Pursuant to our telephone conversation this morning, the State of North Carolina approved the permit modification that
documents the change in the name and ownership of the above subject NPDES Permit from Occidental Chemical to
Elementis Chromium. This permit covers the operation of the facility's industrial wastewater plant and the domestic
wastewater treatment plant. Occidental Chemical continues to hold the Surface Disposal Permit and is responsible for the
quarry surface disposal units and the groundwater activities at the facility.
In addition to the name change, minor modifications were made to the permit (at Elementis Chromium's request) to include
all process equipment and piping associated with transport of the treated residue into the quarry (it was previously assigned
to the Occidental Chemical's surface disposal non -discharge permit). All other terms and conditions of the previous permit
remained unchanged. Occidental Chemical is now in the process of submitting a permit modification request to the
Non -Discharge Permitting Unit to have the above mentioned equipment removed from the Occidental Chemical surface
disposal permit.
One of the conditions (Condition I.3.c.) of the surface disposal permit states that Elementis Chromium's NPDES permit be
modified to allow the continued discharge of groundwater and quarry water to Elementis Chromium WWTP. These streams
were included on the drawing of influents to the NPDES plant as required in the NPDES permit renewal application submitted
to the State on August 1, 2001. In Tight of the change of ownership from Occidental Chemical to Elementis Chromium, both
Occidental Chemical and the Non -Discharge Permitting Unit believe it is appropriate to obtain confirmation from the NPDES
unit in the form of a letter or an e-mail that states that the groundwater and quarry water streams are still included as
influents to the NPDES industrial wastewater treatment plant.
In other words, what is needed is acknowledgement that it is acceptable for the surface disposal supernatant and remediated
groundwater to continue to be sent to the NPDES facility for treatment/disposal and that the language in the reissued NPDES
permit implies that these activities are still approved.
