Dear Mr. Rawls:
As we discussed during our telephone conversation on July 5, 1991,
attached is a copy of the affected portion of revised Plan Sheet Number 4 as
well as the revised portion of the overall sheet for the subject project. I will
mail you the original of this letter and a complete set of the revised plans for
your files this afternoon.
We now show that the existing culvert between Lots 22 and 23 will be
removed and replaced with a grass lined swale. The culvert is to terminate
at the roadway right-of-way line. A flared end section and rip -rap dissipation
pad will be located at this terminus point which is consistent with the
NCDEHNR- Land Quality Section's requirements. Also, the temporary
sediment pit will be constructed in its original location so as to prevent
erosion from migrating off -site.
I discussed the elimination of this particular culvert with Mr. Dean
Walters of Sea Trail Corporation last Friday. At that time, he authorized our
firm to make the requested revisions to the plans.
As you are aware, an Erosion Control Permit has been issued for the
subject project. By copy of this letter, we are informing Mr. Dan Sams of the
North Carolina Department of Environment, Health and Natural Resources -
Land Quality Section of this minor revision to the project and are
transmitting him a copy of the affected plan sheet for his files.

It is our understanding that your receipt of this information will allow
issuance of the required permit from your department. We request that you
mail us a copy of this permit for our files.
Again, we appreciate your attention in this matter and value the good

which require such stormwater permits.

We find the plan to be acceptable and hereby issue this letter of approval with
comments as attached.
Please be advised that Title 15A, of the North Carolina Administrative code,
4B.0017(a) requires that a copy of the approved plan be cn file at the job site.
Also, you sbould consider this letter to give the Notice required by CS 113A-61(d)

oriented, requiring protection of the natural resources and adjoining properties.
If, follawing the of this project, it is determined that the erosion
and sedimentation control plan is inadequate to meet the requirements of the
Se tatien Pollution control Act of 1973 (North Carolina Cenral Statute 1IM-51
thru 66) , this office may require rim revisions to the plan and its implementation to
insure ecupliance with the Act.
Recognizing the desirability of early coordina.tim of sedimentation control, we
believe that it would be beneficial if a cmfereanoe could be
arranged to discuss the approved plan for this project. Please contact this office

We are pleased to submit for your review and approval three (3) sets of
the project plans with supporting documentation for the subject project.
Also enclosed, is the Projects Using Density Limits for Stormwater Control
form which has been executed by the Owner. Enclosed are original
statements which have been executed by the Owner and duly notarized.
As you recall, these statements refer to: (1), the required restrictive
covenants and deed restrictions; (2), authorization by the Owner for our firm
to submit these plans; and, (3), the areas which have been reserved by Sea
Trail Corporation. Please note that references to these required statements
appear on the enclosed plan sheets.
Enclosed is a copy of the Erosion Control Permit which has been issued
for the subject project. By copy of this letter, we are informing Mr. Dan
Sams of the North Carolina Department of Environment, Health and Natural
Resources - Land Quality Section of our submittal of this project to your
department.
On behalf of Sea Trail Corporation, we respectfully request that the
existing stormwater facilities (ie. culverts and catch basins) be allowed to
remain as constructed. This request is made with the belief that the intent
of the current North Carolina Stormwater Regulations will not be
compromised. Sea Trail Corporation and our firm feels that adequate
filtration of the stormwater runoff generated for this project will be provided
by the extensive use of roadside and other triangular vegetative swales within
the project. It also complies with the allowable impervious area under the
density limits option. We trust that your department will find our submittal
acceptable and that the subject project warrants approval.

Dear Mr. Houston:
On May 7, 1991, The Wilmington Regional Office received a
copy of the Sedimentation and Erosion Control Plan for -the
proposed development of Oyster Bay Utilities Phase 3. To -date,
however, this Office has not received a submittal concerning
stormwater management for the subject project. A stormwater
submittal must be received by this Office no later than June 10,
1991, or the subject file will be closed and construction may
experience subsequent delay.
Please be reminded that any site which requires either'a
Sedimentation and Erosion Control Plan or a CAMA Major permit
will also require a Certification of Stormwater Exemption or
Approval by The Division of Environmental Management. Any
construction on such a site, prior to receipt of the required
Certification, will constitute a violation of 15A NCAC 2H. 1003
and will result in appropriate enforcement by this office.
