Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 890306 Modification dated March 2; 2004, for the construction of Piney Green Shopping Center (Golden Corral Restaurant). This permit shall be effective from the date of issuance until March 2, 2014, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This permit shall be effective from the date of issuance until March 2, 2014, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 377,230 square feet of impervious area. This pond must be operated with a vegetated filter. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. SCHEDULE OF COMPLL kNCE The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following crite-iia: a. The fountain draws its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. C. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for the fountain's pump is based on the permanent pool volume. The maximum pump power for a fountain in this pond is 1/3 horsepower. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below- 4 State Stormwater Management Systems Permit No. SW8 890306 Modification a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. If the proposed BUA exceeds the amount permitted under this permit, a modification to the permit must be submitted and approved prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. At least 30 days prior to the sale or lease of any portion of the property, the permittee shall notify DWQ and provide the name, mailing address and phone number of the purchaser or leasee. An access/maintenance easement to the stormwater facilities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale or lease of any portion of the property. 13. The permittee must maintain compliance with the proposed built -upon area and ensure that the runoff from all the built -upon is directed irao the permitted system. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 15. The permittee must maintain the current permitted drainage area. No additional runoff from outside of the permitted drainage area boundary may enter the permitted stormwater facilities without first applying for and receiving a permit modification. III. GENERAL CONDITIONS This permit is not transferable except after notice to and approval oy the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 8. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 9. The permittee shall notify the Division any name, ownership or mailing address changes within 30 days. Permit issued this the 2nd day of March 2004. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings. a. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to construction. 5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity and performanm of the system as permitted. A preliminary review of that information has determined that the application is not complete. As discussed over the phone on the afternoon of January 28, 2004, since Bailey & Associates retains ownership of the land and is simply leasing to the proposed Golden Corral restaurant, this application is a modification to the existing project, and will require a new permit. The following information is needed to continue the stormwater review: 1. Please complete Section 111.6 of the application on page 2, with the existing built -upon areas that were permitted in 1989.. Please report all built -upon areas in square feet on the application. , 2. Please initial page 2, sign and execute the enclosed wet pond supplement. The original certification of compliance had been erroneously issued to the consultant, and I must re -issue a permit to the correct responsible party. I am unable to issue the new permit without this completed form. 3. For your protection, please make sure that the lease agreement specifies the responsibilities that The Corral Group of Piney Green, LLC, shares for compliance with the stormwater permit issued to Bailey and Associates. They would include, for example, a limitation on the built -upon area to what is shown on the approved plans, a prorated share of the maintenance costs, (included in the rent amount) and a -requirement to direct all runoff into the permitted system. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to February 28, 2004, or the application will be returned as incomplete. SUMMARY OF WORK The CONTRACTOR for this section shall furnish all materials, supplies, equipment, labor, tools and all other incidentals necessary to construct the Stormwater Detention Pond and appurtenances, complete, and ready for use, as shown on the plans and as enumerated herein. Work necessary for the construction of the Stormwater Pond includes but is not limited to clearing and grubbing, dewater- ing, excavation, backfill, install piping system, grassing, and erosion control as shown on the plans and as outlined herein- after. 2. FIELD ENGINEERING A. OWNER will establish base lines for the Project and two bench marks for use by the CONTRACTOR. OWNER will fur- nish boundary surveys if required. B. CONTRACTOR shall: 1. Develop and make all detail surveys and measurements needed for construction including slope stakes, batter boards, and all other working lines, elevations and cut sheets. 2. Be solely responsible for all locations, dimensions and levels. No data other than written orders of the ENGINEER shall justify departure from the dimensions and levels required by the Drawings. 3. Safeguard all points, stakes, grade marks, monuments and bench marks made or established on the Work, re- establish same if disturbed and rectify all Work improperly installed because of not maintaining, not protecting or removing without authorization such established points, stakes, marks and monuments. 4. When requested by ENGINEER, provide such facilities as may be necessary for ENGINEER to check line and grade points placed by CONTRACTOR. Where applicable, CONTRACTOR shall do no excavation or embankment work until cross --sectioning necessary for determining pay quantities has been completed and checked by ENGINEER. 3. SUBMITTALS The CONTRACTOR shall submit a minimum of three (3) copies of all submittals, of the various materials and products, to the ENGINEER for approval. Of these, one (1) copy will be returned to the CONTRACTOR. UR-2 Each set of submittals shall include but not be limited to: 1. Drawings showing all dimensions units and locations of all other accessory equipment, including a piping layout. 2. All technical information needed by the ENGINEER to deter- mine if the proposed equipment meets the plans and specifi- cations. 4. TESTING LAB SERVICES A. General: Testing of materials, testing for moisture con- tent during placement and compaction of fill materials, and of compaction requirements for compliance with tech- nical requirements of the specifications shall be per- formed by a ,testing laboratory. B. Testing Services: 1. Test the CONTRACTOR'S proposed materials in the lab- oratory and/or field for compliance with the speci- fications. 2. Perform field moisture content and density tests to assure that the specified compaction of backfill materials has been obtained. 3. Report all test results to the ENGINEER and the CONTRACTOR. C. Authority and Duties off Testing Agency: Technicians re- presenting the testing laboratory shall inspect the mate- rials in the field and perform tests, and shall report their findings to the ENGINEER and the CONTRACTOR. When the ma- terials furnished or work performed fails to fulfill speci-. fication requirements, the technician will direct the at- tention of the ENGINEER and the CONTRACTOR to such failure. The technician shall not act as foreman or perform other duties for the CONTRACTOR. Work will be checked as it progresses, but failure to detect any defective work or materials shall not in any way prevent later rejection when such defect is discovered, nor shall it obligate the ENGINEER for final acceptance. 'technicians are not au- thorized to revoke, alter, relax, enlarge, or release any requirements of the specifications, nor to approve or accept any portion of the work. D. Responsibilities and Duties of CONTRACTOR: The use of testing services shall in no way relieve the CONTRACTOR of his responsibility to furnish materials and construc- tion in full compliance with the drawings and specifica- tions. UR-3 To facilitate testing services, the CONTRACTOR shall: I. Secure and deliver to the testing agency, without cast, preliminary representative samples of the materials he proposes to use and which are required to be tested. 2. Furnish such casual labor as is necessary to obtain and handle samples at the project or at other sources of material. 3. Advise the testing agency sufficiently in advance of operations to allow for completion of quality tests and for the assignment of personnel. 5. INSPECTION/CERTIFICATION James E. Stewart and Associates, Inc., as ENGINEER, will provide inspection throughout the performance of this Contract. All di- rectives issued to the CONTRACTOR will be through the ENGINEER and direct contact will generally not occur between the OWNER and the CONTRACTOR. Inspections will be made periodically or on a full time basis as the work progresses to insure compliance with these specifications and with the specification requirements shown on the plans. When requested by the ENGINEER, CONTRACTOR shall provide his services to insure to the ENGINEER'S satisfac- tion that all dimensions, lines and grades are as designed. In order for the ENGINEER to adequately inspect and approve this construction, testing services shall be provided by an approved testing laboratory. 6. GUARANTEE OF WORK A. Except as otherwise specified, all work shall be guaranteed by the CONTRACTOR and his sureties against defects resulting from the use of faulty or inferior materials, equipment, or workmanship for 12 months from the date of final completion of the work as signified by acknowledgement of receipt of Final Payment by the CONTRACTOR. B. If, within any guarantee period, repairs, or changes are re- quired in connection with guaranteed work, which, in the opin- ion of the ENGINEER, are rendered necessary as the result of the use of materials, equipment, or workmanship, which are inferior, defective, or not in accordance with the terms of the CONTRACT, the CONTRACTOR shall, promptly upon receipt of notice from the OWNER, and without expense to the OWNER: 1. Place in satisfactory condition, in every particular, all of such guaranteed work. 2. Correct all defects therein. L. GR-4 3. Make good all damage to the site, which in the opinion of the ENGINEER, is the result of the use of materials, equipment, or workmanship which are inferior, defective, or not in accordance with the terms of the CONTRACT. 4. Make good any work or material, or the equipment and contents of said building site, disturbed in fulfilling any such guarantee. C. If in fulfilling the requirements of the CONTRACT or of any guarantee embraced therein or required thereby, the CONTRAC- TOR disturbs any work guaranteed under another CONTRACT, he shall restore such disturbed work to a condition satisfactory to the ENGINEER, and shall guarantee such restored work to the same extent as it was guaranteed under such other CON- TRACT. D. If the CONTRACTOR, after notice, fails to proceed promptly to comply with the terms of the guarantee, the OWNER may have the defects corrected and the CONTRACTOR and his Surety shall be liable for all expenses incurred. E. All special guarantees applicable to definite parts of the work that may be stipulated in the specifications or other papers forming a part of the CONTRACT shall be subject to I the terms of this section during the first year of the life of such special guarantee. I SECTION II SITE WORK L SITE WORK SE C:T 1 ON 1 1 I. CLEARINU AND GRUBBING: Clearing shall consist of the cutting, removal, and satisfac- tory disposal of all trees, down timber, projection roots, stumps, lap wood rubbish, trash, and all other objectionable material within the construction limits as directed. Any spe- cific trees or shrubs designated to be saved by the OWNER shall be protected from injury during construction. Grubbing shall consist of the excavation, removal, and disposal of all stumps, roots, logs, and other perishable and objection- able material within the construction limits as directed. All clearing and grubbing shall be accomplished in such a manner as not to injure or destroy any merchantable timber or other property on land adjacent to the project site. Before any burning of debris shall occur, CONTRACTOR shall con- tact OWNER and ENGINEER for permission and location and CONTRAC- TOR will be required to secure ANY and ALL burning permits re- quired. All perishable material shall be burned in such a man- ner as not to injure trees or shrubs outside the project site or any tree or shrub designated to be saved. Any material that can- not be completely burned will be removed and disposed of at an off -site location at the expense of the CONTRACTOR. 2. EXCAVATION AND GRADING: All grading and excavation shall be in accordance with typical dimensions and cross -sections shown on the plans and specifica- tions contained herein. During excavation all topsoil suitable for reuse shall be stock- piled in an area' designated by the OWNER. All soils. suitable for reuse as backfill material shall be stockpiled in a separate area designated by OWNER. All soils unsuitable for reuse shall be stockpiled n a separate location as designated by the OWNER. Ser- vices of a testing laboratory shall be used to determine which soils are best suitable for reuse as backfill. In areas requiring backfill to construct the pond dikes, a mini- mum of 12-inches of topsoil and subsoil stripping shall occur prior to the commencement of backfill. S. DEWATERING: I. The CONTRACTOR shall provide and maintain adequate dewater- ing equipment to remove and dispose of all surface and ground water entering excavations, trenches, or other parts of the work. Each excavation shall be kept dry during sub- SW-2 grade preparation and continually thereafter until the struc- ture to be built, or the pipe to be installed therein is completed to the extent that no damage from hydrostatic pres- sure, flotation, or other cause will result. A. The working areas on the site (exclusive of sediment entrapment devices) shall be kept free of surface water at all times. The CONTRACTOR shall install drainage ditches and dikes and shall perform all pumping and other work necessary to divert or remove rainfall and all other accumulations of surface water from the exca- vations and fill areas. The diversion and removal of surface water shall be performed in a manner that will prevent the accumulation of water behind temporary struc- tures or at any other locations within the construction area where it may be detrimental. 8. Water used for working or processing, resulting from dewatering operations, or containing oils or sediments that will reduce the quality of the water downstream of the point of discharge shall not be directly discharged. Such waters shall be diverted through a settling basin or filter before being discharged. C. The CONTRACTOR is responsible for the condition of any pipe, conduit or channel which he may use for drainage purposes and all such pipes, conduits'or channels shall be left clean and free of sediment. 2. The CONTRACTOR shall provide, install, and operate suffi- cient trenches, sumps, pumps, hose, piping, wellpoints, deep wells, etc., necessary to depress and maintain the ground water level below the base of the excavations during all stages of construction operations. The ground water table shall be lowered in advance of excavation and main- tained two feet below the lowest subgrade excavation made until the structure has sufficient strength andd weight to withstand horizontal and vertical soil and water pressures from natural ground water. The system must be operated on a 24-hour basis and standby pumping facilities and personnel shall be provided to maintain the continued effectiveness of the system. I f , in the opinion of the ENGINEER, the water levels are not being lowered or maintained as required by these specifications, the CONTRACTOR shall install addi- tional or alternate dewatering devices as necessary, at no additional cost to the OWNER. 4. BACKFILL: After completion of stripping the area to receive embankment backfili and compaction, the CONTRACT UR shall place compacted backfill to construct the dikes for the stormwater pond in ac- SW-3 cordance with typical dimensions and cross -sections shown on the plans and requirements contained in the specifications herein. Any soft areas of subgrade containing unsuitable, wet or yielding material not readily capable of site compaction shall be removed and replaced with compacted select borrow material. Services of a testing laboratory shall be used to determine which soils are suitable as select borrow material. All fill shall be placed in horizontal loose lifts not exceed- ing 8-inches in thickness and shall be mixed and spread in a manner assuring uniform lift thickness after placing. Each lift shall be compacted by not less than two (2) complete coverages of the specified compactor. The compaction of the complete area of the backfill shall have a minimum compacted density of 95 percent as obtained by test procedures in ASTM D 1557 (modified proctor). Services of a testing laboratory shall be required to provide the CONTRACTOR with the required compaction density results to insure compliance with the above required compaction density. No fill material shall be placed when free water is standing on the surface of the area where the fill is to be placed. No compaction of fill will be permitted with free water on any portion of the fill to be compacted. No fill shall be placed or compacted in a frozen condition or on top of frozen material. Any fill containing organic materials or other unacceptable material previously described shall be removed and replaced with approved fill material prior to compaction. Each lift of compacted fill shall be compacted by the designated number of coverages of all, portions of the surface of each lift by a smooth -drum vibratory roller for granular material having a static weight not less than 5,500 pounds, a sheepsfoot roller for cohesive material exerting a pressure of 250 psi on the sur- face of the feet, or equivalent equipment approved by the ENGINEER prior to commencement of the work. One coverage is de- fined as the condition obtained when subjected to the direct contact of the compactor. The compactor shall be operated at a forward speed not exceeding 40 feet per minute. In some areas where soft soils are removed, it may be difficult to properly compact the first lift or two on the base of the undercut area. If the base is excessively wet, a working mat of compacted crushed stone shall be placed prior to placement and compaction of the fill. L SW-4 5. PIPING SYSTEM: A. GENERAL: 'The piping system required shall be constructed and installed as shown on the plans and as further described herein. The stormwater pond piping system shall include but not be limited to one 24-inch outlet pipe, one 24-inch riser pipe, one trash rack, an anti -seep plate and all appurtenances required for a complete installation. B. PIPING: 'The piping included shall be to the diameters and lengths shown on the plans. These pipes shall be fabricated of corrugated aluminum made from alloys of ALCAD 3004 or 5052. They shall be helically corrugated Corlix as manufactured by Kaiser Aluminum or an approved equal. All welding required shall be done in the factory. The units shall arrive to the site ready for installation. Flanges shall be welded to the pipes for easy connections in the field. 'The flanges shall be bolted together using 3/8-inch stainless steel bolts, nuts, and washers and using 3/16-inch neoprene gaskets. A trash rack shall be provided to the dimensions shown on the plan. The trash rack shall include an aluminum grate top with 1/2-inch openings welded to the top. An aluminum anti -seep plate shall be provided and installed per the dimensions and locations shown on the plans. 6. GRASSING• A. DYKES AND EMBANKMENTS: i 'The CONTRACTOR after grading and shaping the dikes and remaining areas as shown on the plans, shall furnish labor, tools and equipment to till and seed any and all areas, as outlined here- inbefore under site work. The entire area shall be given one application of agricul- tural lime at the rate of 2,UUU pounds per acre; super phosphate at 500 pounds per acre; a 12-4-8 grade fertilizer at the rate of 600 pounds per acre, all harrowed to a point that it is thoroughly mixed with the soil. The Contractor shall then furnish and sow, Rebel Fescue seed, at the Pate of 100 pounds per acre mixed with 25 pounds per acre of Bermuda. L_ I I 7. SW-5 A suitable cover of straw mulch shall be placed at a rate of 1.5 to 2 tons per acre on the entire area following the sowing operation. The CONTRACTOR shall then wet down the entire area to prevent the straw mulch from blowing away and to assist in earlier germination. In the case of extreme slopes, the straw mulch shall be stabilized by the application of an asphalt or other approved binding material. The Contractor shall guarantee entire area. A stand of grass when cover is at least 95%. B. Veoetative Filter and Spillway: a full stand of grass over the shall be considered acceptable A vegetative filter will be provided to the dimensions shown on the plans at the outlet of the piping system. The filter shall consist of Reed Canarygrass which shall be sown at a rate of 40 pounds per acre. The Canarygrass should be sown during the months of August to September or February to April. During other periods of the year it shall be sown with rye grass at the rate of 60 pounds per acre to guarantee a stand until such periods of the year when the Reed Canarygrass can be sown. The soil preparation of limes, super phosphates and fertilizers; the placement of a mulch cover and the guarantee of a stabilized stand shall be as previously specified. To aid in control of erosion and to aid in germination, a biode- arad :bl a rc-tec t i e mat sha l t~. 1 be placed and anchored overthe prepared soils and crass seed! ings. The protective mat shall be the Curlex Excelsior Blankets as manufactured by American Excelsior Company or an approved equal. The Excelsior Blanket shall be anchored as recommended by the manufacturer. The spillway and its backslope and outfall shall also receive the Excelsior Blanket to aid in erosion control and germination. The spillway shall receive the same grass covering asIspecified for the entire dike and embankments. EROSION AND SEDIMENT CONTROL MEASURES' A. NARRATIVE REPORT: The CONTRACTOR'S attention is called to the Narrative Report on Erosion and Sediment Control Measures, for Piney Green Shopping Center Additions, as prepared by dames E. Stewart and Associates, Inc. The "Narrative Report" will generally govern the basic work to be provided for the erosion and sediment control measures and seeding and grassing. The ENGINEER may direct minor changes in the shape, sizes, dimensions or materials for the construction of erosion and sediment control facilities from those specified in the "Narrativ Report". L SW-6 B. LOCATIONS: The erosion and sedimentation control measures shown on the plans, as specified herein and within the "Narrative Report", indicate the approximate locations of those measures on the basis of the existing topography within the area or on the basis of the pre— determined need for any specific area. Upon commencement of the operations in those areas where measures are proposed, the ENGINEER may make minor adjustments in location. The CONTRACTOR should generally not install any of the measures in a specific location until general direction is given by the ENGINEER. Upon direction by the ENGINEER, the CONTRACTOR shall install such measures in a reasonable and timely manner. C. VIOLATIONS: It will be the CONTRACTOR'S responsibility to provide the erosion and sediment control measures as shown on the plans or as other— wise specified in the Contract Documents or as directed by the Engineer. The CONTRACTOR is cautioned that these facilities will be installed as directed by the ENGINEER during the construction process. Any citations, penalties, or fines issued by the N.C. Department of Natural Resources and Community Development or any other agency resulting from negligence or the CONTRACTOR not providing the specified facilities will be the sole responsibility of the CONTRACTOR and the CONTRACTOR shall hold James E. Stewart and Associates, Inc., its authorized representatives and Bailey and Associates, Inc., harmless from any resulting damages or fines. I SECTION III OPERATION AND MAINTENANCE L L. L OPERATION AND MAINTENANCE SECTION III To assure that the stormwater pond operates as it was designed, proper maintenance of the stormwater pond and all appurtenances are necessary. Bailey and Associates, Inc., as OWNER, will be responsible for proper maintenance of the pond. The following list is a guideline to help the OWNER properly maintain this system. 1. To assure that the pond will not fill with sediment during the construction period of the shopping center, it is imperative that the erosion and sediment control measures designed be installed and maintained properly to prohibit any sediment from entering the pond until stabilization of the entire site has occurred. I Grassing requirements should be followed strictly and a stand of grass shall be provided within 30 days to stabilize the dike and embankments and assure minimal erosion. Rip rap structures should be installed and maintained as shown and described in the plans and the erosion and sedimen- tation control "Narrative Report° to help reduce erosive velocities of stormwater encountered. Once stabilization has occured these items should be checked on a monthly basis and properly repaired should any damage occur. 2. A pumping system will be required to drain the pond for maintenance. Bottom of pond elevations should be checked every year to determine the amount of 1sediment build-up. If sediment build-up is greater than one foot, the pond should be drained and excavated to the original pond bottom elevation. 3. The riser pipe, trash rack and small orifice opening should be checked every month to assure no clogging of the system or damage to the system has occurred. The trash rack screen and small orifice should be cleaned monthly to assure proper operation of the pond.. L4. Mow back slope of dam frequently enough to preclude growth of trees which may result in soil piping along root channels.
