The Division of Water Quality has reviewed your submittal fora 401 Water Quality Certification for the aforementioned project.
Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit
application was deficient in the following areas:
1. Please recalculate total impacts to streams for this project. The channel referred to as the South Tributary should be
identified as the main stream and the impacts to this channel should be totaled with the impacts from the culvert extension.
The impacts to the North Tributary should be identified as impacts to a separate channel. Per the Water Quality General
Certification #3404 (corresponding to the NW #14) that will be issued for this project "Impacts to streams as determined by
the Division of Water Quality shall be measured as length of the centerline of the normal flow channel."
2. Please explain the Grade Control Sills shown at the upper end of both channels. Please submit a construction detail for
these structures.
3. Please provide a plan sheet and profile that clearly shows the existing road fill (both edge of pavement and toe of fill slope)
and the new road fill (new edge of pavement and new toe of slope) with the location of the existing stream channels and
proposed channels shown to scale. The two pages of plans submitted (Exhibit 4 and Exhibit 6) do not appear to provide the
same location of the relocated stream channels and the scale on Exhibit 6 does not match up with the written distances on
the plans.
4. Please provide a thalweg channel profile for the relocated channels. The profile should clearly indicate pools, riffles and
other features for use by the contractor during construction.
5. Please clarify the profiles of the provided stream sections. The profiles provided do not indicate dimensions but appear that
the stream banks maybe greater than 2:1 slopes. Slopes greater than 2:1 will be difficult to establish vegetation. If steep
slopes are necessary due to area constraints, please provide justification and additional measures to ensure the banks will not
excessively erode.
6. Details of the cross vane structure indicate that installation elevation is determined by bankfull elevation. Please ensure that
resubmitted plans and profiles of the relocated channels indicate appropriate elevations such as streambed, bankfull, and
streambank elevations so that structures are installed accurately.

The Division is concerned that the meander bend designed at Section D-D maybe situated too close to the new toe of fill
(depending on the accuracy of the scale provided in the submitted plans). It has been our experience that a design should
account for space between the toe of fill and the top of streambank. It will be necessary to have space to complete
construction as well as provide erosion control measures between the fillslope and the stream. In addition, installation of the
rootwads into the fillslope should be addressed to deternune if it provides a stability concern for the roadway. Also, if the
stream is allowed to be aligned duectly at the toe of fill and in the future causes any erosion of the fillslope it would create a
situation that is best to avoid if possible.
Section VIII 1. of the PCN indicates that "The City will place a permanent conservation easement over the relocated and
restored stream area to include a minimum 100-ft buffer from the top of stream banks." It appears that the easement is not
large enough to include 100 ft buffers on all sides of the restored streams. Please provide a clear indication on the plans
where existing vegetation will not be disturbed, what areas will be vegetated with appropriate native woody species, and
what areas will be vegetated with herbaceous cover and maintained. Restrictions such as easement limits, the adjacent
sewerline and water line easements, and the roadway fill, should be accounted for in determining what areas can provide
vegetated buffer protection for the relocated streams.
Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the
necessary information. You have 30 days to respond in writing with the requested information or notification to this office that the
information is forthcoming. Please send one copy of the requested information to Mr. Ian McMillan, N. C. Division of Water
Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650 and send one copy to Sue Homewood,
DWQ Winston-Salem Regional Office, 585 Waughtown Rd, Winston-Salem, NC 27107. If, at the end of the 30 days, our office has
not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore,
until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of
Engineers place the permit application on hold.
