In the second paragraph he mentions removal of the sediment. We do not think sediment from the NCDOT project is
significant enough to be removed. There is significant sediment accumulation over several years before our project
started.

Not that I am aware of, it seems the landowner is threatening action and if any action were brought it should be in the
form of an inverse condenation.

Gentlemen,
Attached are: A letter from Wyatt Farlow's Attorneys, Results of an investigation by the Department on 10/25/10, Map
showing depths of recent sediment
As you can see the Department found only minor siltation and the silt was considered so little that it could not be easily
removed. The project has lost silt into the steam that goes to Mr. Farlow's Pond several times. However, vegetation is
now established in this area except for the roadbed and erosion control measures are installed according to plans.
Some of the sediment reaching the pond may be from other property along the stream. (Estimated 1.5 to 2 miles from
project to pond). We have not seen the report by Mr. Farlow's soil scientist.
