Based on the information provided and an April 11, 2019 site inspection by MRO staff, we are approving this request. In accordance with 40 CFR § 122.2 1 (g)(7), you are authorized to sample outfall number 2 as representative for the entire site. This approval is effective with the next sampling event. Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that representative outfall status has been approved. If changes in drainage areas, structures, processes, storage practices, or other activities occur that significantly alter the basis of this approval, representative outfail status may no longer be valid. You should either resume sampling at all SDOs, or reapply to this office for representative outfall status based on updated information. Purpose and Scope The purpose of the plan is to identify sources of toxic organics in the plant wastewater and describe controls necessary to ensure that these chemicals are not intentionally or accidentally discharged in the facility wastewater system. Refer to Appendix A for the toxic organic list. a. Process Description The Southwire Huntersville Plant manufactures medium to heavy duty underground cable using vertical continuous vulcanization (VCV). The manufacturing process begins at the wire drawing line in which copper or aluminum rod is drawn down to smaller wire size specifications. At stranding, the copper or aluminum wire is twisted to form a conductor_ The conductor can be additionally twisted together at the drum twisting line for large size conductors. At VCV line and tower, up to three (3) layers of insulation are extruded onto the conductor usually involving an inner layer of insulation / black polyethylene conductor shield, a layer of colorless insulation, and a black outer layer 1 black polyethylene insulation shield. Ground wire is added over the cable at the screening line. At the jacketing line, an outer copper shield layer is added over the cable and an outer layer black polyethylene insulation shield is extruded onto the cable. The wire draw line uses oill water / emulsion solutions from a closed system to draw the wire down. The water solution is changed out periodically in which the solution is pumped out a cleaning tank and into totes or vacuum truck for waste to energy disposition. Stranding, screening and drum twist lines do no require water. The VCV process located at the tower utilizes a closed loop water and nitrogen system to cure the insulation layers from the extrusion process. Water is recirculated and stored in a recirculation tank Waste process water is collected in a clean out tank. When full, the waste water is pumped into a tote for a waste to energy disposition. Water that overflows during change -over is captured in a sump pit and transferred to the sewer line. Water is used to cool the cable from the extrusion process in the jacketing line_ This is a closed loop system. Water is not discharged. The jacketing line is in the main manufacturing area. b. Inventory of Total Toxic Organic Chemicals present on site Currently there are no Toxic Organic Chemicals present on site. See "Annual TTO Review" in "section c" below. c. Management Procedures and Engineering Measures for assuring that toxic organics do not spill or leak into stormwater. • Chemical Approval: Prior to purchasing, a new chemical is reviewed through an approval process in Southwire's Safetec SIDS system. An EHS review is performed on the chemical to determine the environmental impact, including TTO. Safety Process Review: All new processes or significant modifications to processes are reviewed through a Management of Change procedure. Any new chemicals are identified and reviewed for environmental impact, including TTO. • Employee Training: Annually, employees are trained on Spill, Stormwater, and Waste Management procedures. Spill clean-up, chemical storage and chemical waste management are topics that are reviewed. • Engineering Controls: Liquid chemicals are stored inside the plant or within building structures with spill containment, inside flammable cabinets, and/or in double wall design containers. • Spill Control: Response to spills is immediate and considers containment, proper clean-up of spill, proper disposal of waste and notification to Southwire and regulatory officials. Storage of chemicals follows practices identified in "Engineering Controls" in this plan. Annual TTO Review: Annually using the Southwire Safetec database, the CAS numbers of chemicals for this site is compared to the TTO list (Appendix A) for usage of TTO chemicals. This Solvent Management Plan is reviewed annually and updated when applicable. Seller is the owner of a high voltage power cable manufacturing plant located at 12331 Commerce Station Drive, Huntersville, North Carolina (the "Facili „ ). For purposes of clarity, "Facility„ includes the Transferred Real Property, and all improvements thereon and made thereto. 2. Buyer desires to purchase from Seller, and Seller desires to sell to Buyer, the Acquired Assets. 3. Buyer desires to assume the Assumed Liabilities upon the terms and subject to the conditions set forth herein. 4. In connection with the purchase and sale of the Acquired Assets, Buyer and Seller desire to enter into the Ancillary Agreements. 5. Each capitalized term used in this Agreement has the meaning ascribed to it in Article Xl. To the extent permitted by applicable Law, each Party hereby irrevocably waives all rights to trial by jury in any action, proceeding or counterclaim (whether based on contract, tort or otherwise) arising out of or relating to this Agreement or the Transactions or the actions of any Party in the negotiation, administration, performance and enforcement of this Agreement. 12.16 Further Representations. Each of Seller and Buyer acknowledge and represent that it has been represented by its own legal.counsel in connection with the Transactions, with the opportunity to seek advice as to its legal rights from such counsel. Each of Seller and Buyer further represent that it is being independently advised as to the tax consequences of the Transactions and is not relying on any representation or statements made by the other as to such tax consequences. 12.17 CounterRarts and Facsimile Signature. This Agreement may be executed in one or more counterparts, and by the parties hereto in separate counterparts, each of which when executed will be deemed to be an original but all of which taken together will constitute one and the same agreement. This is being allowed since I was at the site during the installation of all of the BMP's, and since they have been in the ground and functioning for several years. We have also reached out to the original engineer to see if we can get a copy of the design calculations for the BMWs. The design engineer seems agreeable to help us find these calculations. Mecklenburg County has an agreement with our Department to assist with NPDES inspection efforts in their county jurisdiction so they are familiar with your facility. The county noted a number of inspections over time and while they didn't appear to have any concerns with the permit, they did have a concern about information that has not been provided to them. They noted that the facility was in non-compliance with the Huntersville post -construction ordinance because you have not provided required as -built information for the BMPs (Stormwater Best Management Practices) on your property. it will help our process forward with your permit to have assurances that you have resolved this issue with the County and Huntersville. On two (2) other occasions we responded to spills at the facility and required corrective actions. No water quality impacts were documented. The only current outstanding issue that we have with ABB is that they have not submitted the required as-builts for their BMP. Until the as-builts are received and approved by the County they are in noncompliance with Huntersville's Post -Construction Ordinance. If you can help with this issue it would be much appreciated. Also, we didn't know they were trying to sell the facility. We would not want the property to change hands without the as-builts being approved. This will put a burden on the new owner of the BMP. If you need copies of any of our reports, please let me know. Thank you. They were following the general permit, but just never went through the permit process. Anyway, they have submitted now and are working through the process quickly since they are selling the property at the end of the month. Your input would help us to be able to move forward quickly with getting their coverage in place.
