A copy of the Compliance Inspection Report is enclosed for your review. Mike Gregory, REM, was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCGO80000 under Certificate of Coverage NCG080942. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as an unnamed tributary to the Cape Fear River, a Class C waterbody in the Cape Fear River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG080000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day.for each violation. She reviewed the Stormwater Pollution Prevention Plan (SPPP) which appeared orderly, containing the information required by General -Permit NCG080000. The Site Map should indicate the percentage of each drainage area that is impervious. Facility inspections should occur semi-annually and be documented in the SPPP. Outfall One was inspected and was in good condition. A bare slope was eroding near the stream which will need to be repaired and stabilized with groundcover. If remote fueling (or other vehicle maintenance activities] are conducted at offsite locations but coordinated from the permitted facility, the plan shall include a component that describes the storinwater managenient practices and BMPs used to prevent and/or minimize the contamination of stormwater from such activities." We advised you that twice -per -year sampling is not required at the track -side fixed fueling locations, based on your report that the locations do not use 55 gallons of oil per month. I mean, under those constraints we don't consider that the permit provisions for petroleum bulk storage stations and terminals should be extended to apply to the DTL tanker truck. This response is consistent with our past responses related to tanker truck loading and unloading that we have addressed under other stormwater General Permits for other industry sectors. • We advised you that the General Permit requires only visual monitoring of the stormwater discharge at the remote fueling locations. We still think that some form of visual monitoring or inspection at the remote fueling stations is prudent, and required as part of the annual review of the SPPP. (See Part 11 Section A. 7.) However, upon closer review of the permit text, it is not clear that the permittee is required to conduct visual monitoring strictly in accordance with Part II Section D at the remote fueling sites.
