Please see below email exchange with Hydro clarifying the Item 5 requirement as discussed this morning. The causeway
itself does NOT need to be 1’ above BFE, which is 23.3’. An elevation of 24.3 is equivalent to the bottom of the caps and
is actually two feet higher than the record high. However I will note that Items 5 and 7 are addressed in the narrative
writeup to Jay for the mod.

Brian,
Can you please expand on the Item 5 requirement for an equipment staging area 1 ft above BFE? Is this to be
interpreted that there just has to be a high ground area for equipment to escape to in the event of a catastrophic
flooding event where the work bridge and/or causeway are inundated? Or is the intent that the causeway itself should
be built to an elevation 1 ft higher than the BFE?

Sorry for not getting back sooner.
NC-NFP (FEMA’s state representatives) have no issues with the causeway. We will not be required to obtain a floodplain
development permit for this; however, if Donnie LaVelle has any further concerns regarding this matter he can contact
us. On occasion we have completed(no fee) a local floodway development permit for community’s records.
The only provisions of Chapter 15, Section 15.6 of our Guidelines for Drainage Studies and Hydraulic Design (Jerry
provided them below) I believe are necessary are number 5. Designated staging areas for equipment that are at least
one (1) foot above the BFE and 7. Department commitment assuming liability for any flood damages resulting from the
temporary encroachment.

Thanks for reaching out to us regarding this inquiry. I have a couple of things to mention that will hopefully help to
answer your questions:
First, as a state agency, we are governed primarily by Federal Executive Oder 11988 and State Executive Order 123
(discussed in our Guidelines, linked below, in Chapter 2) with respect to floodplain management compliance, so we are
generally not subject to local floodplain ordinances; however, we are glad to coordinate through our relationship with
the NC Floodplain Mapping Program, NCFMP, (via our Memorandum of Agreement) with the Craven County floodplain
administrator to ensure any concerns they have are properly addressed. As such, we would not be required to obtain a
floodplain development permit from them for this.
Secondly, our Guidelines for Drainage Studies and Hydraulic Design address Temporary Encroachment in Regulatory
Floodway in Chapter 15, Section 15.6, as follows:

We have had a close ongoing relationship with NCFMP, which is Cooperating Technical Partner with FEMA for National
Flood Insurance Program (NFIP) compliance for many years, and we likewise are in regular contact with Mr. Steve
Garrett, who is the state’s NFIP Coordinator. I would be happy to provide his contact information if you would like to
reach out to him. I think the primary concern in this project location is that the DOT be prepared in the event of liability
from a major storm event that could potentially cause any increase in the 100-year base flood elevation on an insurable
property during the time the temporary causeway encroachment is in place. From a quick look at the aerial photos of
the bridge site, it does not appear to me that there is any significant concern in this regard, but it would need to be
verified. If needed, we have a monthly coordination meeting with NCFMP (on a “virtual” platform) the first Thursday of
each month, and we could add this project on the agenda for discussion, if that would be helpful.

I’m reaching out to you in reference to a bridge replacement in Craven County. I’m not sure exactly sure who I need to
talk to, but I figured this would be a good start. The contractor is requesting to install a temporary causeway in the
floodplain to shorten the length of their work bridge. I have reached out to Donnie LaVelle
(dlavelle@cravencountync.gov) per Stephen Lane request below and he’s asking about how FEMA looks at this. This
would be temporary (6 months to 18 months) depending on if the contractor can complete their work during the first
moratorium or not. Do you know what potential impacts this would have on the floodplain in this area? Any help would
be greatly appreciated.

Before we get too far into this subject, my understanding is that Craven County passed a Flood Damage Prevention
Ordinance within the last couple of years which regulates filling and other activities in the floodplain of Craven
County. Please contact the Craven County Floodplain Administrator, which I believe is the Chief Building Inspector, to
see if the proposed fill in the floodplain would be allowable and/or require a Floodplain Development Permit and
provide documentation of the resulting outcome in order for us to consider this request. Please let me know if you have
any questions or if I may be of further assistance.

PDF showing the proposed location marked in orange.
I have looked and can’t find any information that states one way or the other. Is this allowable since the area will not be
in a buffer or wetlands, but is in the flood plain?

15.6 Temporary Encroachment in Regulatory Floodway
Temporary roads for construction activities and on -site detour traffic that last longer than one
year and encroach into the floodway must be reviewed and coordinated with NCFMP and the
community's floodplain administrators. The design engineer should perform hydraulic analysis
and work with Division Operations staff to include a provision in the project's contract to
stipulate the following, as applicable:
1. Boundary of the regulatory floodway
2. Duration of construction within the floodway
3. Installation of on -site stream gages
4. Installation of a flood warning system
5. Designated staging areas for equipment that are at least one (1) foot above the BFE
6. Notification of the affected property owners of the potential risk of flooding from the
temporary encroachment
7. Department commitment assuming liability for any flood damages resulting from the
temporary encroachment
No CLOMR or LOMR approvals will be required for the temporary encroachment into the
FEMA regulated floodway.
