Please see the email below summarizing today’s call with Mr. Ricitelli:
Per Mr. Ricitelli’s request, I conducted a site compliance inspection with several other members from NCDEMLR and
DOT on-site July 29, 2021. Overall, the site conditions observed were good, his pond was clear and the turbidity curtain
was secured. Additional repairs to silt fence and erosion control measures on-site were recommended and since then,
DOT has provided photo documentation of those repairs.
I stated that DOT is currently in compliance with the 401 permit issued for the site, and that issues related to
sedimentation of his pond would need to be addressed directly with DOT. Per the email below, I have asked DOT to
collect additional photos of the current pond conditions and turbidity curtain.
Mr. Ricitelli was unaware that an NOV response letter was issued by DOT for the site on June 2, 2021. He has requested
a copy of that letter (attached).
If acceptable, I’ll provide a copy via email.

Jerry,
Good morning. Mr. Daniel Ricitelli contacted me today regarding his pond.
He stated that recent rains have once again discharged silt into his pond and that nothing has been done to fix it.
I wanted to notify you and request that an inspector observe the pond area and provide photo documentation of the
current surface water conditions and the anchoring of the turbidity curtain.
