facility was clean and neat in appearance. Employee training is done online through Environmental Certification
training. Also, due to the size of this facility an agreement was made with the State to only do Qualitative
Monitoring annually.

On January 17, 2019, a site inspection was conducted for the Milan Rail Yard facility located at 918 North Street,
Cumberland County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Mike
Gregory, REM, was also present during the inspection and his time and assistance is greatly appreciated. The site visit
and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCGO80000 under
Certificate of Coverage NCG080942. Permit coverage authorizes the discharge of stormwater from the facility to receiving
waters designated as an unnamed tributary to the Cape Fear River, a Class C waterbody in the Cape Fear River Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG080000 permit.
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the
inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty

Inspection Summary:
On January 17, 2019. Melissa Joyner met with Mike Gregory,REM, at the CSX - Milan Rail Yard facility. She reviewed the
Stormwater Pollution Prevention Plan (SPPP) which appeared orderly, containing the information required by General -Permit
NCG080000. The Site Map should indicate the percentage of each drainage area that is impervious. Facility inspections
should occur semi-annually and be documented in the SPPP. Outfall One was inspected and was in good condition. A bare
slope was eroding near the stream which will need to be repaired and stabilized with groundcover.

Confirming the several aspects that you discussed with Rick and me yesterday about the remote locomotive fueling
activities at fixed track -side locations:

The provisions of our stormwater General Permit NCG08 require that the remote fueling operations shall be
addressed in the permitted facility's SPPP.
o See Part II Section A 2.f. of the permit, page 3 of 10: "Remote Fueling Operations. If remote fueling
(or other vehicle maintenance activities] are conducted at offsite locations but coordinated from
the permitted facility, the plan shall include a component that describes the storinwater
managenient practices and BMPs used to prevent and/or minimize the contamination of
stormwater from such activities."
We advised you that twice -per -year sampling is not required at the track -side fixed fueling locations, based on
your report that the locations do not use 55 gallons of oil per month. At this point we do not consider that
diesel fuel is captured by the General Permit term "motor oil."
o See Part II Section B of the permit, page 5 of 10: "Analytical monitoring of stormwater discharges
shall be performed as specified in Table 1, for those facilities conducting vehicle maintenance
activities and utilizing more than SS gallons new motor oil per month when averaged over the year
(those vehicle Mai ntenanc a ivities not utiliijng more than S5 gallons of new mot r oil per month
are not required to conduct analytical monitoring]."
Based on the expectation of infrequent and short duration visits, we advised you that the presence of a tanker
truck at the remote fueling location does not trigger the discharge limitations provisions of Part II Section C of
the permit. I mean, under those constraints we don't consider that the permit provisions for petroleum bulk
storage stations and terminals should be extended to apply to the DTL tanker truck. This response is consistent
with our past responses related to tanker truck loading and unloading that we have addressed under other
stormwater General Permits for other industry sectors.
• We advised you that the General Permit requires only visual monitoring of the stormwater discharge at the
remote fueling locations. We still think that some form of visual monitoring or inspection at the remote fueling
stations is prudent, and required as part of the annual review of the SPPP. (See Part 11 Section A. 7.) However,
upon closer review of the permit text, it is not clear that the permittee is required to conduct visual monitoring
strictly in accordance with Part II Section D at the remote fueling sites. Our closer reading of the permit text
now is that the permittee is not required to conduct visual monitoring in accordance with Part II Section D at the
remote fueling sites. Again, we think Part-ll Section A 7 requires at least annual inspections or visual monitoring
of the remote fueling sites.

state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Energy, Mineral and Land Resources (Division). The Division may require modification or
revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division or permits required by
the Division of Water Resources, Coastal Area Management Act or any other federal, state or local
governmental permit that may be required.

Please review the attached NO1 application with the objective of responding to me with a recommendation to issue the
permit. I recognize that you may not visit each new permittee during this NOI review, but it affords you the opportunity
to log the permit into your regional database and add the facility to a future monitoring and compliance visit
schedule. Therefore, your recommendation now to issue the permit serves as your acknowledgement that (1) the
facility is located in your region, (2) that there are no current complaints outstanding about the facility that have not
been dealt with, and (3) that the facility may ultimately be inspected by the regional staff. I've also attached a scanned
