Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. If something changes and your facility would again require stormwater or wastewater discharge permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the . proper permit coverage. He is 2 years in arrears. He reports that the sand pit has been closed down since 2012. I advised we would certainly forgive the current billing of $100 for the period March 2014 — February 2015, but that I would have to talk with Bradley about whether we will forgive the other past due $100 for the period March 2013 — February 2014. I advised that we will not rescind the permit until/unless our regional office staff report that all mining has ceased and that significant threats to storrwater runoff quality no longer exist. Butch responded that he would go by the sand pit this week to check out the site conditions. Wooten Briley Pit Dewaterin NCC��� Introduction Project Description The `Briley Pit' is an open pit mine that has recently been permitted by the North Carolina Division of Land Quality in accordance with the requirements of G.S. 74-51 of The Mining Act of 1971. Subsurface investigations have revealed select fill material meeting NCDOT Specifications to depths of approximately twenty-two feet. It is anticipated that the mine will be excavated to that depth, with the majority of the excavated material being used on the NCDOT Highway 17 Bypass project in Washington, NC. In order to efficiently mine the material and meet the anticipated project schedule, S.T. Wooten Corporation, the mine owner, intends to dewater the excavation as part of their operation. Project Location The site is located on a portion of Beaufort County Parcel Numbers 15022307 and 15019477, within the City of Washington's Extra Territorial Jurisdiction. The site is situated immediately east of NCSR 1456 (Page Road), between US Highway 264 and NCSR 1407 (Leggett Road). The site is within the Tar -Pamlico River basin and is adjacent to Mitchell Branch (Stream Index No, 28-103- 6, Class C, w, NSW). A vicinity map is provided in the Appendix. / Regulatory Requirements Mining Permit No. 07-54 was issued for the `Briley Pit' under the requirements of The Mining Act of 1971. A copy of the permit is found in the Appendix. Operating Condition I.A. of the mining permit states that "Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission". North Carolina General Statute 143-215.1 permits the discharge of mine dewatering, which is permitted under General Permit No. NCG020000. As part of this dewatering plan, a Notice of Intent for a General Permit No. NCG020000 is being filed with the North Carolina Division of Water Quality. As part of the General Permit, an Operation'and-Monitoring Plan will be -implemented due to the potential to drain wetlands adjacent to -the mine. The plan will conform to published monitoring requirements for mine dewatering wastewater as listed below. Page 2 S.T. Wetland impacts are to be avoided or minimized in accordance with State and Federal Regulations. These impacts include stress to wetland vegetation caused by the loss of ground water from the mining operation. A portion of this plan will address the means and methods to avoid those impacts. Site Characteristics The mine site comprises 56 acres +/- of a parent tract that has historically been in cultivation. The vast majority of the parent tract is cleared and actively farmed, while the remaining acreage is forested. The mine site is limited to the cleared portion of land that has been in active cultivation. Much of the forested land represents wetland and riparian areas around Mitchell Branch. Farm roads and farm ditches bound the site on the southwest, northern and northeast sides. Mitchell Branch and its associated wetlands and riparian buffers comprise the southern boundary. During an on -site determination by the North Carolina Division of Water Quality, the drainage ditches comprising the northern mine limits were determined to be exempt from to the Tar - Pamlico Riparian Buffer Rules. The U.S, Army Corps of Engineers has also determined that no jurisdictional wetlands are associated with those ditches. Copies of these determinations are provided in the Appendix. A pond of approximately 3.5 acres in size is located in the southwest corner of the property. The pond has formerly been a borrow pit for on -site use, and there are no plans for any excavation or dewatering in this area. The USDA National Cooperative Soil Survey indicates predominately Sb (Seabrook Loamy Sand), AaA (Alta Vista fine sandy loam), and To (Tomotley fine sandy loam) in -situ soils. A subsurface investigation was conducted by S.T. Wooten Corporation in January 2007. The Page 3 S.T. Wooten Briley Pit Dewatering borings extended to depths varying from 15 to 22 feet deep. Soils within the upper 2 feet are classified as clayey silt and topsoil. Fine to coarse grain sands were encountered to depths of 22 feet, with no significant presence of silt or clay fines. The groundwater table was found to be generally located within 5 feet of natural ground. A map showing boring locations along with the boring logs and analyses are found in the Appendix. Proposed Dewatering Plan i-o����� Two areas are designated for excavation for the project; Pit A and Pit B. Only Pit A is being tcon.s_idered for _dewatering_at this time. Dewatering will be accomplished using a perimeter well point system. A combination of two and three inch well points will be installed at intervals of six feet on center to a depth of approximately twenty-five feet along the perimeter of the excavation. The well points will be connected by a header pipe. Five twelve inch rotary pumps will be used to drive the system, which will ultimately outlet into Mitchell Branch. Details for the system layout, pumps and other appurtenances can be found in the Appendix. In order to affect an initial groundwater drawdown, flows of 2,000 gpm can be expected for approximately six weeks. Following the initial drawdown, flow rates just less than 500 gpm can be expected to maintain the desired groundwater level for excavation. Discharge will be measured and recorded by an in-Iine flow meter. Flow rates will be measured quarterly and the results will be provided to the Division of Water Quality. In order to ensure that Mitchell Branch provides an.adequate outlet for the additional flow created by the mine wastewater dewatering operation, the largest anticipated flow rate was analyzed. ThOnitial groundwater.drawdown is expected to generate a flow rate of 2,000 gpm,' �_. which is equal to 4._45 cfi. The watershed containing the mine site was delineated, with the twin culverts under U.S. Highway 264 being the ultimate outlet. The additional overland flow that will occur during initial groundwater drawdown is equivalent to 9.6% of the flow discharged from this watershed during the Iyear - 24hour storm. With the downstream culverts sized to carry the 50-year storm, the additional flow during initial drawdown will have little effect on the ��pC capacity of the culverts..`' S.T. Wooten Corporation has also agreed to cost -share with the City of Washington for a' snag }�\�`' and drag" project on the portion of Mitchell Branch adjacent to the mine site. This will helper eliminate existing natural dams that have impeded flow within Mitchell Branch between NCSR` 1407 (Mitchell Branch) and U.S. Highway 264. S.T. Wooten Corporation has also volunteered its services to the City of Washington for evaluation of the effect of removing an existing railroad trestle located on Mitchell Branch just downstream of U.S. Highway 264. These efforts will further ensure that Mitchell Branch achieves improved performance both during and afler • the operation of the mine. The filtered water from the well point system will be cycled through C the wetlands adjacent to Mitchell Branch. A--1,00-foot.buffer-between the wetlands and the pit g excavation is provided as part of the mining plan to help minimize the influence of dewatering U on the wetlands. In addition to physical separation of the well point system and the wetland system, it is intended to utilize the filtered discharge water to maintain the hydrology of the wetland system. Over the duration of the dewatering operation, the wetlands adjacent to Mitchell Branch will be consistently irrigated with a flow equivalent to 1.9% of the 1 year — 24 hour storm event. in addition to constant irrigation,ts x'monitori_ng wells -are proposed to be en installed between the mine exaction and the wetland limits. The monitoring wells will be three Ito tVil inch diameter casings installed to a depth of twelve feet below adjacent natural ground. Water lT levels at each monitoring well will be recorded monthly and the data will be provided to the Division of Water Quality. Samples were collected during the month of February to establish background turbidity levels in Mitchell Branch and in other existing drainage features upstream and downstream of the proposed mine. cBackground turbidity levels; average ,between 10 NTU and 27 Mt.
