On 12/19/2012, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG 140415. In accordance with your request, Certificate of Coverage
Number NCG 140415 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process.of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

set to the N rth Carolina Turnpike Authority for Sedimentation and Erosion Control review. Upon finalization of their review,
the proposed erosion control plan will be submitted to the North Carolina Department of Transportation for approval. NCDOT
operates their own in house Sedimentation and Erosion Control program through their Roadside Environmental Unit for all
projects within designated NCDOT rights -of -way.

On behalf of Raleigh -Durham Roadbuilders (RDR), we are pleased to present you with this Notice of Intent
(NOI) Application for coverage under NPDES General Permit NCG140000 for your review and approval.
The North Carolina Turnpike Authority (NCTA) has retained RDR to provide grading and pavement services
for the Western Wake Expressway (1-540) in Wake County, NC. RDR intends to erect a New Temporary
Ready -Mixed Concrete (RMC) Batch Plant at 1525 South Salem Street, in Apex, NC. The site is located on
Old US Highway 1 (South Salem Street), approximately two (2) miles southwest of the intersection with US
Highway 55 in Apex, NC.
In order to meet NCTA construction schedules, the plant should be ready to produce concrete on February
1, 2012, in order to begin full scale production on Match 15, 2012. To meet this schedule, the owner
needs to have all permits in hand prior to November 15, 2011.
Please find attached three (3) NOI submittal packages including application forms, a written narrative,
design specifications, calculations and supporting documentation, and three (3) sets of construction plans for
your review and approval.

For new plant sites that will discharge or recycle process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to Construct (ATC) wastewater
treatment facilities. ATC requests must be submitted at least 90 days prior to construction'.
For exfstina plant sites discharging or recycling process wastewater (even if commingled with
stormwater): This NOI is also an APPLICATION FOR Authorization to continue to operate wastewater
treatment facilities In place. Construction, modification, or installation of any new treatment components
at an existing site requires an ATC.
Treatment facilities used to treat or recycle process wastewater (including stormwater BMP structures
treating process wastewater flows commingled with stormwater) require an ATC prior to construction
per 15A NCAC 2H .0138. The 4uthorization to construct or continue to operate will be issued at the
same time as the Certificate of Coverage (COC) for the NCG14 permit. Design of treatment facilities
must comply with requirements of 15A NCAC 21-1.0138 & .0139.
Construction of wastewater treatment facilities (this includes recycle systems) at new or existing plant
sites requires submission of three (3) sets of plans and specifications signed and sealed by a
Professional Engineer (P.E.) or qualified staffz along with this application. A copy of the design
calculations should be included. Please see questions 14 & 15.

compliance of final discharge with permit limits. For existing sites, applicants should submit
three (3) sets of plans and specs for facilities as -built and provide as many design details as
possible, or submit a detailed diagram of treatment systems in place that includes information
such as tank volumes, dimensions, retention time, piping, settling basin details, etc.
Please note: If new treatment systems are planned for an existing site, an ATC will be required
prior to construction of those facilities. Plans/specs/calculations prepared by a P.E. and the
request for an ATC may be submitted with this NOI, or separately at a later date. DWO may
request the status of your plans for requesting an ATC upon issuance of the COC.

0.0 INTRODUCTION
This document is intended to accompany the attached Notice of Intent (NOI) to apply for
coverage under the National Pollutant Discharge Elimination System (NPDES) North
Carolina General Permit NCG140000. General Permit NCG140000 applies to
stormwater and process wastewater discharges associated with activities classified as
Standard Industrial Classification (SIC) Code 3273, Ready .Mixed Concrete (RMC).
The North Carolina Turnpike Authority (NCTA) has retained Raleigh -Durham Roadbuilders
to provide design -build services for the construction of the Western Wake Freeway in
Wake County, North Carolina. In order to support paving operations, Raleigh -Durham
Roadbuilders intends to erect a Temporary RMC_Batch Plant within a designated
construction easement located at the intersection of the future Western Wake Freeway
and Old US Highway 1, within the Town of Apex iurisdiction. The site is located on Old
US Highway 1 (South Salem Street), approximately two (2) miles southwest of the
intersection with US Highway 55 in Apex, NC.
This application for coverage applies to a New Temporary Facility. As part of their
normal operations, Raleigh -Durham Roadbuilders intends to operate and maintain a
process wastewater recycle system for the washing of concrete trucks. The recycle system
consists of a wash bay with weir overflow, a primary settling basin (Basin 1) and a
secondary holding basin (Basin 2). During normal operations, the recycle system will
function as a closed system with no discharge. In wet weather conditions resulting in a
discharge of treated process wastewater, Basin 2 has been designed to comply with NC
Division of Water Quality (DWQ) effluent standards for discharge during a 10 year
design event:

All on -site stormwater shall be directed through permanent erosion control structures and

6.0 STANDARD INDUSTRIAL CLASSIFICATION
The four (4) digit SIC Code that describes the proposed primary industrial activity at this
facility is the SIC Code for Ready Mixed Concrete.

7.0 INDUSTRIAL ACTIVITIES
The proposed primary industrial activity to occur at this facility is the production of Ready
Mixed Concrete for the Wake County Western Wake Freeway project.
For the proposed site layout showing the process areas present at the facility, please
refer to Sheet C200 of the attached construction plans.
8.0 DISCHARGE POINTS
There are two (2) discharge points for the property. One discharge point conveys process
wastewater from the wash bay recycle system offsite at the northwest corner of the
project site. A second discharge point adjacent to the process wastewater treatment
system conveys primarily stormwater from the project site. However, the latter will also
be sampled for compliance with wastewater effluent standards, as it has been determined
to contain .a very weak process wastewater stream resulting from the wetting of raw
material stockpiles. All materials to be wet by sprinkler system are to be washed prior to
delivery to the project site. Additionally, the sprinkler system will utilize water from a
municipal source, which has been treated to drinking water standards. Therefore, the
weak wastewater stream has been determined to present very little potential negative
impact on effluent water quality, and will not be treated in the wash bay recycle system.
It will however be treated through conventional sedimentation and erosion control
measures such as rock check dams and a skimmer basin located immediately to the west of
the recycle system. The ultimate receiving water for all discharge points is an Unnamed
Tributary (UT) to Beaver Creek, with a water quality classification of WS-IV, and a
supplementary classification of NSW (Nutrient Sensitive Waters). �—

11.0 BEST MANAGEMENT PRACTICES
This facility will employ Best Management Practices (BMPs) for stormwater control. BMPs
that will be incorporated to this site are as follows..
Permanent Rock Check Dams located in stormwater conveyance ditches.
A Permanent Skimmer Basin to be the final treatment structure for all stormwater (plus the
weak wastewater from material wetting) leaving the site, located at the northwestern
edge of the intersection quadrant.
For the proposed erosion control plan, please refer to Sheet C300 of the attached
construction plans.
12.0 STORMWATER POLLUTION PREVENTION PLAN
This facility does not have a Stormwater Pollution Prevention Plan (SWP3) at the time of
this NOI submittal. However, a SWP3 will be completed and on -site prior to plant
operation.
13.0 VEHICLE MAINTENANCE
Vehicle maintenance activities will not occur on the property.
14.0 WASTEWATER GENERATING ACTIVITIES
Concrete trucks will be washed at 30 gallons per minute for approximately 1 to 2 minutes
in a wash bay directing all runoff to a recycle system.
Wetting of raw material stockpiles will occur at this facility, via sprinkler nozzles run
intermittently, utilizing water from a municipal source, or via periodic sprays from a water
truck. Under normal operating conditions, wetting of raw materials will not produce
runoff. However, runoff is anticipated during wet weather.
The stationary mixing drum at the batch plant will be cleaned once daily. Normal wash
out is 3 to 4 rinses using 250 to 300 gallons of water per rinse until the drum discharges
clean water. Wastewater generated from this process will be contained in ❑ water -tight
front-end loader bucket. The wheel loader will then transfer the process wastewater from
the mixing drum to the wash bay. The contractor will ensure that the bucket used has
sufficient capacity to prevent spillage of wastewater during transport.
Refer to Sheet C200 of the attached construction plans for the proposed site layout.
15.0 RECYCLE SYSTEM
This facility will use a recycle system. The recycle system consists of a wash bay with weir
overflow, a primary settling basin (Basin 1), a secondary holding basin (Basin 2), and a
final treatment basin (Basin 3). During normal operations, the recycle system will function
as a closed system with no discharge. In wet weather conditions resulting in a discharge of

treated process wastewater, Basin 2. has been designed to comply with NC Division of
Water Quality (DWQ) effluent standards for discharge during a 10 year design event-
30 mg/1 for Total Suspend Solids (TSS)
5 mg/I for Settleable Solids (SS)
6-9 SU for pH
The total cumulative volume of all basins in the recycle system is 49,027 cubic feet. The
treatment system has been designed to treat process wastewater to the DWQ effluent
standards under a worst -case scenario, in which all basins are 100% full prior to the
introduction of stormwater runoff from a 10-yr design storm.
Using data available from the National Oceanic and Atmospheric Administration's
(NOAA) National Climate Data Center (NCDC), calculations predict that the recycle
system has the capacity to contain the 25-year, 24-hour rainfall event before overflowing.

Over a 0.54 acre area, assuming all rainfall becomes runoff (CN=100):
10-year, 24-hour volume = 10,664 cubic feet
25-year, 24-hour volume = 12,761 cubic feet
Although the recycle system has been sized to contain the 25-year, 24-hour rainfall event,
it has been deemed impractical to recover the required capacity in a sufficient period of
time (3 days or less). Therefore, the system has been designed to treat process
wastewater to the DWQ effluent standards even if all basins are full prior to the
introduction of stormwater runoff, as stated above. Over the possible life of the facility, it
is possible that all basins may store their maximum volumes at some point. During a 10-
year design storm, TSS and SS effluent limits have been achieved by following a
conventional settling basin design, and using a grain size distribution based on a 2004
study conducted by the National Institute for Standards and Technology (NIST). The
findings of this study have been included in this document as Appendix C.
pH control will be achieved by the use of a skid -mounted, automatic CO2 dosing system
located in Basin 3. The system will be set to maintain a pH of 7.25 in the discharge.
Power will be supplied to the unit using a portable generator. The product used shall be
the Fortrans, Inc. Model 5000-SK Skid Mounted pH Control System, or approved
equivalent. For design data and specifications, please refer to Appendix E.
Infiltration in the wastewater treatment basins will be controlled by the use of a bentonite-
based pond liner product in Basin 1, with a minimal amount of concrete overlay to prevent
damage during maintenance clean out activities. Basins 2 and 3 shall be lined with the
some material as Basin 1 without concrete overlay, or a textured HDPE pond liner
material, at the discretion of the contractor. The bentonite-based product to be use shall

be CETCO Lining Technologies Akwaseol® Pond liner, or approved equivalent. The HDPE
product to be used shall be a GSE 40mil textured HDPE, or approved equivalent.

16.0 100-YEAR FLOODPLAIN
No part of the RMC batch plant, including the recycle system will be located within the
100-year floodplain. For the current Flood Insurance Rate Map (FIRM), please refer to
Appendix F.
17.0 HAZARDOUS WASTE
This facility is not a hazardous waste treatment, storage or disposal facility.
This facility is not a generator of hazardous wastes (small or large quantity).

I've got some questions on the submittal on this project. Please give me a call to discuss. My number is 807-6376.
I'm ok with the talcs. As per the last few you all have submitted, they're very conservative: to the extent that I'm not
chasing details on the math, the design concept, the selected values, or the necessary approximations inherent in the
engineering approach.
I would like to discuss drawing C400, since I'm not understanding it on the following points.
I'm not sure that we are capturing all the aggregate irrigation water. As I read the finished grade topo, it looks like the
western -most portion of the aggregate area might slip off to the west and bypass the sediment basin to the west. What
I see is an existing ravine and a graded slope that seem to fall off to the west of the aggregate storage area— leaving me
to conclude that some portion of the flow from this area will not be through the existing sediment pond. Your concept
is to route that water through the sediment pond, right? Can we amend the drawing to insure that it provides the
features necessary to convey all of the aggregate flow to the sediment basin?
Similarly, with the washdown of the silos and plant area. I see that you have looped the 372' contour to capture flow
from this area and send it to the sediment basin. But, it would seem more certain to me if we avoided the possibility of
the grading contractor missing that/deciding that it would be cheaper just to grade it all flat/thinking he could just dig a
10' square hole around the mouth of the slope drain/etc, and if we provided labeling or centerline or more developed
contour work that more clearly emphasizes that an important element of this job is a drainage feature to be installed
north of the plant area and leading to the existing sediment basin. This drainage feature must capture the plant area,
and most of the rest of the site , and it must effectively exclude the flows from the truck wash off pad.
I do see a series of 1/8" rectangles spaced along the north and west edge of the stone pavement, but I didn't find a label
on C400 that tells me what that symbolizes. is it intended to indicate a line of concrete barriers as a surface water
diversion? If so, can we label it on C400? If it is supposed to be those portable highway concrete barriers, then we need
some spec or note calling for them to be installed so as to be an effective barrier to overland flow. The contractor can't
set them 5' apart, as per one possible interpretation of the little rectangle symbology. I note that C200 of the same
drawing set mis-labels (I think) the chain -link fence as the concrete barrier— that shouldn't be a confuser, but who
knows on a construction site. Let's make sure the contractor knows what to build as completely as possible on C400.
Could we identify and label the outfall sampling locations on C400 so that we can see where your client will be taking his
samples?

Please see below our response to comments provided on October 10, 2011. Revised plans are attached.
Comment #1: I'm not sure that we are capturing all the aggregate irrigation water. As I read the finished grade

Response #1: Based on actual field conditions, the "ravine" actually does flow into the sediment basin. The
ditching shown on the plans is the future, proposed condition based on the NCDOT plans. A diversion berm has
also been added to the west and northwest portions of the site to ensure that all run-off from the aggregate
irrigation is directed to the slope drain, and therefore the sediment basin.
Comment #2: Similarly, with the washdown of the silos and plant area. I see that you have looped the 372'

flow, except for the truck washing area, to the proposed slope drain. Notes have been added to both Sheets C300
and C400 to reinforce this concept.

Response #3: These concrete barriers are proposed as a protection for trucks operating adjacent to a large slope.
The barriers are NOT intended to be a flow diverter. The barriers have been removed on the northwest portion of
the site due to the location of the fence and the addition of a diversion berm. All labeling on the plans has been
updated to properly identify the barriers and the fence.
Comment #4: Could we identify and label the outfall sampling locations on C400 so that we can see where your
client will be taking his samples?
v Response #4: The discharge sampling location has been labeled on the plans as requested.
Comment #5: 1 need to be clear on the northern downslope basin labeled, "Proposed stormwater management

Response #5: This is area is a proposed BMP for the roadway. It currently functions as a storage area. All site
work and design related to the NPDES permit has been limited to the proposed limits of disturbance, as shown on
Sheet C300. The stormwater management area only factors into our design in so much as we have made sure to
avoid the inundated area in our grading efforts.

of the construction activity for the Western Wake Freeway project. As you know, we're required to go
through your section for concurrence with the issuance of our permit.
Relevant items:

Apex, NC.
2. Treatment facility designed to operate as a recycle system with no discharge normally, and to

In accordance with your application for a discharge permit received first on
September 23, 2011, and subsequently received in completed form October 24, 2011, we
are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state — NPDES general permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Please note that our General Permit NCG140000 contains effluent limitations for
process wastewater discharges (see Part IV, Section D of the permit text). Wastewater
discharges must meet the requirements of these effluent limitations. An exceedence of any
of these limitations is a violation of permit conditions.
Please note that groundwater standards in 15A NCAC 02L and 02T regulations must
also be met for recycle systems or any discharges to groundwater.
This certificate of coverage is not transferable except after notice to the Division of
Water Quality and upon our specific action. The Division of Water Quality may require
modification or revocation and reissuance of the certificate of coverage. This permit does
not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal
Area Management Act or any other federal or local governmental permit that may be
required.
Please note that the Authorization to Construct permit requirements in Part II,
Section A, numbers 1-5, and Part II, Section B, number 1 are no longer valid per the July 1,
2011, NC Session Law 2011-394. However, note that Part II, Section A, number 6, and Part
II, Section B, numbers 2-10 are unaffected by this Session Law. Those sections remain in
effect for the duration of this permit term. Please be reminded that your facility must notify
the DWQ Raleigh Regional Office at least 72 hours in advance of the first time operation of
your wastewater treatment facility.

In accordance with your application for a discharge permit received first on
September 23, 2011, and subsequently received in completed form October 24, 2011, we
are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state - NPDES general permit. This permit is issued pursuant to the requirements
of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Please note that our General Permit NCG140000 contains effluent limitations for
process wastewater discharges (see Part IV, Section D of the permit text). Wastewater
discharges must meet the requirements of these effluent limitations. An exceedence of any
of these limitations is a violation of permit conditions.
Please note that groundwater standards in 15A NCAC 02L and 02T regulations must
also be met for recycle systems or any discharges to groundwater.
This certificate of coverage is not transferable except after notice to the Division of
Water Quality and upon our specific action. The Division of Water Quality may require
modification or revocation and reissuance of the certificate of coverage. This permit does
not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal
Area Management Act or any other federal or local governmental permit that may be
required.
Please note that the Authorization to Construct permit requirements in Part II,
Section A, numbers 1-5, and Part II, Section B, number 1 are no longer valid per the July 1,
2011, NC Session Law 2011-394. However, note that Part II, Section A, number 6, and Part
II, Section B, numbers 2-10 are unaffected by this Session Law. Those sections remain in
effect for the duration of this permit term. Please be reminded that your facility must notify
the DWQ Raleigh Regional Office at least 72 hours in advance of the first time operation of
your wastewater treatment facility,
