We are writing this letter to inform you that Libby Owens Ford Glass plant is in violation
on their average daily flow for the Wastewater Treatment Plant, the permitted flow is
30,000 gallons per day (gpd), April's daily flow rate was 35,000 gpd. Based on
conversations with personnel in the Fayetteville Regional office, when the average daily
flow exceeds 10% of the permitted flow civil penalty will be issued and this penalty is
the responsibility of LOF Glass.
Regulations governing National Pollutant Discharge Elimination System (NPDES)
indicates that when a facility consistently reaches 80% of the designed capacity the
facility is required to conduct an investigation to determine the maximum amount of flow
that could be adequately treated at this facility. Plans and specifications will need to be
developed and submitted to the state to indicate that the problem is being properly
investigated.
One recommendation is to retain an Engineering Firm to do an investigation of the
current treatment plant and to determine if the plant can adequately treat flows greater
than 30,000 gpd. If determined by the engineering firm that this is an option we would
need to apply for an amendment to the existing NPDES Permit for a flow modification.
If this is not an option you could add additional treatment capacity to the existing facility
or investigate the possibility to discharge to a Public Owned Treatment Works (POTW).
