records concerning Section 401 Water Quality Certification to conduct bank stabilization
activities and restore cover to an exposed natural gas pipeline within waters of the United States.
Based on a review of the Corps of Engineers Regulatory Program, it appears that the work
proposed herein could meet the criteria established for authorization under Nationwide Permits
(NWP) No. 3 — Maintenance and No. 13 — Bank Stabilization, as found in the March 12, 2007,
Federal Register, Reissuance of Nationwide Permits (72 FR 11180). We will comply with the
general and regional conditions of the permits during construction.

Transco's 50ft Right- of-Way (ROW) crosses Dye Creek approximately 2 miles southeast of Mooresville, NC. The bed, as well as the bank of the
creek, consists of primarily clay, rock and sand with a vegetative line located throughout some areas of the creek. The banks are vegetated with grass,
trees, and brush with a sheer bank determined on the southwestern lateral. The creek has migrated southwest, degrading the creek bed.

Project is designed to minimize the amount of material to be placed within the stream, but maximize the protection of the currently exposed pipeline
and additional lines within the section of the right -of -way.

Measures to control sediment and erosion will be implemented prior to any ground disturbance and will be maintained throughout project construction.
Permanent grass will be planted to help control erosion immediately following any final ground disturbing activity. Native annual small grains and
herbs appropriate for the season will be planted. Also, fertilizers and pesticides will not be used near streams. Additionally, construction best
management practices, using pre - formed concrete mats, working in the dry, using clean uncontaminated fills, and soil stabilization measures.

3d. Over the duration of twenty years, the creek has migrated southwest abandoning its original bed
and creating a new one. The original bedding has silted and become benched with the high high bank
(HHB). Also; several headcuts have been moving through the system with several sizeable rocks acting
as hard points directing flow thus causing degradation of the soils and banks as well as lateral migration.
Identified within the ROW are four (4) Transco pipelines; two (2) 30 -inch pipelines (Lines A & B) located
upstream, one 36 -inch pipeline (Line C) located midstream, and one 42 -inch pipeline (Line D) located
downstream. There is an additional abandoned pipeline within the ROW as well. This project proposes
to re -route Dye Creek to its historical location, while installing articulating concrete mattresses to
protect the pipelines from exposure.
3e. Submar proposes to armor the pipelines with a system of articulating concrete revetment
mattresses for the entire distance that the lines run across the ditch to stabilize the banks, cover and
protect the pipelines, as well as provide cover on the exposed sections of the pipeline. The east and
west bank will be cut back to create a gentle, stable slope within the project area. The freshly graded
creek will be covered with a geotextile material prior to the installation of the Submar concrete
revetment mattress system. The mattress system will extend from the high bank on the east lateral,
across the creek bed to the high bank on the west lateral. The mattress system will be anchored into
the high bank elevations in excavated termination trenches to prevent flanking of the system. The
upstream, leading edge of the mattress system will also terminate into an excavated 3 -foot deep anchor
trench. Longitudinal Peaked Stone Toe Protection (LPSTP) will be placed along the left- descending bank
and the right- descending bank to prevent further migration of the bend. The LPSTP will key into the
banks upstream of the mattress system terminating at the mattress systems leading edge. The LPSTP
will consist of well - graded riprap installed along the toe of the right descending bank to stabilize to the
bank. Submar's LPSTP design will resist against future erosion of the creek's right- descending bank.
Submar's articulating concrete revetment mattress system, in addition to the LPSTP, will provide and
maintain cover over the pipelines within the matted area. The proposed project will necessitate the use
of a track -hoe, skid steer for excavation, grading, and mat installation, and a 6" pump for dewatering.
