Dear Permittee:
Payment of the required annual administering and compliance monitoring fee of $715.00 for this year has not
been received for the subject permit. This fee is required by Title 15 North Carolina Administrative Code 2H.0105, under
the authority of North Carolina General Statutes 143-215.3(a)(1), (la) and (1b). Because this fee was not fully paid within
30 days after being billed, this letter initiates action to revoke the subject permit, pursuant to 15 ncac 2H.0105(b) (2) (k)
(4), and G.S. 143-215.1 (b) (3).
Effective 60 days from receipt of this notice, subject permit is hereby revoked unless the required Annual
Administering and Compliance Monitoring Fee is received within that time. Discharges without a permit are subject to the
enforcement authority of the Division of Water Quality. Your payment should be sent to:

I spoke with Mrs. Younce, NPDES Permit Number NC0050822, Pine Ridge Subdivision,
Catawba County. The facility has not been constructed and she believes Mr. Billie Younce did
not renew the permit.

This Office has reviewed the comments submitted by Mr.
Carroll Williams, on behalf of the owner of the subject
development and we offer the following comments and/or
recommendations.
Topography, soil conditions and proposed land uses have
generally prohibited (with some minor exceptions) non -discharge
options for this site. Even with the development constructed in
phases, site constraints will prohibit extensive use of non -
discharge alternatives. Although a municipal sewer connection is
possible, distance and the numerous easements that must be
obtained make a sewer connection impractical.
For this reason, construction of a WWTP would appear to be
the appropriate solution at this time. Since the development is
to be constructed in phases, it is recommended that WWTP
construction also be phased to correspond to development growth.
Hydraulic loading from the first phase is expected to be P:0.020
MGD. The Permit should be reissued containing effluent
limitations for both 0.020 and 0.090 MGD. This will allow for
phased construction of both the development and the WWTP. Should
municipal sewer become available before, during or after the
first phase is constructed, the WWT facility could be abandoned
and a connection made.

B. THE PROPOSED WASTE WATER TREATMENT AND DISPOSAL FACILITY WILL BE A
"PACKAGE" TYPE EXTENDED AERATION ACTIVATED SLUDGE SYSTEM WITH FLOW
EQUALIZATION, SLUDGE HOLDING - DIGESTOR FEATURES AND TERTIARY
TREATMENT WITH DISINFECTION. GEE ATTACHMENT NO.1.
BASICALLY THE FIRST SYSTEM COMPONENT IS THE FLOW EQUALIZATION SYSTEM,
DESIGNED TO GIVE A STEADY OR UNIFORM FLOW TO THE TREATMENT COMpONENTGv
ELIMINATING SURGES AND PEAK FLOWS. SINCE SOME DETENTION 19 PART OF
FLOW EQUALIZATION, THE WASTE WATER IN THIS COMPONENT IS AERATED TO
PREVENT SEPTIC CONDITIONS.
THE SECOND COMPONENT IS A THREE PART BASIC TREATMENT SYSTEM. WASTE
WATER FROM THE FLOW EQUALIZATION TANK ENTERS AN AERATED TANK WHERE IT
IS VIGOROUSLY AGITATED FOR PHYSICAL BREAKDOWN AND ENCOURAGING AEROBIC
BIOLOGICAL ACTIVITY. THE WASTE WATER IS RETAINED A MINIMUM OF 24
HOURS IN THIS STATE.
THE SECOND PART OF THE BASIC TREATMENT SYSTEM IS THE CLARIFIER OR
SETTLING SYSTEM, INTO WHICH THE WASTE WATER IS CHANNELED. THE
CLARIFIER IS DESIGNED FOR A QUIESCENT PERIOD ALLOWING MOST OF THE
SOLIDS TO SETTLE TO THE BOTTOM AS SLUDGE. THEN ROUTINELY A PUMPING
SYSTEM REMOVES THE SLUDGE AND RETURNS IT TO THE AERATION CHAMBER TO
HELP ENCOURAGE THE GROWTH OF AEROBIC BACTERIA. LIQUIDS OR EFFLUENT
FROM THE CLARIFIER FLOWS OVER A CONTROLLED WEIR CREST FOR FURTHER
TREATMENT.

IN TIME, THE LIQUIDS THICKEN, INDICATING THAT SLUDGE LEVELS HAVE
INCREASED BEYOND THE PLANNED CONSISTENCY. TO REMEDY OR PREVENT THIS,
SLUDGE REMOVAL FROM THE CLARIFIER IS BY -'PASSED TO THE THIRD PART OF
THE TREATMENT SYSTEM -SLUDGE HOLD%NG/DIGESTOR. THIS TANK IS BASICALLY
USED TO STORE THE ACCUMMULATION OF EXCESSIVE SLUDGE UNTIL IT IS
REMOVED FOR DRYING ON SAND BEDS OR ACCEPTED IN A SLUDGE PROCESSING
FACILITY TO BECOME COMPOST. THE DIGESTOR FEATURE IMPLIES THE SLUDGE
IS CONTINUOUSLY AERATED IN THIS TANK FOR FURTHER BACTERIA ACTIVITY AND
SLUDGE BREAK -DOWN.
WHEN EFFLUENTS LEAVE THE CLARIFIER OVER THE WEIR CREST, THEY ENTER THE
TERTIARY SECTION WHICH IS REALLY A FLOODED SAND FILTER CHAMBER TO
REMOVE AS MUCH OF THE REMAINING SUSPENDED SOLIDS AS POSSIBLE. THE
EFFLUENT FROM THIS FILTER IS DIRECTED THROUGH A DISINFECTING UNIT FOR
BACTERIA KILL AND DISCHARGED TO A RECEIVING STREAM. SOME OF THE FILTER
EFFLUENT IS ROUTED TO A STORAGE TANK TO BE USED IN BACKWASHING THE
FILTER. THE BACKWASH WASTE IS RETURNED TO THE MAIN AERATION BASIN FOR
FURTHER TREATMENT AND TO HELP BIOLOGICAL GROWTH.
THE DISINFECTION UNIT, USUALLY A CHLORINE -INDUCING SYSTEM, RETAINS THE
LIQUIDS A DESIGNED PERIOD OF TIME TO KILL OFF ALL BACTERIA GROWTH
BEFORE ALLOWING THE LIQUIDS TO DISCHARGE INTO THE STREAM. A DESIGNED
DISINFECTANT RESIDUAL IS PRESENT IN THE DISCHARGE WHICH IS FINALLY
DISSIPATED IN THE STREAMS' OWN PROCESSING ACTIVITIES.
C. THE PINE RIDGE SUBDIVISION IS A PLANNED DEVELOPMENT OF
APPROXIMATELY 220 RESIDENTIAL HOUSING UNITS,, WITH ABOUT 30 TO 40 lN
SINGLE FAMILY UNITS AND 180 TO 190 MULTI -FAMILY UNITS (CONDOS). SEE
BASIC STREET PLAN ATTACHED.
THE TOTAL WASTE LOADING IS ESTIMATED AT 88,000 GPD, USING 400 GPD PER
DWELLING UNIT AS AN AVERAGE DAILY FLOW FROM AN ASSORTMENT OF 2
BEDROOM, 3 BEDROOM AND 4 BEDROOM UNITS WITH ALL UNITS PROBABLY USING
CLOTHES WASHERS AND KITCHEN SINK GRINDER DISPOSALS. A ROUND OFF
FIGURE OF 90,000 GPD IS USED.
D. IT IS ANTICIPATED THAT ABOUT 20 TO 25 PERCENT OF THE DEVELOPMENT
WILL BE PURSUED AS A FIRST PHASE. THE WASTE WATER LOADING FOR THIS
FIRST PHASE WILL BE 20,000 GPD" TENTATIVE PLANS ARE THAT ABOUT HALF
OF THE SINGLE FAMILY LOTS WILL BE AVAILABLE IN THE FIRST YEAR AND THE
BALANCE DEVELOPED IN A TOTAL THREE YEAR PERIOD.
MULTIFAMILY OR CONDO UNITS OF 20 OR MORE ARE EXPECTED TO BE COMPLETED
THE FIRST AND SECOND YEARS WITH THE DEVELOPMENT BEING TOTALED OUT IN 5
TO 10 YEARS. THE MAJORITY OF THE CONDOS WILL BE CONSTRUCTED ON A
PRE -SOLD BASIS.

II. EVALUATION OF ENVIRONMENTAL FEASIBILITY OF DISCHARGE
ALTERNATIVES.
A. CONNECTION TO SEWERAGE SYSTEM
1.
EXISTING SEWERAGE SYSTEM
a. ROCK BARN PROPETIES, INC. OWNS AND OPERATES A DOMESTIC
WASTE WATER TREATMENT PLAN (NPDEG NO. NC 0076163). THE PERMIT IS FOR
0.100 MOD WHILE THE FIRST PHASE PORTION OF 0.010 MOD IS ACTUALLY IN
SERVICE.
THE NEAREST ACCESSIBLE SEWER IN THIS SYSTEM THAT COULD TAKE THE
PROJECT DISCHARGE IS ABOUT 3100 FEET TO THE WEST. IT WOULD REQUIRE AT
LEAST ONE LIFT STATION, WITH EASEMENTS ACROSS A GOLF COURSE AND 5
OTHER PROPERTIES.
THE PROJECT WOULD REQUIRE 90% OF THE PERMITTED DISCHARGE, WHICH IS
UNACCEPTABLE TO ROCK BARN PROPERTIES, INC. ROCK BARN AUTHORITIES
ADVISE THAT DEVELOPMENT PLANS ARE IN PROGRESS WHICH WOULD INCREASE THE
USE OF THEIR FACILITY AND THEY ARE NOT INTERESTED IN ALLOTTING ANY
PORTION OF THEIR PERMITTED FLOW.
b. THE CITY OF CONOVER, NC. HAS ITS NORTH EAST WASTE WATER
TREATMENT FACILITY LOCATED ON LYLE CREEK AND IS APPROXIMATELY 7200 LF
SOUTH WEST OF THE PROJECT SITE. THE CITY OF CONOVER OFFICIALS ADVISE
THAT THEIR PLANT HAS THE CAPACITY AND WOULD ACCEPT THE FLOW, AS WELL
AS ACCEPTING THE SEWERAGE SYSTEM FOR UP -KEEP AND MAINTENANCE. THEY
ALSO ADVISE THAT THEY WOULD NOT PARTICIPATE IN CONSTRUCTION COSTS NOR
THE PROCUREMENT OF RIGHTS OF WAY.
A SEWAGE SYSTEM TO CARRY WASTE WATERFROM THE PROJECT AREA WOULD
ENCROACH ON AT LEAST 14 TRACTS OF LAND, ONE OF WHICH IS THE ROCK BARN
CLUB OF GOLF. AT THIS TIME SUCH A SYSTEM APPEARS IMPOSSIBLE WITHOUT
THE POWER OF EMINENT DOMAIN.
2. SUBSURFACE DISPOSAL SYSTEM
a. THE PROJECT AREA HAS SOILS THAT VARY FROM SUITABLE TO
UNSUITABLE FOR SUBSURFACE SYSTEMS. THE SUITABLE SOILS OCCUR ON TOP OF
THE RIDGES AND PASS THROUGH PROVISIONALLY SUITABLE TO UNSUITABLE AS
THE SLOPES GET STEEPER.
TO BEGIN WITH, ABOUT 16 ACRES OF THE 120 ACRE PROJECT AREA LAY IN THE
100 YEAR FLOODWAY, 8 ACRES OF WHICH ARE USE IN GOLF COURSE FAIRWAYS.
AN ANALYSIS OF THE APPARENT SLOPES SHOW THAT RIDGES WILL SLOPE 5 TO
10% WITH THE SIDE SLOPES FALLING OFF AT AROUND 16%. WHEN THE GULLIES
AND RAVINES GET MORE DEFINITE, THE SLOPES ARE 30% AND OVER. THERE ARE
SEVERAL SMALLER DRAINAGE WAYS ALL ACROSS THE PROPERTY.
THE CATAWBA COUNTY ENVIRONMENTAL HEALTH SPECIALIST HAS REVIEWED THE
AVAILABLE TOPOGRAPHIC MAP AND SUGGESTED THAT SLOPES WOULD CLASSIFY THE
PROPERTY AS PROVISIONAL TO UNSUITABLE.
CATAWBA COUNTY RULES AND REGULATIONS DO NOT PERMIT THE SPECIALIST TO
PROVIDE A LONG-TERM ACCEPTANCE RATE (LTAR) UNLESS THE DWELLING UNITS
ARE STAKED OUT ON THE GROUND AND ALL PROPERTY LINES MARKED.
WITHOUT THE BENEFIT OF AN "LTAR" OBSERVATIONS ARE MADE FROM AVAILABLE
SOILS MAPS AND EXISTING CONDITIONS.
1. LESS THAN 50% OF THE SINGLE FAMILY LOTS ARE USABLE WITH
PROVISIONAL SOILS AND SLOPES. THE MAJORITY OF THESE LOTS WILL USE A
LOW PRESSURE PIPE SUBSURFACE SYSTEM.
2. BECAUSE OF THE FLOODWAY, STEEP SLOPES, GULLIES AND OTHER
DRAINAGE COURSES, -
PERHAPS 44 ADDITIONAL DWELLING UNITS COULD BE
CONSTRUCTED, EITHER AS MULTI -FAMILY OR SINGLE FAMILY, WITH A PRIMARY
SUBSURFACE SYSTEM AND 100% REPAIR.
3. THE NET RESULT IS ABOUT ONE DWELLING UNIT FOR EACH TWO
ACRES OF REMAINING LAND AFTER REDUCING OUT FLOODWAY, GOLF COURSE AND
STREETS, WHICH IS NOT CONSIDERED THE BEST ECONOMIC USE OF THE LAND.
THERE IS NO LAND ADJACENT TO THE PROJECT THAT IS ADAPTABLE OR
AVAILABLE FOR SUBSURFACE USE.
BASED ON THE PREVAILING SOILS, APPARENT SOILS DEPTHS AND GENERAL
KNOWLEDGE OF SEPTIC TANK USAGE IN THE AREA A CONSERVATIVE APPLICATION
RATE OF 0.35 GPD/SF WAS ASSUMED FOR THE ANALYSIS ABOVE.
3. SPRAY IRRIGATION SYSTEM
