Alan, The proposed impacts were corrected from the last submittal (dated July 23, 2021). In addition, the site plan was re- evaluated by the civil design engineer and now includes a redesign to the proposed retaining wall (updated submittal dated August 12, 2021). The retaining wall was shifted to the east to directly abut the driveway and truck court area, which has resulted in a reduction to the overall stream impact by 69 linear feet from the previously submitted (and corrected) site plan. The corrected site plan proposed 521 linear feet of stream impact, and the current updated site plan proposes 452 linear feet of stream impact. The developer explored implementing underground stormwater controls or constructing multiple smaller retention ponds to reduce impacts to the on -Site stream and wetland. However, due to the size of the development, amount of impervious area, and planned use for heavy truck traffic, underground stormwater management is very costly and impractical. In addition, relocating or shifting the building and/or parking areas into the current location of the proposed BMP in the western portion of the Site would not result in an additional reduction to on -Site Waters of the U.S. due to: 1) the presence of the Duke Energy high tension powerlines located in the eastern portion of the Site; 2) industry -required dimensions of the Site building; and 3) parking constraints. These points are discussed in more detail below: • Duke Energy high tension powerlines are located in the eastern portion of the Site. Based on the Duke power right-of-way, parking is the only possible use below and in the vicinity of the powerlines. Because of the presence of the powerlines, the proposed location of the building is fixed, and the entirety of the building must be located to the west and outside of the powerline right-of-way. The proposed building has been pushed as close as possible to the powerline right-of-way. Parking has been located in the eastern portion of the Site because parking uses are allowed below the powerlines. In addition to the Duke Energy Powerline right-of-way, a sanitary sewer easement exists in the west -central portion of the Site. The developer is proposing to relocate the sanitary sewer along the western Site boundary to maximize developable upland area on the Site. • Due to industry -specific requirements, a further reduction in building size is not economically feasible. The building has been reduced to the industry minimum of 225,000 square feet that includes a required 240-ft depth of building and 130-ft depth of truck court. The building has been reduced from the originally proposed 285,000 square feet to the currently proposed 225,000 square feet to reduce impacts to on -Site Waters of the U.S. • The developer explored reducing parking areas along the frontage of the proposed building in order to shift the development toward Hambright Road to further reduce impacts to on -Site Waters of the U.S. However, tenants require access to the front of the building in the case of multi -tenant leases, which are likely for this development. Additionally, due to the length and width of the building, the Americans with Disabilities Act and fire department require access points and parking along the building frontage. The developer has included parking spaces based on market demand. i Let's discuss these points during our site meeting tomorrow. Please let me know if we can provide any further information. Or just a correction of proposed impacts. I believe I asked about the siting plan and utilization of underground stormwater controls that would allow more room for parking. There was no response to the potential avoidance and minimization regarding alternative site layout. We need to confirm the intermittent stream calls for our mitigation purposes. What about August 19th, after lunch?
