Box 659 Beaufort, NC 28516 Dear Sirs: If 1:�EHNF1 March 18, 1997 Carteret County WQC 401 Project #970011 You have our approval, in accordance with the attached conditions, to construct a docking facility at 1612 Front Street, as you described in your application dated 22 January 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3112. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non - Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specked in the General Certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611 -7447. This certification and its conditions are final and binding unless you ask for a hearing. NARRATIVE DESCRIPTION: The applicant's property consists of a f 2.6 acre tract of land located on the north and south side of Front Street in the Town of Beaufort. The property north of Front Street is being developed into an 11 lot housing development known as 1612 Front Street. The lots range from 4,500 to 5,850 sq.ft. in size and will be serviced by the Town's water and sewer systems. The grading and infrastructure placement (roads, sidewalks, utilities) have begun but no houses have been constructed on site. The applicant has received an approved Sedimentation and Erosion Control Plan and a Stormwater Management permit. The approved stormwater plan included a detention pond with the overflow discharge being piped into an existing storm drain which is located on the north side of Front Street. This storm drain discharges directly into Taylors Creek just east of the project site. The tract of land located on the south side of Front Street is ± 30 to 40' wide x 120' in length. The high ground portion of this area is vegetated with a fairly dense canopy of wax mrytle, scrub oaks, cedar and pine trees. A f 5 to 10' wide border of spartina alterniora exists along the waters edge. Water depths in Tailors Creek deepen to -13' mean low water approximately 60' offshore. Adjacent properties on the north side of Front Street have been developed into single family residence with adjacent docks extending into Taylors Creek. Taylors Creek has been classified as SC waters and is closed to the harvesting of shellfish. A federally maintained channel is located approximately 160' offshore of this property. The applicant is requesting a permit to construct a dock into Taylors Creek and to relocate the stormwater discharge point for the detention pond. Plans included with the application propose the placement of a f 88' long x 6' wide pier into Taylors Creek with 6 finger piers and 10 mooring pilings to accommodate 8 boats. The pier would be approximately 67' from the edge of the federal channel and at least 25' away from the adjacent property owners areas of riparian access. The pier would extend beyond adjacent piers. The proposed relocation of the stormwater discharge point would involve the trenching and placement of an 18 ".reinforced concrete pipe across Front Street and adjacent upland areas with the terminal end being located above the mean high water line and above Coastal Wetlands. A rock riprap apron is proposed to be located at the terminal end of the pipe to dissipate the scouring effects of the discharge point. 10. ANTICIPATED IMPACTS: The project as proposed will result in the construction of a community 8 slip docking facility within the waters of Taylors Creek. The proposed dock will have a footprint of f 930 sq. ft. and will be f 67' away from the edge of a federally maintained channel. The pier will project out into the waters considerably farther than the eastern adjacent property owner's pier and slightly farther than the western neighbor's pier. Turbidly levels will be increased in the immediate area during piling placement(s) but will be short term in duration The proposed relocation of the stormwater discharge pipe will result in f 630 sq. ft. of woodland vegetation within the Estuarine Shoreline Area of Environmental Concern being either excavated or filled. The relocation should not result in any additional water quality impacts since the existing stormwater permit authorizes the pond discharge into an existing pipe which has a direct connection to Taylors Creek. The 1 applicant will, however, need to modify their existing stormwater permit in order to undertake the relocation. The upland housing development has already impacted f 2.7 acres of previously wooded tract of land and will have built upon surfaces of ± 1.6 acres. The applicant has received a Sedimentation and Erosion Control Plan and the necessary permits from the Town of Beaufort tp begin construction on the housing units.
