Dear Mr. Vinson:
We are in receipt of the above referenced Notice of Violation, dated August 10, 2021,
which involved overflows at eight locations occurring on July 8, 2021. Measurements at
the Big Buffalo wastewater treatment plant do not show a spike in flows around the time
period in question. Rain gauge data measured at the plant was 2.78 inches on that day.
Below is a discussion of the history as well as the current and future actions being taken
to address these occurrences.
Little Buffalo Basin (Incident 202101535, 202101536, 202101537,202101538)
These incidents took place in part of the same outfall where we have had previous
overflows. Therefore, the City has this area identified as high priority for cleaning and

inspections prior to anticipated storm events. In addition, the following long-term
corrective actions, which have been previously reported, are underway:
1. East Sanford CDBG
On February 21, 2020, the City received a $2 million CDBG-I grant to rehabilitate
sections of sewer line in East Sanford that was originally installed prior to 1930.
We submitted plans and specifications to the Division of Water Infrastructure on August
18th for review. Once permits are received, we can proceed to bidding.
2. Little Buffalo Rehabilitation — Upper Reach
In January of 2020, design work started to increase the size of a portion of Little Buffalo
outfall. Previously, studies were undertaken to determine our options for addressing the
overflows in the Little Buffalo basin.
On March 1, 2021 we received a Notice of Intent to Fund from the Division of Water
Infrastructure for the construction of this project (see attached). Our designer has
submitted the Engineering Report for their review.
Big Buffalo Basin (Incident 202101539, 202101540, 202101541, 202101542)
The remaining four incidents occurred in two separate areas in Big Buffalo Basin.
1. Dry Creek (202101539, 202101540)
We have collected survey information on this area and modeled its flow. Smoke testing
and rehabilitation of a portion of the upstream area is scheduled for next fiscal year, funds
permitting.
2. Shoreline (202101541)
The City has cleaned and televised the downstream area. We are looking into installing
flow monitoring equipment to help determine the extent of the issue.
3. Crusaders (202101542)
The City has cleaned and televised the downstream area. Just as with Shoreline, we are
looking into installing flow monitoring equipment.

The Division of Water Infrastructure has reviewed your application, and the State Water
Infrastructure Authority has approved your project as eligible to receive a Clean Water State
Revolving Fund (CWSRF) loan of $3,845,000. 25 percent of the loan (up to a maximum of
$500,000) will be forgiven, and the remainder will be repayable at a maximum interest rate of
0.10%. A loan fee of 2% will be invoiced after bids have been received.
Please note that this intent to fund is contingent on approval of the loan through the Local
Government Commission and on meeting all of the following milestones:

The first milestone is the submittal of an Engineering Report by close of business on
July 1, 2021. The Engineering Report must be developed using the guidance found on our
website (https://deq.nc.govlabout/divisions/water-infrastructureli-have-fundinglengineering-
reportenvironmental-information). Failure to meet any milestone may result in the forfeiture
of funding for the proposed project.

Upon detailed review of the project during the funding process, it may be determined that
portions of your project are not eligible for funding and the total funding amount may be
reduced. Additionally, changes in the scope or priority points awarded x based on additional
information that becomes apparent during project review — may also result in changes to the total
funding amount and loan terms.
Davis -Bacon Requirements and American Iron and Steel Provisions
Projects funded through the State Revolving Fund (SRF) programs (including ASADRA) must
comply with Davis -Bacon wage requirements and American Iron and Steel provisions. You can
find standard specifications covering these requirements on our website.
Joint Legislative Committee on Local Government Notification Requirements
In accordance with G.S. 120-157.2, local government units with projects that require debt to be
issued greater than $1,000,000 must submit a letter to Committee Chairs, Committee Assistant,
and the Fiscal Research Division of the General Assembly at least 45 days prior to presentation
before the Local Government Commission. You are responsible for submitting that letter and
providing a copy to the Division.
Brooks Act Compliance
Projects funded through the CWSRF program (including ASADRA) must comply with the
federal Brooks Act for the selection of architectural and engineering services. CWSRF projects
cannot be exempted from qualification based selection of these services under N.C.G.S. 143-
64.32. Any services provided that were not selected in compliance with federal requirements will
be ineligible for reimbursement.
Extended Term Loan
Projects that qualify for a targeted interest rate and demonstrate in the Engineering Report a
weighted average design life for the major components of the project greater than 20 years are
eligible for an extended loan term up to the calculated weighted average design life, but not to
exceed 30 years. Request an extended term on the Engineering Report Submittal Checklist
(https://deq.nc.gov/aboutldivisions/water-infrastructure/i-have-funding/engineering-
reportenvironmental-information) and provide the necessary calculation.
