to south). Approx. 1200 sq. ft. of "404" wetlands
would be impacted by filling for the approach road and the construction of the end wall
abutment on lot #7. No wetlands would be impacted on lot #8.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross- sectional drawings) drawn to scale in black
ink on an 8 1/2" by I V white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
