PROJECT DESCRIPTION: The project site is located at 1862 and 1900 Scotts Hill Loop Road, adjacent to Futch Creek located in the Pender County. To locate the property from NC Highway 17, turn right onto Scott's Hill Loop Road and travel east approximately 1.8 miles. The property will be located on the right at the end of a long dirt driveway. The property consists of two lots, each approximately 1.5 acres, with a combined approximate shoreline of 290 feet. The highground portion of the property averages approximately 26 feet above mean high water (MHW) and the vegetation consists of lawn grasses and ornamental landscaping. There are currently two single-family residences on the property. The lot slopes from the highground downward to a fringe of high marsh, measuring approximately 20 feet wide. It consists of mixed coastal wetlands and "404 type" vegetation, which includes: Salt Meadow Grass (Spartina patens), Sea Ox-eye (Borrichia frutescens), Spikegrass (Distichlis spicata), Glasswort (Salicornia sp.) and Sea Lavender (Limonium latifolia). The property then transitions waterward into a band of Smooth Cordgrass marsh (Spartina alterniflora), which is approximately 30 feet in width. The waters of the AIWW and Futch Creek are classified SA-ORW by the Division of Water Quality. They are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a private pier with a T-head that would terminate onto a floating dock with two (2) boatlifts. The shoreline from both lots must be utilized for the proposed docking facility to meet the four square foot rule. The applicants have submitted a "Declaration of Joint Use of Adjacent Lots For Single Pier Along Riparian Shoreline''. The document has been signed and notarized. but proof has not yet been submitted that it has been recorded by Pender County. The pier would extend from the highground towards Futch Creek a distance of approximately in length. It would then terminate in a 24' in width by 16' in length T-head at the waterward edge of marsh. A ramp would lead onto a 40' in length by 8' in width floating dock aligned perpendicular to the pier. The applicant's hydrographic survey states that the water depth at the location of the proposed floating dock is -1.3' at Mean Low Water (MLW). The application states a frame would be constructed under the floating dock to prevent the dock from sitting on the substrate at low tide (see Project Narrative and Drawing 5 of 5). Two 13' by 13' boatlifts would then be installed at each end of the floating dock. The proposed structure would provide docking space for up to four (4) vessels. 10. ANTICIPATED IMPACTS The proposed pier system construction would incorporate 1,042 sq. ft. of Estuarine Waters and Pubic Trust Area and would shade approximately 300 sq. ft. of Coastal Wetlands. Minor increases in turbidity should be expected during construction. Due to the limited amount of water, there will be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers accessing the docking facility at low tide. The proposed pier would extend approximately 36 feet into the waterbody from the edge of marsh, which measures in excess of 240 feet across. This distance would conform with the 1 /4 width rule.
