Hey Chuck,
Not sure if you have been made aware of this situation yet, but you can read the email trail below to catch up. Mason
Herndon with DWQ visited the site today along with Barry Harrington and discovered a subdivision nearby that has no
measures and is depositing sediment into several streams and through DOT's project described below. Mason said the
subdivision is located on Old Way Road in Sophia and saw a sign for Ace Avant (a concrete company out of Archdale). Do
you know anything about this project? Thanks.

Good Morning Everyone,
Can anyone provide me with any additional information on the location of pond and /or the property owners name?
The only complaint or report I have received concerning sediment in a pond on the US 311 Bypass Project was reported
by Mr. Wyatt Farlow whose pond is located on 3083 Thompson Heath Rd in Sophia. The pond is approximately 9000 ft
downstream of the project. There have been incidents where sediment loss have occurred on project and discharged
into tributaries that feed the pond, however the sediment was promptly removed by NCDOT's contractor. The losses
were not due to a lack of maintenance or inadequate measures, they were in conjunction with heavy rain events that
overwhelmed the devices. NCIDOT had core samples taken from the pond in June 2010 and found little to no
accumulation of sediment in the pond, however turbidity has been an continuing issue due to a residual film of sediment
in the stream system that could not be retrieved. Mr. Farlow has acquired an attorney and all records and reports have
been provided to him earlier this year.
As I stated earlier this is the only report I have received concerning sediment in a pond. I will contact the NCDQT
resident engineer's office to see if they have received any other complaints.

Mason Herndon handles DOT projects in Randolph County, because its in DOT Division 8. He is in the
process of issuing a NOV to DOT on this project. I have included him on the email, so he can
respond. I'm assuming this is associated with US31 1, as I -77 doesn't run through Randolph County.

I just returned from the work session of the Soil and water Conservation
Commission. Craig Frazier, a Soil and Water Conservation Commissioner and
former EMC member, showed some photos of a problem that local efforts in
Randolph County have been unable to get addressed.
In brief and as relayed to me, this is an erosion and sedimentation
problem caused by the construction of a new part of I -77 in Randolph
County. The soil has left the site and deposited sediment in a private
pond down stream in excess of 9 inches deep. Neither NCDOT, nor Land
Quality have shown interest or concern and have made no attempts to
protect: either water quality in the receiving stream nor the property of
the downstream farmer.
From photos taken yesterday and presented by Mr. Frazier, the stream
appears to be quite turbid.
Please have someone go to the Soil and Water Commission meeting tomorrow
morning (Wednesday)in the Ground Floor Hearing Room of the Archdale
Building and get this information directly from Mr. Frazier.
I would appreciate hearing what the DWQ field staff has to say about this
situation. DOT is a major actor in changing of land use in our state. We
have given them significant consideration in regards to their activities
in building and maintaining highways and other road infrastructure which
has the potential to impact water quality. However problems do occur and
measures should be taken to protect the streams and downstream property
owners.
